The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, February 18 th, 2015. Present were President Elliott, Commissioner Garcia and Commissioner VanGilder. The proceedings of Wednesday, February 18 th, 2015, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on February 19 th, 20 th, 23 rd and 24 th, 2014 were approved as submitted and signed. Chaplin Ken Charles of the Fairmont Regional Medical Center led the Court with a prayer. County Prosecuting Attorney Pat Wilson led the Court with the Pledge of Allegiance. President Elliott called the meeting to order. Commissioner VanGilder moved to dispense with the reading of the minutes of Wednesday, February 18 th, 2015 and accept them as presented. Commissioner Garcia seconded. President Elliott concurred. For the record, note James Priester, Assessor presented to the County Commission the following Exonerations for approval. Dated February 25, 2015 Nos. #2015-283 through #2015-290 Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner VanGilder moved that the President sign Nos. #2015-283 through #2015-290. Commissioner Garcia seconded. President Elliott concurred. The Commission received an Order Confirming and Ratifying Fiduciary Supervisor s Report of Claims and Settlement Reports, Order #359. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held for this County at their offices in the J. Harper Meredith Building on the 25 th, day of February, 2015. This day came David A. Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission his Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the Clerk of the County Commission, pending confirmation. There being no objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved. 1

The Commission presented the Resolution on Paint the Town Blue event. Commissioner VanGilder moved that the Commission sign the Resolution. Commissioner Garcia seconded. President Elliott concurred. The Commission received a request for advice and consent from Patrick Wilson, Prosecuting Attorney, to hire James McClain as full time Assistant Prosecuting Attorney with benefits, to be effective March 2, 2015. Pat Wilson stated that this will be a replacement employee because Dan Shay will become the new Magistrate Judge once Kathy Reed retires. 3
Commissioner VanGilder moved that the Commission grant its advice and consent to hire James McClain as full time Assistant Prosecuting Attorney with benefits, to be effective March 2, 2015. Commissioner Garcia seconded. President Elliott concurred. The Commission received a request for reimbursement from West Virginia Division of Justice and Community Services to cover expenditures from February 1, 2015 to February 28, 2015. (14-VAS-016) 4
Commissioner VanGilder moved that the Commission sign the request. Commissioner Garcia seconded. President Elliott concurred. The Commission presented the appointment of Jim Hershman to the Board of Marion County Development Authority. Commissioner VanGilder moved that the Commission sign appoint Jim Hershman to the Board of Marion County Development Authority. Commissioner Garcia seconded. President Elliott concurred. The Commission received a request for funds from Bass Nation of West Virginia (BNWV). Tim Mitchem President of the Bass Nation of West Virginia made the request in person and added that there is a very good chance that the Locks at Opekisa will be opened for some weekends out of the summer; an agreement should be coming forward soon for this to take place. The fishing tournament taking place over the Memorial Day Weekend will generate a lot of interest in bringing to Town a lot of fisherman and their families for the weekend; bringing in revenue to the County. He continued that in June there will be a Mid Atlantic Fishing Tournament that will bring in people from 6 states and 2 foreign countries and will be streamed over the internet. Commissioner VanGilder moved that the Commission allocate $7,000.00 to Bass nation of West Virginia and that those funds be appropriated from the Hotel/Motel Fund. Commissioner Garcia seconded. President Elliott concurred. Charlie Reese presented his update on the Palatine Park meeting from last week with thrasher Engineering. He presented the application for to improve the 5
existing boat ramp and floating dock along with regarding of the access road and ramp. He added that this meeting will be Wednesday, March 4 th, 2015 with the Planning Department of the City of Fairmont. Charlie added that Alisha Elliott has worked very hard on obtaining rooms for the fishing tournament for CVB and she has done a great job in that area. Rick Garcia s nephew, Michael Garcia was once again named the Mountaineer for West Virginia University Circuit Clerk Rhonda Starn introduced Alina Voronenko as the new Channel 5 reporter for Marion County, who is from Sacramento California. The County Commission will now recess until, 10:30 a.m. for a Public Hearing on the Abandonment of streets in Bellview Addition. Public Hearing for first reading of Petition to Abandon Orchard Street, Lot 32 N Bellview Ave, Ls 30-31N Bellview, Ls 61-62-63 N Bellview Addition. President Elliott called the Public Hearing to order. Diane Floyd of Floyd Real Estate was present to the request on behalf of her client that she is assisting in this matter; who is as follows: Pamela Viands Houck, David Viands and Caren Shore. She stated for the record that they have advertise in the Times West Virginian and presented a copy of the ad as Exhibit 2 and Presented the green cards returned from the certified letters being sent out to the local residents for consideration in this matter as Exhibit 1. There was no one present to object to this abandonment taking place. County Administrator Kris Cinalli stated that he and the County Attorney Chuck Shields have reviewed this information and found it to be complete. Chuck Shields recommends that the Commission approve the abandonment. Chuck Shields added that he would assist Diane Floyd with what needs to be included in the Order of Abandonment to present to the Commission in the near future for its approval. Commissioner VanGilder moved that the Commission accept the recommendation from Chuck Shields to abandon the streets. Commissioner Garcia seconded. President Elliott concurred. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, March 4 th, 2015 at 10:00 a.m. for the next scheduled County Commission Meeting.
