MINUTES OF SIOUX COUNTY BOARD OF SUPERVISORS MEETING HELD ON JANUARY 2, 2013 13-01-02 1 The Board of Supervisors of Sioux County, Iowa, met pursuant to adjournment at 9:00 o clock a.m. with Lois Huitink, County Auditor presiding as Temporary Chairman until a new Chairman was appointed. Members present were Al Bloemendaal, John Degen, Arlyn Kleinwolterink, Mark Sybesma and Dennis Wright. 13-01-02 2 Oaths of office were administered by Judge James Scott to Sioux County Sheriff, Dan Altena; Sioux County Auditor, Lois Huitink; and Sioux County Supervisors Al Bloemendaal, John Degen, and Mark Sybesma at 9:00 o clock a.m. in the courtroom prior to the regular County Board of Supervisors meeting. The meeting then moved to the Board of Supervisors room. 13-01-02 3 Motion by Kleinwolterink and supported by Wright to appoint Mark Sybesma, County Supervisor as Chairman of the Board of Supervisors for calendar year 2013. Motion carried, Chairman Sybesma presided over the remainder of the meeting. 13-01-02 4 Motion by Wright and supported by Kleinwolterink to appoint John Degen, as Vice-Chairman of the Board of Supervisors for calendar year 2013. Motion carried, unanimous in favor 13-01-02 8 The Sioux County Soil and Water Conservation Commission met with the Board to request funding in for FY 2014. This is the first time this Commission has requested funding. Allan Reinders began the presentation by introducing fellow members of the Commission, who were in attendance: Howard Hulshof and Kendall Roetman. Reinders told the Board that the Sioux County Soil and Water Conservation Commission is comprised of members who are elected by the people of the county. No more than one commissioner may live in any township. Two staff members from Natural Resources Conservation Services, Gregg Marek and Mary Nyhof, were also present for this part of the meeting. Requests are as follows: Proposal to fund cover crop applications ($25,000); Education related projects ($4,750); Seed corners at gravel road intersections ($15,000); Incentive program to leave four rows of corn parallel to road as a snow fence ($15,000). 13-01-02 9 Motion by Kleinwolterink and supported by Degen to appoint Arlin Smit to fill a vacancy, left by the resignation of Jim Plagge, to the Sioux County Planning and Zoning Commission, and to reappoint Roger Bomgaars and Bill Rens to five year terms on the Planning and Zoning Commission. Motion carried, 13-01-02 10 Motion by Bloemendaal and supported by Wright to appoint Shirley Born for a five year term to the County Board of Adjustment. Motion carried, 13-01-02 11 Motion by Wright and supported by Degen to reappoint Daryl Grooters to a five year term as a member of the County Conservation Board. Motion carried, unanimous in favor. 13-01-02 12 Motion by Bloemendaal and supported by Degen to reappoint Lee Kamstra and Barb Top to three year terms as members of the County Board of Health. Motion carried,

13-01-02 13 Motion by Degen and supported by Wright to reappoint Jonathan Grossmann as County Medical Examiner for a two year term. Motion carried, 13-01-02 14 Motion by Kleinwolterink and supported by Degen to reappoint Doug Julius as County Engineer, Weed Commissioner and Sanitarian for calendar year 2013. Motion carried, 13-01-02 15 Motion by Bloemendaal and supported by Wright to reappoint Shane Walter as County Community Services Director, County Zoning Administrator, Veterans Affairs Director and Environmental Health Administrator for calendar year 2013. Motion carried, 13-01-02 16 Motion by Wright and supported by Kleinwolterink to appoint Micah Van Maanen as County Information Technology Director for calendar year 2013. Motion carried, 13-01-02 17 Lois Huitink, County Auditor reported that the following four newspapers have filed written applications to become one of the three official county newspapers for calendar year 2013, and that a contest does exist for the selection of said official newspapers: Sioux County Capital-Democrat Sioux County Index Reporter Sioux Center News Siouxland Press Motion by Bloemendaal and supported by Wright to declare that a contest does exist for the selection of the three official county newspapers; and to instruct Lois Huitink, County Auditor to notify the four official county newspaper applicants that they are to deposit with the County Auditor, in a sealed envelope, a statement, verified by the applicant, showing the names of the applicant s bona fide yearly subscribers living within the county and the place at which each such subscriber receives such newspaper, and the manner of its delivery. The Board will determine the bona fide yearly subscribers of each official county newspaper applicant at 9:15 o clock a.m. on January 8, 2013. Motion carried, 13-01-02 18 Coleman McAllister, Sioux County Attorney Requested that the Board discuss at its next meeting a resolution to set the date for a public hearing to recodify the County s Ordinances. This must be done once every five years. Told the Board that he has been asked to be board member for the Iowa County Attorney s Association. 13-01-02 19 Doug Julius, Sioux County Engineer Sign title sheet for a bridge project BROS CO84 (146) 5F-84 approximately 1 ½ miles north of Iowa Highway 10 on Ibex Avenue, between sections 25 and 26 in West Branch Township. Asked that the Board approve and the Chairman sign a permit agreement for Frontier Communications to install copper telephone cable in sections 15 and 22 of Nassau Township. Motion by Degen and supported by Kleinwolterink to approve the aforementioned permit agreement. Motion carried,

Requested approval and the Chairman s signature on a completion sheet for project L- 1-2013 73-84-CULV on Kennedy Ave (L14) from Boyden north 4 ½ miles to Lyon County (15 locations) Updated the Board on the purchase of a new Motor Grader. Motion by Wright and supported by Bloemendaal to approve the purchase of a new Motor Grader. Motion carried, Report on the Courthouse projects: The door and window on the northwest corner of the building have been installed. Finishing work remains to be done. The Air Conditioning project continues. It is anticipated that work in the Recorders office will be finished this week and that they will be able to move back into the office next week. 13-01-02 20 Shane Walter, Sioux County Community Services Director: Reported that a letter of intent to set up a regional mental health district has been sent to the State. Distributed a letter from the Creative Living Center requesting a 3% increase for FY14. Mental Health budget wise doing fairly well. Walter projects a $49,000 ending fund balance for FY 2012/2013. 13-01-02 21 Motion by Wright and supported by Bloemendaal to sign a Resolution supporting Clean Line Energy s efforts to develop and construct the Rock Island Clean Line. Roll Call on Vote: Wright, Yes; Bloemendaal, Yes; Degen, Yes; Kleinwolterink, Yes; and Sybesma, Yes. Motion carried, RESOLUTION NO 2013-01 Resolution of Support for the Rock Island Clean Line Electric Transmission Project WHEREAS, Sioux County desires to improve the quality of life for its citizens by strengthening the economy and improving the environment; WHEREAS, Clean Line Energy is developing the Rock Island Clean Line (the Project ), a 500- mile overhead high voltage direct current electric transmission line that will transmit costeffective wind-generated electricity from northwest Iowa to Illinois; WHEREAS, Clean Line Energy will pay $7,000 per transmission line mile each year to be apportioned among the applicable taxing districts in each County in which the line will operate; WHEREAS, Clean Line Energy has indicated it will utilize local services and local labor to the extent possible during construction of the transmission line, thus providing new business opportunities for local county businesses and residents; WHEREAS, Clean Line Energy will make payments to property owners for the easements needed to construct and operate the Project; WHEREAS, by opening new transmission capacity on the electric transmission grid and providing a pathway to the market, the Rock Island Clean Line will enable more than $7 billion in new wind farms to be constructed in northwest Iowa that otherwise could not be built due to the lack of available electric transmission infrastructure; WHEREAS, the construction of the Rock Island Clean Line across the state of Iowa will boost demand for materials and services that support the transmission and wind power industries; WHEREAS, County residents will benefit generally from the construction and manufacturing jobs and associated economic benefits that the Project will provide;

WHEREAS, the Rock Island Clean Line will result in substantial financial investment in the State of Iowa and the counties in which the line will operate; WHEREAS; the new wind turbines that will be constructed as a result of the line will result in a meaningful increase in property tax bases to various counties in Northwest Iowa; WHEREAS, by enabling more wind energy to be utilized, the Project will bring substantial environmental benefits to the region, resulting in cleaner air and cleaner water; and WHEREAS, Clean Line will apply to the Iowa Utilities Board for an electric transmission franchise to construct and operate the transmission line in the State of Iowa, NOW, THEREFORE, BE IT RESOLVED that Sioux County supports Clean Line Energy s efforts to develop and construct the Rock Island Clean Line; and be it FURTHER RESOLVED, that the County will work cooperatively with Clean Line Energy during the development and construction of the Project; and be it FURTHER RESOLVED; that a copy of this Resolution will be forwarded to the Iowa Utilities Board Passed this 2nd day of January 2013 ATTEST: /s/ Lois Huitink, Sioux County Auditor /s/ Mark Sybesma Chairman, Board of Supervisors 13-01-02 22 COMMITTEE REPORTS: Wright and Sybesma - Attended a Regional Mental Health meeting. Letters of intent were signed by Cherokee, Plymouth, Sioux and Woodbury Counties. The Regions are scheduled to take effect on July 1, 2014. All Supervisors visited the Trans Ova Genetics facility in Sioux Center. That company is considering expanding at facility by constructing an office building. Bloemendaal Because of snowy conditions, a NW Iowa Planning and Development meeting was held via a conference call on December 20. Three projects for Fiscal Year 2014 were discussed and amended. They included Hwy 182 in Lyon County, the City of Sheldon and a project in O Brien County. Ex-director Ten Kourousis was asked to prepare a response to the Environmental Protection Agency s because of the EPA s insistence on implementing processes to alleviate problems in the Gulf by requiring expensive improvements across the state. Degen - Attended a seminar on private Wind Energy Turbines. Sybesma and Wright will be interviewing candidates for the position of Iowa State Association of County Supervisor s lobbyist. 13-01-02 23 Claims as submitted by the County Auditor were approved. 13-01-02 24 The Chairman adjourned the meeting at 10:50 a.m. until 9:00 a.m. Tuesday, January 8, 2013.
