BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF RINGWOOD, ILLINOIS, as follows: WHEREAS, 55 ILCS 5/5-1062 grants counties authority to prescribe by ordinance rules regulations for floodplain and stormwater management; and, WHEREAS, on January 20, 2004, the County Board of McHenry County, Illinois adopted Ordinance Number 0-200401-10-009, commonly known as the McHenry County Stonnwater Management Ordinance, effective June 1, 2004 and January 1, 2005, establishing rules and regulations for floodplain and stormwater management throughout the County of McHenry and superseding any less restrictive municipal rules and regulations therein; and,

WHEREAS the President and Board of Trustees of the Village of Ringwood have previously, adopted Ordinance No. 2005-2-1, which adopted by reference the McHenry County Stormwater Management Ordinances~ and, WHEREAS, on April 15, 2008, the County Board of McHenry County, Illinois, adopted Ordinance Number 0-200804-10-018, an ordinance amending the McHenry County Stormwater Management Ordinance, effective immediately; and, WHEREAS, the President and Board of Trustees of the Village of Ringwood find it to be in the best interests of the Village of Ringwood to require all development to meet, at least, the minimum standards prescribed by the McHenry County Stormwater Management Ordinance to the fullest extent practicable. NOW, THEREFORE, BE IT ORDAINED by the President and Board oftrustees of the Village of Ringwood, McHenry Counties, Tilinois, as follows: SECTION 1: That there is hereby adopted by reference, as if fully set out herein, that certain ordinance known as the McHenry County Stormwater Management Ordinance, approved as amended by the County ofmchenry, State oflllinois. SECTION II: That in the event that the rules, regulations, terms or conditions imposed pursuant to the McHenry County Stormwater Management Ordinance are either more restrictive or less restrictive than comparable rules, regulations, terms or conditions imposed by any other applicable rule, regulation, resolution, ordinance, statute or law, then the most restrictive rules, regulations, terms or conditions shall govern. SECTION ID: That all ordinances and resolutions, or parts thereof: in conflict with the provisions of this Ordinance are, to the extent of such conflict, expressly repealed. SECTION IV: That this ordinance shall be published in pamphlet form by and under the authority of the Corporate Authorities of the Village. SECTION V: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form, as provided by law.

INTERAGENCY AGREEMENT BETWEEN McHENRY COUNTY STORMW ATER COMMITTEE and THE VILLAGE OF RINGWOOD REGARDING PROVISIONAL CERTIFICATION FOR THE STORMW ATER MANAGEMENT ORDINANCE THIS INTERAGENCY AGREEMENT is entered into this.30+1.- day of :{A~~::::..J-' /o~h~e..a.y" 2008, by and between McHENRY COUNTY STORMW ATER COMMITTEE ("MCSC") and the VILLAGE OF RINGWOOD, an Illinois municipal corporation (the "Village"). WITNESSETH: WHEREAS, the Village passed Resolution No. 2005-5-1 - a Resolution of Intent to Participate in the National Flood Insurance Program at its January 18, 2005 Board of Trustee's meeting; and WHEREAS, at the October 30, 2008 Board of Trustee's meeting the Village approved the McHenry County Stonnwater Management Ordinance as amended on April 15, 2008. WHEREAS, the County of McHenry passed the McHenry County Stonnwater Management Ordinance on January 20, 2004 and amended April 15, 2008, which provides that a community may petition the McHenry County Stormwater Committee (MCSC) for provisional certification via an interagency agreement which will define the level of Ordinance implementation by the community, the process of interaction between the community and the MCSC and a timetable for full Ordinance implementation. - 1- C:\Documcnts and Settings\Sue\Local Settings\ Temporary lnternet Files\Contcnt.IE5\0L6K5MQN\Dral\ _IGA( I ).doc
NOW, THEREFORE, the parties agree as follows: 1. The Village shall proceed with the application to the Federal Emergency Management Agency for inclusion in the National Flood Insurance Program, and will provide a copy of the application to MCSC. 2. MCSC will allow the Village to operate with a provisional certification where the Village continues to review development and issue stormwater management permits, but only for areas outside of the floodplain as outlined on Federal Emergency Management Agency FIRM maps. If any development is proposed for a parcel that includes a tloodplai~ MCSC will be responsible for issuing the stormwater management permit for that development, until such time as Federal Emergency Management Agency bas approved the Village of Ringwood's application for the National Flood Insurance Program. 3. Once the Village is granted participation in the National Flood Insurance Program, the Village will make formal application to MCSC for full recertification. 4. The Village will copy MCSC with reviews and permits issued on all developments during the provisional certification. 5. The Village will copy MCSC with correspondence with Illinois Department ofnatural Resources and the Federal Emergency Management Agency. 6. provisional certification to run a year or until such time that the National Flood Insurance Program application is ruled upon. If the Federal Emergency Management Agency is unable to provide a review in that time period, MCSC would allow the Village to apply for an extension of the provisional certification to grant the Federal Emergency Management Agency additional review time. 7. Either party may change its address for notice purposes by giving notice, thereof in the manner set forth in this Section. 8. If any provision of this Agreement is held to be illegal, invalid or unenforceable under present or future laws, such provision shall be fully severable; this Agreement shall be construed as if such illegal, invalid or unenforceable provision had never comprised a part of this Agreement; and the remaining provisions of this Agreement shall remain in full force and effect and shall not be affected by such illegal, invalid, or unenforceable provision or by its severance from this Agreement. 9. This Agreement may be executed simultaneously in counterparts, such of which shall be deemed an original, but all of which together shall constitute one and the same instrument. 10. This Agreement embodies the entire agreement and understanding between the parties relating to the transaction contemplated hereby and may not be amended, waived or discharged except by an instrument in writing executed by the party against whom enforcement of such amendment, waiver or discharge is sought. 11. This Agreement shall be governed by, construed in accordance with and enforced in accordance with the laws of the State of Illinois, and venue shall be in McHenry County, Illinois. 12.
