County of Santa Clara Wednesday, Minutes Regular Meeting 1 Call to Order/Roll Call The regular meeting of the Parks and Recreation Commission (PRC) is called to order by Chairperson Hintermeister at 6:37 pm in the Isaac Newton Senter Auditorium, County Government Center, 70 West Hedding Street, San Jose A quorum is present Members Present Members Absent Susan Brain Daniel Murillo Jan Hintermeister Kris Wang Steven Munzel Greg West (1 vacancy) 2 Introduce new Commission member Steve Munzel Chairperson Hintermeister introduces newly-appointed Commissioner Munzel Commissioner Munzel provides information regarding his background, noting that he has participated on the City of Milpitas Parks, Recreation, and Cultural Resources Commission for 20 years and that he is the current Chairperson Chairperson Hintermeister expresses appreciation to Commissioner West for his efforts and leadership as the PRC Chairperson for the past two years 3 Public Presentations Jim Foran, Open Space Authority, provides comments regarding the decision of the Board of Supervisors to allow the use of the Park Charter Fund for mitigation of habitat damage caused by a County department He directs attention to Page 46 of the County Parks and Recreation System Strategic Plan, No 214, which relates to responsibility of other organizations and the County Parks and Recreation Department (PRD) for the acquisition of open space areas for natural habitat conservation, water quality, or agriculture He notes that areas of natural habitat for protected species are already protected by law and that the 1

party responsible for damage is responsible for providing mitigation Kitty Monahan, New Almaden Quicksilver County Park Association, invites the Commissioners to participate in the Pioneer Day event that will be held on October 11, 2008 at the New Almaden Quicksilver County Park Mike Boulland, Friends of Santa Teresa Park (FOSTP) and Friends of Los Alamitos Watershed (FOLAW), provides information regarding the new FOSTP newsletter, dated August 2008, and the preservation of the historic Jacoba Bernal House Additionally, he expresses appreciation to the PRD staff for their assistance and support to the FOLAW members at a recent coastal clean-up event 4 Approve minutes of August 6, 2008 meeting Commissioner Brain moves that the minutes of the August 6, 2008 meeting be approved, and Commissioner West seconds the motion The motion fails on a vote of three to zero, with Commissioner Munzel abstaining On order of the Chairperson, there being no objection, it is ordered that approval of the August 6, 2008 minutes be held until the next meeting 5 Approve Consent Calendar Commissioner West requests that Item No9 and Item No11 be removed from the Consent Calendar for discussion ordered that the Consent Calendar be approved to include Item No10 and Item No12 6 Accept oral report from Lisa Killough, Director, Parks and Recreation Department (PRD) Lisa Killough, Director, PRD, provides information on events and activities pertaining to the PRD, such as dedication of the Bay Area Ridge Trail at Penitencia Creek Park on October 25, 2008 and certification of the PRD as a Green Business by the Bay Area Green 2

Business Association In addition, she provides an overview of some of the decisions by the Board of Supervisors relating to the County Park System, including approval of the use of the Park Charter Fund for the Santa Clara Valley Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) and approval of the Revised Initial Study and Mitigated Negative Declaration for the Sanborn Trails Master Plan Chairperson Hintermeister requests that a written report be provided describing the key issues concerning the use of the County park lands and Park Charter Fund for the HCP/NCCP Ms Killough responds that the PRD will provide a report at a future meeting On Commission consensus, it is ordered that the oral report be accepted 7 Accept status report relating to the development of the Santa Teresa County Park Historic Area Site Plan The Commission considers a memorandum from Ms Killough, dated, regarding a status report on the development of Draft Preferred Design Alternative for Santa Teresa County Park Historic Area Site Plan (Draft Site Plan) Antoinette Romeo, Park Planner, PRD, provides introductory comments and presents information relative to the development of the Draft Site Plan She describes maps pertaining to the Historic Area and the project site, the Conceptual Design Diagrams 1 and 2, and the various elements and materials that have been incorporated into the Draft Site Plan, such as landscaping, walls, and fences She notes that a community meeting will be held on October 14, 2008 at Santa Teresa Golf Club to discuss the Draft Site Plan and that the final document will be submitted to the Board of Supervisors in February 2009 for approval Discussion ensues among the Commissioners and staff regarding the Draft Site Plan, including the capability of the proposed dry creek to hold some amount of water, if desired; adherence to County guidelines to construct a green building for the proposed visitor center, utilizing the water from Santa Teresa Spring for irrigation, and incorporation of Ignacio Bernal and Pedro Bernal historic houses into the Site Plan 3

Roland Lebrun, member of the public, expresses an objection to the proposed turn-around on the end of Manila Drive, and he requests that updated information regarding the development of the Draft Site Plan be included on the PRD website Further, he expresses a concern regarding the removal of access to some areas in Santa Teresa County Park, including trail access to Buck Norred Ranch from Santa Teresa Spring Finally, he inquires regarding the status of the restoration of the East Barn at Bernal-Gulnac-Joice Ranch Michael Bosworth, Santa Teresa Foothills Neighborhood Association (STFNA), requests that Ms Romeo meet with members of the STFNA to discuss a proposal to create an access from Coyote-Alamitos Canal Trail to Santa Teresa County Park and the Historic Area Mr Boulland expresses a concern regarding the lack of security for the Bernal Family historic houses and he requests that additional notice regarding community meetings be provided Ms Monahan requests that the community meeting scheduled for October 14, 2008 be rescheduled for another date not to coincide with the Annual Volunteer Coordinating Council event In addition, she requests that the Norred Trail be connected to the proposed parking lot located on Curie Drive and San Ignacio Avenue, and that the proposed Historic Site be open to the public on a daily basis John Klimaszewski, STFNA, comments that there is a lack of integration of the trails and access through Santa Teresa County Park to the proposed Historic Site He requests that the Commissioners visit the Park with the planner and discuss the integration of the proposed Historic Site into the Santa Teresa County Park Discussion ensues among the Commissioners and staff regarding the East Barn at Bernal-Gulnac-Joice Ranch that is scheduled for improvement in 2010 and the Coyote- Alamitos Canal Trail that is partly-owned by the Santa Clara Valley Water District Mr LeBrun directs attention to Page 2 of the Santa Teresa County Park Historic Area Site Plan, 4

Design Program 2008, dated May 6, 2008, which reflects control of access to the Coyote-Alamitos Canal service road at entry points Chairperson Hintermeister encourages the members of the public to participate at the upcoming community meeting to further discuss any concerns pertaining to the Draft Site Plan Commissioner West suggests that the community meeting scheduled for October 14, 2008 be rescheduled for another date or that an additional community meeting be held Chairperson Hintermeister comments that the concerns of the community members relative to security and the Coyote-Alamitos Canal need to be addressed Furthermore, discussion ensues between Chairperson Hintermeister and Ms Romeo about maintenance of the proposed native grassland, hydrology of the Santa Teresa Spring, and success in combining native plants and non-native plants On motion of Commissioner Munzel, seconded by Commissioner West, it is unanimously ordered that the report be accepted 8 Approve Rules of Procedure to be forwarded to the Housing, Land Use, Environment and Transportation Committee and subsequently to the Board of Supervisors for approval The Commission considers the updated Rules of Procedure document that was discussed at the August 6, 2008 PRC meeting ordered that the Rules of Procedure be approved and forwarded to the Housing, Land Use, Environment and Transportation Committee and subsequently to the Board of Supervisors for approval 9 Accept a Summary of the Board of Supervisors actions relating to County Parks The Commission considers a memorandum from Ms Killough, dated, regarding the Summary of the Board of Supervisors actions Commissioner West inquires regarding inclusion of the appointments to the PRC by the Board of Supervisors in the report Ms Killough responds that the summary provides information on the Board of 5

Supervisors' actions relating to the County Parks System The Deputy Clerk advises that information pertaining to appointment of a new PRC member is provided to the Commission as the information becomes available ordered that the Summary of the Board of Supervisors actions relating to County Parks be accepted * 10 Accept Special Events Report ordered that the Special Events Report be accepted 11 Accept Legislative Report The Commission considers a memorandum from Ms Killough, dated, relating to the Legislative Report In response to a request by Commissioner West, Ms Killough provides an update regarding a few items of legislation concerning the County Parks, including Assembly Bill (AB) 2537, relating to public works volunteers, that was signed by Governor Schwarzenegger; and AB 31, pertaining to Statewide Park Development and Community Revitalization Act 2008, that was also signed by the Governor On motion of Commissioner West, seconded by Commissioner Munzel, it is unanimously ordered that the Legislative Report be accepted * 12 Consider Business Schedule from August 2008 through September 2009 ordered that the Business Schedule from August 2008 through September 2009 be considered 6

13 Consider Committee assignments The Commission considers a memorandum from Ms Killough, dated, relating to PRC Committee assignments Chairperson Hintermeister initiates discussion regarding possible changes to the Committee assignments, and he indicates that appointments to the various committees will be completed at the next PRC meeting Commissioner West expresses a preference to participate on the Open Space Authority, the Martial Cottle Park Master Plan project, the Marketing/Funding Committee and the Acquisition Review Committee (ARC) Commissioner Brain indicates that she would like to participate on the Park Naming Committee (PNC), the Interpretive Plaques and Monuments Evaluation Committee (IPMEC), and the ARC Additionally, she requests that another Commissioner be appointed to replace her on the Volunteer Coordinating Council (VCC) Commissioner Munzel states that he would like to serve on the PNC, the IPMEC, and as a Liaison to the Youth Science Institute He advises that he could also serve as a Liaison to the City of Milpitas Parks, Recreation, and Cultural Resources Commission 14 Announcements and Correspondence: a Chairperson Hintermeister indicates that there is currently one vacancy on the Commission and to access the online application for Boards and Commission membership, browse to https://eformssccgovorg/lfserver/abaa (Note that the URL is case-sensitive) b Chairperson Hintermeister states that Phyllis Perez, Clerk of the Board of Supervisors, will retire on October 3, 2008, after 43 years of service to the County of Santa Clara Maria Marinos, Chief Deputy Clerk of the Board, has been appointed to serve as the Clerk of the Board of Supervisors effective Monday, October 6, 2008 c Chairperson Hintermeister informs the Commission that the Annual Boards and Commissions Recognition Event is scheduled for December 8, 2008 at 5:30 pm in the County Government Center Cafeteria, and that invitations will be mailed to Commission members 7
