AUTO-OWNERS MUTUAL INSURANCE COMPANY Circuit for Davidson County No. 07C112 No. M2012-00157-SC-R11-CV - Filed 4-11-2013 ORDER Upon consideration of the application for permission to appeal and the entire record in this cause, the is of the opinion that the application should be, and is hereby, granted for the purpose of remanding the case to the of Appeals for reconsideration of this appeal on its merits. We are not convinced that the orders of July 31, 2008 and December 19, 2011, certified as final pursuant to Tennessee Rule of Civil Procedure 54.02, failed to dispose of one or more but fewer than all of the claims before the trial court, as the of Appeals held. Addressing that issue in this appeal is unnecessary, however, as the parties agree that all issues have now been finally resolved in the trial court. Thus, remanding to the of Appeals for reconsideration of the merits will secure the just, speedy, and inexpensive determination of this appeal, consistent with Tennessee Rule of Appellate Procedure 1. Additionally, even assuming for argument s sake that the Rule 54.02 certification was deficient, the parties agreement that all issues have been finally resolved amounts to good cause for suspension of the finality requirement of Tennessee Rule of Appellate Procedure 3(a). See Tenn. R. App. P. 2; Bayberry Assocs. v. Jones, 783 S.W.2d 553, 559 (Tenn. 1990) ( Tennessee Rule of Appellate Procedure 2 authorizes the suspension of all but Tenn. [R. App. P.] 4, 11 or 12.
