THE CITY OF VAUGHAN BY-LAW BY-LAW NUMBER 168-2016 A By-law of the Corporation of the City of Vaughan to amend Parking By-law No. 1-96, as amended, to amend the terms and conditions of visitor parking permits and construction parking permits, and to amend Fees and Charges By-law No. 171-2013, as amended, to include fees for such permits. WHEREAS section 8(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that the powers of a municipality shall be interpreted broadly as to confer broad authority on a municipality to (a) enable it to govern its affairs as it considers appropriate, and (b) enhance its ability to respond to municipal issues; AND WHEREAS section 11(3) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides for lower-tier municipalities to pass by-laws respecting matters pertaining to highways, including parking and traffic on highways, and parking, except on highways; AND WHEREAS section 391(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides for a municipality to impose fees or charges on persons for services or activities it provides and for the use of its property; AND WHEREAS the Council of The Corporation of the City of Vaughan wishes to use technology to provide relevant services in a manner that is flexible, convenient and economical for residents and fiscally sustainable for the City; NOW THEREFORE the Council of The Corporation of the City of Vaughan ENACTS AS FOLLOWS: 1. Amend Parking By-law 1-96, as amended, as follows: (a) Add to Section 2, in alphabetical sequence, the following definition:

Director means the Director of By-law & Compliance, Licensing & Permit Services or his or her designate; (b) Replace in Section 2 the definition for Municipal Law Enforcement Officer with the following: Municipal Law Enforcement Officer means a person appointed by the City as a municipal law enforcement officer under Section 15 of the Police Services Act, R.S.O. 1990, c. P.15; (c) Add sequentially the following section: 9.1 Visitor Parking Permits (1) Every visitor vehicle that parks on any highway in excess of the permitted times requires a visitor parking permit. (2) A visitor parking permit may only be used by a visitor to the address associated with the visitor parking permit and for his or her vehicle that is not registered at the address associated with the permit. (3) Irrespective of the number of vehicles for which permits are sought, visitor parking permits may be issued for no more than ten (10) consecutive days and for no more than sixty (60) calendar days within the calendar year (i.e., January 1 to December 31). (4) Visitor parking permits are only valid for parking on a highway or portions of a highway and for the days and times indicated on the permit. (5) Despite Section 9.1(4), visitor parking permits do not exempt the holder from any other parking prohibitions in this By-law. (6) Every visitor parking permit application shall contain the following information: a. name and address of applicant;

b. the licence number, make and year of the motor vehicle for which a visitor parking permit is being solicited; c. a statement that the permit applicant will be, at the time the permit is in effect, a resident of Vaughan and that the permit is being taken out for a visitor to the applicant s residence. (7) Every visitor parking permit shall be subject to the fees listed in the Fees and Charges By-law No. 171-2013, as amended. (8) Whether the visitor parking permit is used or not, for whatever reason, visitor parking permit fees are non-refundable. (9) The Director may extend, suspend or revoke a visitor parking permit. (10) Notwithstanding that a person may hold a permit authorizing parking on a designated highway at prescribed hours, such person shall be subject to the provisions of Subsection 170(12) of the Highway Traffic Act, R.S.O. 1990, C. H.8. (d) Add sequentially the following section: 9.2 Construction Parking Permits (1) Every vehicle that parks on any highway due to construction requires a construction parking permit. (2) A construction parking permit may only be used by a person who cannot park on his or her driveway due to construction or renovation activity and only for vehicles registered at the address associated with the permit. (3) Irrespective of the number of vehicles for which permits are sought, construction parking permits may be issued for no more than thirty (30) calendar days within the calendar year (i.e., January 1 to December 31).

(4) Construction parking permits are only valid for parking on a highway or portions of a highway and for the days and times indicated on the permit. (5) Despite Section 9.2(4), construction parking permits do not exempt the holder from any other parking prohibitions in this By-law. (6) Every construction parking permit application shall contain the following information: a. name and address of applicant; b. the licence number, make and year of the motor vehicle for which a construction parking permit is being solicited; c. a statement that the owner of the motor vehicle will be, at the time the permit is in effect, a resident of Vaughan and that the permit is being taken out for a vehicle registered at the address of the applicant. (7) Every construction parking permit shall be subject to the fees listed in the Fees and Charges By-law No. 171-2013, as amended. (8) Whether the construction parking permit is used or not, for whatever reason, construction parking permit fees are non-refundable. (9) The Director may extend, suspend or revoke a construction parking permit. (10) Notwithstanding that a person may hold a permit authorizing parking on a designated highway at prescribed hours, such person shall be subject to the provisions of Subsection 170(12) of the Highway Traffic Act, R.S.O. 1990, C. H.8.

2. Schedule I of Fees and Charges By-law No. 171-2013, as amended, is hereby amended by adding the following fees: Fees 2017 2018 2019 Visitor Parking Permit (per vehicle permit) $ 5.00 $ 5.00 $ 5.00 Construction Parking Permit (per vehicle permit) $ 5.00 $ 5.00 $ 5.00 Parking Permit Transaction Fee (all parking permits) $ 2.00 $ 2.00 $ 2.00 3.
