RECORD OF PROCEEDINGS MINUTES OF JACKSON TOWNSHIP BOARD OF TRUSTEES MEETING DECEMBER 20, 2018 Hawke called the meeting to order 4:02 p.m. at the Jackson Township Hall with all Trustees, Fiscal Officer, Vaccaro, Brink, Hogue and Berczik present. Hawke moved and Walters seconded a motion to go into Executive Session for Police Department Personnel (Appointment/Employment/Compensation) Discipline. Upon return from Executive Session at 5:02 p.m., Hawke called the General Session to order with all department heads present except Boger. He requested that all cell phones be turned off at this time. The Pledge of Allegiance was recited. Public Speaks None Administration Department ATTACHMENT 12/20/18 A Hawke moved and Pizzino seconded a motion to re-appoint the following members to serve on the 2019 Highway/Traffic Citizens Advisory Committee: 1. Jeannette Cho 2. Richard Evans 3. Klaus Kuttrus 4. Janice Spadone Hawke moved and Pizzino seconded a motion to dissolve the Park Citizens Advisory Committee effective December 31, 2018. Walters pointed out that the Friends of the Park act in the same capacity as the Park Citizens Advisory Committeee. ATTACHMENT 12/20/18 B Hawke moved and Walters seconded a motion to approve the appropriation transfer request from account code 101.110.5764, Land/Bldgs Site Improvements, to account code 101.110.5454, Economic Dev Admin, in the amount of $37,300.00 and from account code 101.110.5114, Temp. Services, to account code 101.110.5110, Salaries, in the amount of $6,339.00. RESOLUTION 18-249, ATTACHED ATTACHMENT 12/20/18 C RATE ADJUSTMENT FOR LONGEVITY MANAGEMENT PERSONNEL Hawke moved and Walters seconded a motion that effective the pay period beginning July 6, 2019, the Management Personnel (Classes A, B, and C) hired before July 1, 2012, with continuous full- Page 1 of 6 December 20, 2018

time service with the Township as of June 30, 2019, shall receive a rate adjustment for longevity consistent with the rate identified on the attached. Gonzalez said this puts the management personnel longevity pay in line with all the union contracts. He said the longevity is being added to the pay rate. ATTACHMENT 12/20/18 D Hawke moved and Walters seconded a motion not to request a hearing on the liquor license for Bravo Brio Restaurant Group Inc. dba Bravo Cucina Italiana & Loft, 4224 Everhard Rd. NW & Patios, Canton, OH 44718. RESOLUTION 18-250, ATTACHED PUCO CERTIFICATION APPLICATION Hawke moved and Walters seconded a motion that we hereby adopt and authorize the placement of the Board President s signature upon the attached PUCO Certification Application and the attached Affidavit. ATTACHMENT 12/20/18 E Stream & Wetlands Foundation Agreement Hawke moved and Walters seconded a motion to adopt and authorize the placement of the Administrator/Law Director s signature upon the attached Final Credit Request Form and In-Lieu Fee Credit Purchase Agreement, and the Board authorizes payment of $63,700.00. RESOLUTION 18-251, ATTACHED YARD WASTE SERVICE AGREEMENT Hawke moved and Walters seconded a motion that we hereby adopt and authorize the placement of the Board President s signature upon the attached Yard Waste Service Agreement with Earth n Wood Products, Inc. It was pointed out that with this agreement it allows for the Township yard waste site to operate for three more years. Public Works Department Highway Division RESOLUTION 18-252, ATTACHED RIVERSIDE AVENUE NW (TR-353) SPEED STUDY Hawke moved and Walters seconded a motion whereas, a request has been made to this Board that the statutory vehicular speed limit established by ORC Section 4511.21 is greater than that considered reasonable and safe on Riverside Avenue NW (TR-353) between Township Line and Forty Corners Street NW. Whereas, this Board has caused to be made an engineering and traffic investigation upon the section of road described as above; and Page 2 of 6 December 20, 2018

Whereas, it is the belief of this Board that such investigation confirms the allegation that the existing speed limit of 55 mph is unrealistic. Be it resolved by the Board of Trustees of Jackson Township, Stark County, Ohio that: Section 1: By virtue of the provisions of ORC Section 4511.21 the Director of Transportation is hereby requested to review the engineering and traffic investigation and to determine and declare a reasonable and safe prima facie speed limit on Riverside Avenue NW (TR-353) between Township Line and Forty Corners Street NW, Jackson Township, Stark County, Ohio. Section 2: That when this Board is advised that the Director of Transportation has determined and declared a reasonable and safe speed limit on the section of road described in Section 1 hereof, standard signs, properly posted and giving notice thereof will be erected. ATTACHMENT 12/20/18 F Hawke moved and Walters seconded a motion to adopt and authorize the Board President s signature upon the attached Change Order No. 2 for the Strip Avenue NW Extension Project. RESOLUTION 18-253, ATTACHED STRIP AVENUE NW EXTENSION PROJECT EXTENSION OF TIME AGREEMENT Hawke moved and Walters seconded a motion that we hereby adopt and authorize the placement of our signatures upon the attached Strip Avenue NW Extension Project Extension of Time Agreement with Wenger Excavating, Inc. Park Division Hawke moved and Walters seconded a motion to accept a donation of $72.00 from the Teeg Family LLC. Fire Department ATTACHMENT 12/20/18 G Hawke moved and Walters seconded a motion to approve the appropriation transfer request from account code 210.210.5220, Hospitalization, to account code 210.210.5212, Pension Employer Fire, in the amount of $46,960.54, and from account code 228.210.5220, Hospitalization, to account code 228.210.5212, Pension Employer EMS, in the amount of $627.94. Hawke moved and Walters seconded a motion to accept an anonymous donation of $50.00. Zoning & Planning Department RESOLUTION 18-254, ATTACHED INITIATION OF ZONING TEXT AMENDMENT Hawke moved and Walters seconded a motion whereas, the Jackson Township Board of Trustees from time-to-time receive recommendations for text amendments to the Jackson Township Zoning Resolution. Whereas, the Jackson Township Board of Trustees having reviewed the attached text changes and believe the recommendations deserve consideration by the Jackson Township Zoning Commission. Be it resolved that, pursuant to ORC 519.12(A)(1), we authorize the Zoning Inspector, as the Board of Trustees designee, to file an application with the Jackson Township Zoning Commission initiating a text amendment to the Jackson Township Zoning Resolution. Associated fees are hereby waived. ATTACHMENT 12/20/18 H Hawke moved and Walters seconded a motion to appoint Matthew C. Sutter to serve as a member of the Jackson Township Zoning Commission for a five-year term, from January 1, 2019 through December 31, 2023. ATTACHMENT 12/20/18 I Hawke moved and Walters seconded a motion to appoint Justin J. Gantz to serve as Alternate Member 1 of the Jackson Township Zoning Commission for a one-year term, from January 1 2019 through December 31, 2019. Hawke moved and Walters seconded a motion to appoint Matthew A. Williams to serve as Alternate Member 2 of the Jackson Township Zoning Commission for a one-year term, from January 1, 2019 through December 31, 2019. RESOLUTION 18-255, ATTACHED TOWNSHIP ADMINISTRATOR/LAW DIRECTOR BASE COMPENSATION Hawke moved and Walters seconded a motion that, effective December 30, 2017, the annual base compensation salary of the Township Administrator/Law Director shall be $124,737.60; and, Be it resolved that, in addition to Township Administrator/Law Director annual base compensation, the Township Administrator/Law Director shall be entitled to additional salary compensation for additional areas of responsibility and/or duties related to : Lead Counsel, Economic Development and CLOUT Representation, pursuant to ORC Sections 505.031, 505.032(G) and 504.15; and, Be it further resolved that, effective December 22, 2018, and every year thereafter, the Administrator/Law Director shall receive additional compensation in the amount of $15,000.00 in compensation, for the aforementioned duties, for a total annual compensation of $139,737.60 ($67.1815 per hour); and, Be it further resolved that, under Article II of the Benefit Package for Management Personnel adopted June 26, 2012 and amended on July 10, 2018, the base compensation salary of the Township Administrator/Law Director shall be a minimum of three percent (3%) more than the total compensation salary of the department head with the highest base compensation salary; and, Be it further resolved that Resolution No. 17-143 and Resolution 17-164 are hereby repealed, effective January 1, 2019. New Business Gonzalez said this has been a really big year for Jackson Township. He said the Board of Trustees sometimes doesn t get enough credit for all the things going on. He said they have done a great job of keeping track of all the stories. He said if you look at the things that were pushed through solely by the elected officials of the Township and Mike Vaccaro; the wonderful office park getting started at Keck, they re moving dirt; the COMDOC deal is done; the Tam-O-Shanter deal is coming together; Strip Extension got one. He pointed out that these are multi-million, major things that are going on in the Township. He said they are driving a lot of things that are good for Jackson Township and Stark County. He thanked the Board for giving him the opportunity to work on these projects and that it has been great working with them. Hawke thanked Gonzalez and Vaccaro for all the time they have spent working on all those projects. Brink thanked the Board, Fiscal Office, Law Department and Administrator for their support. He said it has been a good year and he is thankful for the support his department receives from them and that he is looking forward to another good year next year. RESOLUTION 18-256, ATTACHED AGREEMENT WITH NEFF & ASSOCIATES AS-BUILT Hawke moved and Pizzino seconded a motion that we hereby adopt and authorize the placement of the Board President s signature upon the attached Agreement with Neff & Associates for an As Built Topographic and Utility Survey necessary for the completion of the North Park Library site.
