He has overburdened the Court s lmted manpower and resources and nterfered wth the normal procedures of the effcent and effectve admnstraton of the court s servces at the taxpayers expense. The overwhelmng, volumnous amount of cases fled by Mr. Holloman are reflected n Exhbt "A" attached hereto. The most recent case that Mr. Holloman attempted to le pro se was a case alleged aganst Wmr Dxe for damages suffered due to "mental angush, loss of capacty for the enjoyment of lfe, loss of rght to receve medcaton and publc humlaton and embarrassment and possblty of false mprsonment" from beng accused of stealng a woman s wallet, whch was allegedly vewed from a survellance camera n the store. The Court s prohbtng Mr. Holloman from flng ths case pro se. He has also harassed courthouse personnel. Whle n the Clerk s Offce, Mr. Holloman sometmes becomes bellgerent. He has rased hs voce loud enough for the securty offcer to be summoned to calm hm down and to gve hm a warnng before beng barred from enterng the Offce. Mr. Holloman has generally used the Clerk s Offce one to fve tmes a month, durng whch tme, he often aggravates people, has been a nusance, has been dsruptve to court personnel, has upset the clerks n the Copy Center (lterally even causng one Clerk to cry), and has pushed them around, usng foul language. More specfcally and most recently, whle the Court was consderng hs request to fle a new case, Mr. Holloman vsted the Clerk s Offce several days ago to nqure about the status of the flng. Upon learnng that he mght be requred to pay a flng fee under a payment plan, he became abusve, and used foul language that ncluded "damn place" and "sh." Mr. Holloman caused a commoton, and accused court personnel of beng "aganst hm," sayng he "won t put
OR BK 478 PAGE 3 up wth ths sh " and "how does a person wth a dsablty get any far treatment around here f you have to jump through all of these hoops to fle a case." He clamed to be "good frends" wth Chef Judge Moran, who "won t put up wth ths sh." In addton to hs dsruptng and harassng conduct, Mr. Holloman has fled forty-eght (48) clams n the past fourteen years, stranng the scarce judcal resources avalable to the publc. Most of the defendants n these fortyeght cases are busnesses, ncludng: the Jacksonvlle Transportaton Authorty, Donald McLean, Wackenhut Corporaton, Jacksonvlle Housng Authorty, Fox and Slvennan Investments, Inc., Jacksonvlle Communty College, Flagshp Property, McDonald s Restaurant, Sand Sage, Ebony Con Laundry, Orthopedcs Sports Medcne Clnc, P.A. Bahr, Methodst Hosptal Shands, Deluxe Securty Agency, Inc., Traveler s Grll & Gft Shop, Dr. Stephen Merrtt, Wnn Dxe Supermaket, Inc., Health Ease, Cty of Jacksonvlle, Weser Securty Servces, Inc., Robert Lee Holls, Jr., P.C.S. Sprnt, Dr., John Drewhahy, Rose and Barrett Pant Contractor, Inc., DSI Securty Servces, Inc., Bank of Amerca, N.A., Mouro s Cleaner & Laundromat, Kush & Manav, Inc., Pannenter Realty Partners, Gerald & Sons, Inc., Franchse Realty Interstate Corp., Captan D s, T.D. Lsante Corp. Some of these defendants have been sued several tmes n varous cases. All of these clams are closed, except for three (3). In all three of the clams that reman open, the summons were retumed as "not sert/ed." It s blatantly apparent that he has prevously fled numerous actons, that he has pled rrelevant and frvolous allegatons, and that he has and wll contnue to harass opposng partes. Mr. Holloman s nterference wth ths Court has caused other ltgants to be deprved of an opportunty to resolve ther worthy grevances expedtously, and t s clear that he wll contnue to fle frvolous pleadngs n pendng and future clams f allowed to nvoke the jursdcton of ths Court as a pro se ltgant. It s ths Court s duty to prevent further unreasonable clams recorded or fled for the sake of ltgousness rather than the proper vndcaton of rghts. Mr. Holloman s conduct consttutes an abuse of the pm se rght of access to the court system so as to substantally nterfere wth the effectve admnstraton of justce. Ths Court recognzes the fundamental consttutonal and statutory rghts whch requre that courts be open to all persons and that ndvduals have the rght to represent themselves.

However, these rghts are subject to restrcton where a ltgant, n a seres of cases or clams, has nterfered wth the normal procedures of the Court by recordng or flng rrelevant, mpertnent and vexatous pleadngs, by wastng the Court s lmted resources, and by falng to comply wth Court rules. Martn v. State, 747 So. d 386 (Fla. 000); Rvera.v Sgtg, 740 So. d 84 (lst DCA 999); Attwood v. Eghth Crcut, 667 So. d 36 (Fla. lst DCA 99); Lowery v. Kaplan, 60 So. d 4 (Fla. 4th DCA 99); Peterson v. State, 30 So. d 4 (Fla. lst DCA 988), rev. dened, 3 So. d 34 (Fla. 988). Erc Holloman has ntentonally and unduly dsrupted the proper and effcent admnstraton of justce n ths Crcut through the recordng of frvolous clams and abuse of the Court s procedure. In lght of ths conduct, ths Court deems the nstant Admnstratve Order necessary to remedy exstng abuse and prevent any further abuse. Based on the foregong, t s hereby ORDERED: In the exercse of ths Court s nherent power and responsblty to control court procedure and prevent abuse and nterference wth the admnstraton of justce, ths Court orders Erc Holloman to show cause n wrtng wthn twenty (0) days of the date of ths Order as to why ths Court should not pronounce the followng:. That Erc Wendell Holloman be prohbted from appearng n propa persona (wthout counsel) n all pendng and future cvl clams, lens, actons, pettons or recordngs n any dvson of any Crcut or County Court n ths Fourth Judcal Crcut;. That Erc Wendell Holloman s pendng clams and cases n whch he s a plantff or pettoner be voded or dsmssed, and that he be barred from flng further pleadngs, clams, notces, or any other types of cases wth the Clerk of Court, unless he causes counsel (a member of the Florda Bar n good standng) to fle and serve a notce of appearance of counsel wthn twenty (0) days n any of the pendng clams; furthermore, Erc Wendell Holloman shall have such counsel sgn all of hs pleadngs, clams, notces, etc. and appear on hs behalf n all of hs pendng and future cases recorded or fled n the Fourth Judcal Crcut; 3. That Erc Wendell Holloman be prohbted from flng or recordng pggy n the Fourth Judcal Crcut unless (a) they are legtmate; (b) accompaned by the approprate recordng or flng fee; pld (c) recorded or fled @ sgned by counsel (a member of 3

That any future cases n whch Erc Wendell Holloman attempts to proceed pro se as a plantff or pettoner be dened recordng or flng by the Clerk of Court;. That Erc Wendell Holloman be prohbted from rasng hs voce and from usng any profanty, vulgar, foul, dsrespectful, dshonorable language (ncludng, but not lmted to, explct terms such as "damn" or "sht"), and be requred to conduct hmself n a nonthreatenng, polte and calm manner n the presence of courthouse personnel whle n the Clerk s Offce and nthe Courthouse; otherwse, Mr. Holloman wll be subject to Contempt of Court whch may requre hm to be escorted by Courthouse Securty n order to seek admsson nto the Courthouse at all tmes after gvng pror notce, should a Contempt Order be entered.
