July 1, 2015 Municipal Building 121 Evergreen Road New Egypt, NJ 08533 The Workshop Session of the meeting of the Plumsted Township Committee was called to order by Mayor Trotta. STATEMENT: "This meeting is being held in compliance with the Open Public Meetings Act. It was advertised for publication in the Asbury Park Press and posted on the bulletin board. THOSE OFFICIALS PRESENT WERE: COMMITTEEMAN LOTITO COMMITTEEMAN MARINARI MAYOR TROTTA ADMINISTRATOR DANCER CLERK HENDRICKSON ATTORNEY KELLY DAVID LEUTWYLER, CDC Deputy Mayor Sorchik and Committeeman Wysong were excused, both were traveling. Mayor Trotta asked for a moment of silence. Mayor Trotta reviewed the agenda. Mayor Trotta reviewed the evening s agenda. Trotta said there were two ordinances for introduction. Ordinance No. 2015-07 would rescind the current Precious Metals Ordinance and replace it with a new ordinance. Trotta said this ordinance came directly from the Ocean County Prosecutors Office, Plumsted is one of the two municipalities that don t current have this ordinance in place. The second ordinance, Ordinance No. 2015-08 creates a chapter for scrap metal; this will enable the police to track and find stolen items easier. Trotta said only a few minor changes were made. There was brief discussion on how the ordinances work. Trotta said there is one precious metals license and one scrap metal business in Plumsted. Sandy Heller of the New Egypt Flea Market asked if all of the flea markets would be affected by this, Trotta told her no, only the ones that deals with precious metals. Mayor Trotta said there was an issue with one of the Municipal Court employee s rate of pay. She was being paid $100 a session and this wasn t the correct amount. An email has been received that says she can continue to be paid this amount. Her hourly rate is $15.61 for what is considered other work. What is happening was she was being paid under the DWI fund which is a $100.00 per session, the other is an hourly rate. The CFO has asked that the salary resolution be updated, if the Committee is okay with $100 per session rather than hourly she would ask the committee to amend the resolution. Trotta suggested that it be changed to a flat rate of $100.00 per session, the Committee was in agreement with this and the resolution will be amended. Administrator Dancer said the Ocean Civil Division of the Courts have authorized that this can be paid out of the DWI account and would not impact the budget. Mayor Trotta explained Resolution No. 2015-213. Donna s Law would eliminate applicable court costs in certain medical event related motor vehicle accidents if summons are issued. This resolution will support Assemblyman Dancer s bill. Trotta asked Attorney Kelly to brief the Township Committee on Resolution No. 2015-214 which ratifies the filing of a motion to participate with the State Board of Public Utilities concerning the Southern Reliability Link. Committeeman Marinari briefed the Township Committee on the change in the Teacher s Union insurance they are working on a resolve for this. Marinari said at a recent Recreation Committee meeting there was considerable discussion about graffiti on the recreation buildings etc. Marinari said it wasn t until recently that he heard about this. Marinari continued by saying there is broken glass on the baseball fields where the players slide into the bases. Marinari said he has spoken to Chief Petrecca who said he would be briefing the police officers on this issue so they can keep an eye on it. Marinari said the next recreation meeting will be tomorrow night (July 2 nd ), Mayor Trotta asked Marinari to remind the chairman of the recreation committee to address CFO Madden s request regarding the budget. Trotta asked Marinari to see if there is anything going on October 17 th at the recreation fields. Trotta said signage is in place, the insurance carrier recently did a walk-through of the buildings and grounds. Committeeman Lotito asked about the liability to the Township with glass on the recreation fields. Marinari also mentioned the issue of animal waste on the fields. Trotta said an email alert will be sent out again. 1

Committeeman Marinari said the Environmental Commission recently did research regarding a new business that is coming to Route 537, Marinari suggested that they put together something regarding their findings. Committeeman Lotito said the police department recently had a demonstration of the view system by Gramco. There were a couple of things that the Chief asked for and Gramco could not provide what he needed to satisfy the Attorney General s requirements. They followed up with Lotito but not to the satisfaction of the Chief. Lotito will look for other companies that provide this equipment. Lotito said he also met with the Arts Council for the first time. Lotito said they want to apply for 501(3)(c) status. Administrator Dancer explained the Senior Outreach Service is a 501(3)(c), perhaps they could get guidance from them or from the Township s Auditor. There was nothing else for workshop. Attorney Kelly read Resolution No. 2015-196 for Executive Session. RESOLUTION NO. 2015-196, A RESOLUTION OF THE TOWNSHIP OF PLUMSTED, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE CONVENING OF AN EXECUTIVE SESSION IN ACCORDANCE WITH THE OPEN PUBLIC MEETINGS ACT WAS ADOPTED. ROLL CALL VOTE: ALL AYES. Mayor Trotta called the Regular Session of the meeting to order with the Flag Salute and introduced the professionals at the dais. MINUTES: THE WORKSHOP/REGULAR/EXECUTIVE SESSION MEETING OF APRIL 1, 2015 WAS APPROVED AS SUBMITTED. ROLL CALL VOTE: ALL AYES THE SPECIAL MEETING MINUTES OF APRIL 10, 2015 WILL BE HELD FOR THE NEXT MEETING. CORRESPONDENCE: Audit Discussion of June 19, 2015 as submitted by CFO June Madden. Administrator Dancer added that the Auditor has informed him that the completed audit and recommendations will be to the committee before the next meeting. Mayor Trotta noted that there were no comments or recommendations for the audit. PRESENTATIONS: Mayor Trotta asked Miguel Garces and his wife Patty to come to the dais. Mayor Trotta presented Garces with a Certificate of Recognition and Appreciation. Garces said he had been on the Planning Board/Land Use Board for 19 years. He also served on the Environmental Commission. Garces thanked all of the volunteers of Plumsted Township and the people that work here. Garces also said Plumsted has become a model for the entire State in conservation and land use planning it was a lot of fulfilling work. Ron Dancer as Assemblyman presented Garces with a Joint Legislative Resolution. Dancer said that Miguel has 30 years as a New Jersey State employee where he managed the site remediation program for the DEP; he was highly esteemed member. Dancer continued by saying the Garces was the leading voice in the adoption of the Township s Conservation Plan Element to the Master Plan and a leading crusader in the Open Space/Natural Lands and the Woodland Protection program. He also brought to the attention of the Planning Board and Township Committee that ultimately was adopted the soil ordinance that would require testing for certain pesticides. Dancer thanked Garces for coming on board and becoming an outstanding VIP (Volunteers in Plumsted) none of this would have been possible without the support of his wife Patty. Garces was also a representative to the Pinelands Commission. Dancer once again thanked Garces by saying he was an important part in retaining the rural character of our community. Mr. Garces said he was retiring in about 30 days and would be leaving the State of New Jersey and moving to Delaware. He said it was an honor working with the Township. ORDINANCE: Introduction ON MOTION OF COMMITTEEMAN MARINARI, SECONDED BY COMMITTEE LOTITO, ORDINANCE NO. 2015-07 AN ORDINANCE OF THE TOWNSHIP OF PLUMSTED COUNTY OCEAN, STATE OF NEW JERSEY RESCINDING CHAPTER 47AA OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF PLUMSTED ENTITLED PRECIOUS METALS, GEMS AND JEWELRY DEALERS AND ESTABLISHING A NEW CHAPTER 47AA PRECIOUS METALS WAS INTRODUCED AND PASSED ON FIRST READING. Mayor Trotta said Ocean County has asked the Township to adopt this ordinance along with the other municipalities in the county. The second reading and public hearing will be August 5, 2015. Trotta added the businesses that currently hold a precious metals license will not need a new license but will have to abide by the new ordinance once it is adopted. ON MOTION OF COMMITTEEMAN MARINARI, SECONDED BY COMMITTEEMAN LOTITO, ORDINANCE NO. 2015-08 AN ORDINANCE OF THE TOWNSHIP OF PLUMSTED, COUNTY OF OCEAN, STATE OF NEW JERSEY CREATING AND ESTABLISHING CHAPTER 52AAA OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF PLUMSTED ENTITLED SCRAP METAL, WAS INTRODUCED AND PASSED ON FIRST READING. ROLL CALL VOTE: ALL AYES. This ordinance was also recommended by the County. The second reading and public hearing will be on August 5, 2015. THE FOLLOWING RESOLUTIONS ON A CONSENT AGENDA ARE CONSIDERED ROUTINE AND SHALL BE ENACTED BY ONE MOTION. REPORTS SUBMITTED FOR COMMITTEE REVIEW: CONSTRUCTION REPORT MAY, 2015; AND TAX COLLECTOR S REPORT MAY, 2015 Mayor Trotta asked for old or new business from the Committee. Committeeman Marinari said he continues to get calls from residents expressing their concerns regarding the proposed gas pipeline. Marinari said one man said that the pipeline would be going between his house and his water source. Marinari continues to tell people to express their concerns to their assemblyman and Mayor. Trotta said he urges everyone to contact NJ Natural Gas to insist they have a meeting in Plumsted Township and at a convenient time not at 5:30 in the afternoon, working people can t get there. Everyone should be able to listen to the questions and answers. Marinari said NJNG has not yet gotten the information he has asked for. Trotta said he can get that information to him. Marinari said that it was time to replace the POW flag outside the building. Trotta said that both the POW flag and the American Flag need to be replaced. Leutwyler was instructed to have the maintenance department check all of the flags on Township property and replace all that need to be replaced and order two for each of the flags being replaced. Mayor Trotta opened the meeting to the public. Barbara Diblin of 12 Terrace Avenue asked what has been done about any kind of prayer being said before the meeting. She asked the three (3) committee people present how they felt about it. Trotta said at the last meeting either Committeeman Wysong or Committeeman Lotito were going to reach out to the other committee people to discuss prayer. Trotta said he and Committeeman Marinari haven t heard anything at this time, so there hasn t been any further discussion and they are not going to move forward at this time. Diblin understood that the committee wasn t going to move forward until there was more discussion and there were two (2) 4

committeeman absent tonight. Committeeman Lotito confirmed it was Committeeman Wysong who was to reach out to set up a meeting. Marinari also said that Committeeman Wysong wasn t in attendance at a previous meeting where this was discussed. Diblin thanked the Committee and said she would see them next month. Lenny Grilletto asked if there was a copy of the audit available. Trotta said that the Committee hadn t received the audit yet. Sandy Heller of 150 Evergreen Road said a company working with NJNG had been out doing soil borings along Route 537. Mayor Trotta asked for any other comments from the Committee or public.
