WASECA COUNTY BOARD OF COMMISSIONERS OCTOBER 3, 2017 The Waseca County Board of Commissioners met in regular session on Tuesday, October 3, 2017, in the boardroom, 300 North State Street, Waseca, Minnesota. Members present were Chair Dan Kuhns, Doug Christopherson, Brian Harguth, Blair Nelson and Richard Androli. Others present at the meeting were Jessica Beyer, County Administrator; Tammy Spooner, Auditor-Treasurer; Melissa Sexton, Human Resources Manager; Brenda Miller, County Attorney; Amy Nelson, 4-H Coordinator; Brad Milbrath, Sheriff; Sarah Berry, Public Health Director; Nathan Richman, County Engineer; Mark Leiferman, Planning & Zoning Administrator; Brian Tomford, Buildings & Grounds Maintenance Director; and Dana Melius, news reporter. Chair Kuhns called the meeting to order at 9:30. Roll call was taken and the Pledge of Allegiance was recited. Androli moved and Christopherson seconded to approve the agenda with the addition of highway bids. Motion carried unanimously. Hometown Haulers Dodge Center, MN 9. Acceptance of 2016 Financial Statement and Final Audit Amy Nelson, 4-H Coordinator, was present at the meeting to acknowledge National 4-H Week. Amy also gave an update on county programs as well as highlights from the past year. Sarah Berry, Public Health Director, shared a request from IMMTRACK Program that Waseca County have representation at their meetings. Sara recommended passing a resolution to appoint the Public Health Director as an alternate representative to the South Central Region Immtrack Joint Powers Board. Christopherson moved and Nelson seconded to adopt the following resolution. Motion carried unanimously. Resolution of Appointment of Alternate Immtrack Joint Powers Governing Board Whereas, the South Central Regional Immtrack Joint Powers Agreement bylaws section 4.1.1 under Governing Board states: The Membership of the Governing Board shall be composed of one representative appointed by each participating county s governing body. The representative need not be a member of the governing body of the participating county but must be an agent thereof. An alternate can be designated by each participating county s governing body, in the event the member appointed to the Governing Board is temporarily unable to attend. An alternate shall possess the same qualifications as the Governing Board Member. Any designation of an alternate shall be in writing, signed by the appropriate county, and delivered to the Secretary of the Governing Board. Therefore, the Waseca County Board of Commissioners hereby appoints the following person as the alternate to Waseca County s appointed Immtrack Governing Board representative. This person shall attend Immtrack Joint Powers Governing Board meetings when the representative is unable to attend. The alternate shall serve until the appointing authority (Waseca County Board of Commissioners) makes a change. Waseca County s Alternate to the Immtrack Governing Board: Sarah Berry, Public Health Director. Nathan Richman, County Engineer, presented a Cooperative Agreement with City of Waseca for Design and Construction of CSAH 2 (Brown Avenue). Androli moved and Harguth seconded to approve the agreement and the total cost to Waseca County of $26,410.12. Motion carried unanimously. Nathan Richman, County Engineer, requested approval of a Detour Agreement Contract #1028057 with MnDOT with the County Engineer as signee. Androli moved and Nelson seconded to approve the agreement as requested. Motion carried unanimously. Nelson moved and Harguth seconded to adopt Resolution 2017-32. Motion carried unanimously. WASECA COUNTY RESOLUTION #2017 32 RESOLUTION TO ADOPT MNDOT AGREEMENT NO. 1028057 343

IT IS RESOLVED that Waseca County enter into MnDOT Agreement No. 1028057 with the State of Minnesota, Department of Transportation for the following purposes: To provide for payment by the State to the County for the road life consumed of the Trunk Highway No. Old 14 detour and the road life consumed and maintenance of the Trunk Highway No. 13 detour on County State Aid Highway No. 2, County State Aid Highway No. 27 and County State Aid Highway No. 5 used as a detour routes during the contract construction to be performed upon, along and adjacent to Trunk Highway No. Old T.H. 14 and T.H. 13 from 0.27 Miles West of Brown Avenue to 0.23 Miles East of Clear Lake Road under State Project No. 8103-115 (T.H. Old 14=7). IT IS FURTHER RESOLVED that the County Engineer and the County Auditor- Treasurer are authorized to execute the Agreement and any amendments to the Agreement. Nathan Richman, County Engineer, presented quotes for gravel hauling by the ton in the Waldorf district. Richman recommended awarding the bid to low quote Max Johnson Trucking in the amount of $5.03 per ton for 6,500 tons for an estimated total of $32,695.00. Harguth moved and Christopherson seconded to award the bid to Max Johnson Trucking. Motion carried unanimously. At 10:12 a.m. Nelson moved and Christopherson seconded to close the session pursuant to MN Statute 13 D05, Subd.3(b) for employment discussions. Motion carried unanimously. Present during closed session were all commissioners; Jessica Beyer, County Administrator; Tammy Spooner, Auditor-Treasurer; Brenda Miller, County Attorney; Brad Milbrath, Sheriff; and Melissa Sexton, Human Resources Manager. Chair Kuhns re-opened the meeting at 10:36 a.m. Androli moved and Nelson seconded to follow the strategies discussed in the closed session. Motion carried unanimously. Commissioner Nelson left the meeting at 10:37 a.m. Mark Leiferman requested adoption of Resolution 2017-31 Resolution Assuming the Authority to Enforce the Parcel Transfer and Division Restrictions of Minnesota Statute 272.162 and to approve a $100 fee for Minor Subdivisions. Androli moved and Christopherson seconded to adopt the resolution and institute the fee. Motion carried 4-0 (Nelson absent). WASECA COUNTY RESOLUTION NO. 2017-31 RESOLUTION ASSUMING THE AUTHORITY TO ENFORCE THE PARCEL TRANSFER AND DIVISION RESTRICTIONS OF MINNESOTA STATUTE. 272.162 WHEREAS, Minnesota Statute 272.162 specifies the conditions when a local government may restrict parcel transfers or land divisions; and WHEREAS, the 90th Minnesota Legislature adopted Chapter 1 in the 2017 First Special Session, amending Minnesota Statute 272.162; and 344

WHEREAS, the amended Minnesota Statute 272.162 authorizes a county to review a deed or other instrument conveying a parcel of land for transfer or division before it is recorded, ensuring conformity with the county s land use regulation; and WHEREAS; a county s review of a proposed land transfer or division will protect land owners from problems arising from property splits not compliant with zoning regulations or inaccurate parcel descriptions; and WHEREAS; a county must choose to assume the authority to review deeds or other instruments conveying parcels of land for transfer or division; now therefore, BE IT RESOLVED, the restrictions of Minnesota Statute 272.162 shall apply to property within Waseca County s boundaries, specifically the County Auditor shall not transfer or divide the land in the official records and shall not certify the deed or other instrument of conveyance as provided in Minn. Stat. 272.162, if: a. The land conveyed is less than a whole parcel of land as charged in the tax lists; b. The part of land conveyed appears within the area of application of municipal or county subdivision regulations adopted and filed under Minn. Stat. 394.35 or 462.36; and c. The part conveyed is part of or constitutes a subdivision as defined in Minnesota Statute 462.352, Subdivision 12; and BE IT FURTHER RESOLVED, the county auditor may transfer or divide the land if its deed or instrument contains a certification by the clerk of the municipality or designated county planning official: a. That the municipality s or county s subdivision regulations do not apply; b. That the subdivision has been approved by the governing body of the municipality or county; or c. That the restrictions on the division of taxes and filing and recording have been waived by resolution of the governing body of the municipality or county in the particular case because compliance would create an unnecessary hardship and failure to comply would not interfere with the purpose of the regulations. Brian Tomford, Buildings & Grounds Maintenance Director, gave an update on playground equipment, Courthouse Park camping, DNR Grant Agreements from prior years, and Blowers Wildlife Park. Brian Tomford, Buildings & Grounds Maintenance Director, expressed concerns for safety in the parking lot on north side of courthouse. He recommends repairing an 8 x 48 section that is in very poor condition and is a trip hazard. Tomford requested guidance as to a temporary fix or a permanent fix. Factors for consideration are the time of year and the Veteran s Memorial project. Harguth moved and Christopherson seconded to do a temporary asphalt repair now and look at a permanent repair in the spring. Motion carried 4-0 (Nelson absent). Jessica Beyer, County Administrator presented the Human Resources Agenda. It was decided to vote on each item separately. Christopherson moved and Androli seconded to approve recruitment for a Dispatcher in the Sheriff s Office. Motion carried 4-0 (Nelson absent). 345

Harguth moved and Christopherson seconded to approve recruitment for a Deputy in the Sheriff s Office. Motion carried 4-0 (Nelson absent). Androli moved and Harguth seconded to approve use of a bank of sick leave from a prior leave to a current situation for an employee. Motion carried 4-0 (Nelson absent). Jessica Beyer, Administrator, updated the board on her activities as well as upcoming meetings and conferences. Having no further county board business, Androli moved and Harguth seconded the motion to adjourn the meeting. Motion carried unanimously and meeting adjourned at 11:24 a.m. Daniel D.
