EXPLANATORY NOTES NOTES EXPLICATIVES Section 1 Article 1 This provision adds a new ground on which a member may be found guilty of professional misconduct. Section 2 The new section 56.1 allows the Council, under certain specified conditions, to impose a temporary restriction or suspension of a member's licence without a hearing. - The new section 56.2 allows the Minister, in cet: ' tain specified circumstances, to make a complaint in respect of a member to the Council and to request the Council to impose a temporary restriction or suspension of the member's licence. The section further provides that, where the Council fails to comply with the Minister's request within seven days, the Minister may apply ex parle to The Court of Queen's Bench of New Brunswick for an-order temporarily restricting or suspending the licence of the member. The new section 56.3 provides that where the Court or the Council has temporarily restricted or suspended the licence of a member under section 56.1 or 56.2, the Council shall appoint a Board of Inquiry to immediately proceed with a hearing in respect of the matter, and the Council shall render its final order within thirty days after the date on which the temporary restriction or suspension was imposed. The new subsection 56.4(1) allows the Council, under certain specified conditions, to impose a temporary restriction or suspension of a member's licence without a hearing. The new subsection 56.4(3) provides that where the Council has temporarily restricted or suspended the licence of a member under subsection 56.4(1), the Council shall appoint a Board of Inquiry to immediately proceed with a hearing in respect of the matter, and the Council s"'all issue its final order within thirty days after the date on which the temporary restriction or suspension was imposed. An Act to Amend An Act Respecting the New Brunswick Medical Society and the College of Pbysicians and Surgeons of New Brunswick Loi modifiant la Loi relative a la Societe medicale du Nouveau-Brunswick et au College des medecins et cbirurgiens du Nouveau-Brunswick Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: 1 Section 56 of An Act Respecting the New Brunswick Medical Society and the College of Physicians and Surgeons of New Brunswick, chapter 87 of the Acts of New Brunswick, /98/, is amended (a) by striking out the word "or" where it appears at the end of paragraph (b) thereof; (b) by adding immediately after paragraph (b) thereof the following paragraph: (b, J) he has been involved in the performance or attempted performance of an act intended to procure the miscarriage of a female person outside a hospital approved by the Minister of Health; or Sa Majeste, sur l'avis et du consentement de I' Assemblee legislative du Nouveau-Brunswick, decrete: 1 L'artide 56 de /a Loi relative a /a Societe medicale du Nouveau-Brunswick et au College des medecins et chirurgiens du Nouveau-Brunswick, chapitre 87 des Lois du Nouveau-Brunswick de /98/, est modifie a) par /a suppression du mot «ou» a /a fin de l'alinea b); b) par l'adjonction apres l'alinea b) de l'alinea suivant: b. 56.2(2) Where Council fails to comply with a request by the Minister of Health under subsection (1) within seven days thereafter, the Minister may make an ex parte application to a judge of The Court of Queen's Bench of New Brunswick for an order temporarily restricting or suspending the licence of the member. 56.2(3) A judge of The Court of Queen's Bench of New Brunswick, upon application by the Minister of Health under subsection (2), may by order suspend the licence of a member, or impose restrictions on the licence, on a temporary basis where he concludes on a balance of probabilities that the member is likely to do anything for which he may be found guilty of professional misconduct under paragraph 56(b.I). 56.2(4) An order under subsection (3) shall continue in force until Council issues its final order referred to in section 56.3. 56.2(5) Any person who continues to practise medicine in contravention of an order under subsection (3) is guilty of contempt of court and subject to such penalties as may be imposed by the Court under the Rules of Court. 56.3 Notwithstanding any other provision of this Act, where an order is made under subsection 56.1(1) or under subsection 56.2(3), Council shall appoint a Board of Inquiry under subsection 59(1) to immediately proceed with a hearing to determine whether the member is guilty o f professional misconduct, and the Board shall report its findings and recommendations to Council and Council shall issue its final order in respect of the matter within thirty days after the date on which the order under subsection 56.1(1) or 56.2(3) was made, unless the member consents to the issuance of the final order at a later date. 56.2(2) Lorsque Ie Conseil fait dcfaut de se conformer it une demande faite par Ie ministre de la Sante en vertu du paragraphe (1) dans les sept jours de la demande, Ie Ministre peut, ex parte, demander it un juge de la Cour du Bane de la Reine du Nouveau-Brunswick de rendre une ordonnance suspendant provisoirement Ie permis au imposant provisoirement des restrictions au perm is du membre. 56.2(3) Saisi de la demande faite par Ie ministre de la Sante en vertu du paragraphe (2), un juge de Ia Cour du Bane de la Reine du Nouveau-Brunswick peut, par ordonnance, suspendre provisoirement Ie permis d'un membre au y imposer provisoirement des restrictions Iorsqu'il conclut, selon la pn:ponderance des probabilites, que Ie membre va vraisemblablement faire quelque chose pour lequel il peut etre trouve coupable d'une faute professionnelle visee it I'alinea 56 b.i). 56.2(4) Une ordonnance rendue en vertu du paragraphe (3) est maintenue tant que Ie Conseil n'a pas rendu son ordonnance finale visee it l'article 56.3. 56.2(5) Une personne qui continue d'exercer la medecine en contrevenant a une ordonnance rendue en vertu du paragraphe (3) est coupable d'outrage au tribunal et est soumise aux peines qui peuvent etre imposees par la Cour en vertu des Regles de procedure. 56.3 Nonobstant toute autre disposition de la presente loi, lorsqu'une ordonnance a ete rendue en vertu du paragraphe 56.1(1) ou en vertu du paragraphe 56.2(3), Ie Conseil doit nommer une commission d'enquete pour proceder immediatement a une audition afin de determiner si Ie membre est coupable d'une faute professionnelle et la commission doit faire rapport de ses conclusions et recommandations au Conseil et Ie Conseil do it rendre une ordonnance finale en la matiere dans les trente jours de I' ordonnance de suspension en vertu du paragraphe 56.1(1) ou 56.2(3), ou it une date ulterieure avec Ie consentement du membre. 3
