Starred C. Q. Nos 437, 263, 417, 343, 59 & 454 were orally answered. In response to Starred C.Q. No. 437 asked by Mr. Vijay Bakaya on behalf of Sheikh Gh. Rasool regarding delegation of powers to Panchayats in respect of 14 departments, Mr. Ali Mohammad Sagar, Hon ble Minister for Rural Development department assured the House that if any Hon ble Member has any complaint that would be addressed. Replies to Starred C.Q. Nos 21, 332, 118, 359, 412 & 06 and Un-starred C.Q. Nos 66, 312, 275, 356 & 270 were laid on the table of the House. 12:00 Hrs MESSAGE READ BY THE SECRETARY Secretary read the messages received from the Jammu and Kashmir Legislative Assembly regarding the bills passed by the Legislative Assembly at its sitting held on 28 th day of March, 2013 for recommendation of Legislative Council and laid the Bills on the table of the House. Secretary also read the message received from Jammu and Kashmir Legislative Assembly regarding recommending two members each from Legislative Council to associate with the Committee on Public Accounts,

Committee on Estimates and Committee on Public Undertakings of the House for the period ending 31 st March 2014. 12:04 Hrs PAPERS LAID ON THE TABLE OF THE HOUSE On behalf of Mr. Omar Abdullah, Hon ble Chief Minister Mr. Abdul Rahim Rather, Hon ble Minister Finance laid on the table of the House, copies of Half-yearly Reports of the State Vigilance Organization for the periods indicated below as provided in Section 9-A of the Jammu and Kashmir Prevention of Corruption Act, Samvat 2006:- (a) 01.01.2009 to 30.06.2009; (b) 01.07.2009 to 31.12.2009; (c) 01.01.2010 to 30.06.2010& (d) 01.07.2010 to 31.12.2010. On behalf of Mr. Omar Abdullah, Hon ble Chief Minister Mr. Abdul Rahim Rather, Hon ble Minister Finance laid on the table of the House, a copy of the notification (SRO-65 dated 28 th February, 2013) issued under section 24 of the Jammu and Kashmir Right to Information Act, 2009 (Act No. III of 2009). Mir, Hon ble Minister for Tourism Mr. Sajjad Ahmed Kitchloo, MOS for Tourism laid on the table of the House, as required under section 619-Aof the Companies Act, 1956, copies of Annual Reports of the Accounts of J&K State Cable Car Corporation Limited (J&KSCCC) for the financial years :- (a) 1997-1998, (b) 1998-1999, (c) 1999-2000, (d) 2000-2001. 12:07 Hrs Mr. Sajjad Ahmad Kitchloo, Hon ble Minister In-Charge Industries & Commerce laid on the table of the House, copies of each of the following reports:- (a) Audit Reports for the year 2007-08; (b) Audit Reports for the year 2008-09; (c) Audit Reports for the year 2009-10 & (d) Audit Reports for the year 2010-11.

12:09 Hrs (Mr. Khalid Najeeb Suharwardy Vice Chairman in the Chair) CALLING ATTENTION Mr. Nurboo Gialchan, Hon ble Member called the attention of the Government towards a matter of urgent public importance namely the situation that has arisen by not allotting sufficient number of Ambulances to various Hospitals in Leh District and action taken by the Government in this behalf. Mr. Shabir Ahmed Khan, Hon ble MOS Health replied the points raised by the Hon ble Member and assured the House that ambulances would be provided very soon. 12:14 Hrs Mr.Showkat Hussain Ganie, Mr. Bashir Ahmad Shah (Veeri) and Mr. Ali Mohammad Dar, Hon ble Members called the attention of the Government towards the situation arisen due to non-functioning of ground water pumps/hand pumps throughout Valley. It has been observed that most of these pumps become non-functional immediately after installation, reasons and remedies thereof. Mr. Sham Lal Sharma Hon ble Minister for PHE & F/C replied the points raised by the Hon ble Members and assured the House that technical assistance will be provided wherever required to make ground water pumps/hand pumps functional. 12:30 Hrs DISCUSSION UNDER RULE 51(1) Dr. Shehnaz Ganai, Hon ble Member raised the discussion under Rule 51 (1) of the Rules of Procedure and Conduct of Business in the Jammu and Kashmir Legislative Council on the points arisen out of Starred C.Q No. 223 taken-up on 04-03-2013 regarding ICDS Projects. Mr. Viqar Rasool, Hon ble MOS Social Welfare replied the points raised by the Hon ble Member. The discussion to be raised by Dr. Bashir Ahmad Shah (Veeri), Hon ble Member was not taken up as Mr. Nazir Ahmed Gurezi, Hon ble MOS for Agriculture requested the Chair to defer the said discussion as he had not received any information regarding the discussion. On this Mr. Vice Chairman deferred the discussion till a next date to be notified.

12:57 Hrs DISCUSSION UNDER RULE 183-A Discussion on the working of Ministry of Rural Development took place and following Hon ble Members participated in the discussion. 1. Dr. Bashir Ahmed Veeri 2. Mr. Muzzafar Ahmed Parrey 13:18 Hrs Interrupting the discussion, Hon ble Chairman announced the following decision regarding constitution of a House Committee to look into the alleged bunglings in PHE, Irrigation & F/C departments reserving the right of constituting a House Committee as and when required and on the assurance of Mr. Sham Lal Sharma Hon ble Minister that he will communicate and submit the findings of the two enquiry committees to this House within a period of one month and rejected the demand of constituting a House committee to look into the alleged bunglings in the PHE, Irrigation & Flood Control department at this stage and said that if the Departmental Committees fail to submit their findings within the time as assured by the Hon ble Minister or should the House be not satisfied with those findings, the decision about constituting a House Committee would be reviewed. At this stage, Mr. Devinder Singh Rana, Hon ble Member and other members agitated and demanded that House Committee be constituted to probe the bunglings. 13:42 Hrs The House was adjoured for ten minutes. 14:15 Hrs THE HOUSE REASSEMBLED As House reassembled, Mr. Devinder Singh Rana, Hon ble Member again requested the Hon ble Chairman to reconsider is decision and constitute a House Committee. On this Hon ble Chairman ruled that he had given his decision and if Hon ble Members still have any reservations about that they can move another motion stating clearly what they felt about the whole issue which would be considered.
