C3-09-106 Planning Department on behalf of the City of Omaha Approval of an Amendment to Chapter 55 Zoning regarding Section 55-845 Areas of special graphic control Omaha and 3-mile extraterritorial jurisdiction DISPOSITION: APPROVED 6-0. Preliminary Plat approval of PACIFIC SPRINGS PLACE, a subdivision outside the city limits, with rezoning from AG and MU to MU and approval of a Major Amendment to the Mixed Use District Development Agreement for Pacific Springs Northeast of 180 th and Pacific Streets DISPOSITION: APPROVED 6-0. Approved the rezoning from AG and MU to MU, subject to submittal of an acceptable final mixed use district development agreement being submitted prior to forwarding the request to the City Council; and APPROVED the preliminary plat subject to: 1) Transferring notes to the final plat stating that there will be no direct access to 178 th, 180 th, Marcy or Pacific Streets from any of the lots or outlot(s) within the subdivision; 2) Obtaining a permit from Douglas County for the proposed driveway connection to 180 th Street, located between Lot 2 and 3; 3) Confirming with the Public Works Department whether or not a warrants analysis needs to be provided for left turn phasing at the traffic signal at 180 th and Pacific Streets; 4) Submittal of a Post Construction Storm Water Management Plans as required by Section 53-6(c)(8) of the Omaha Municipal Code that complies with Section 32 OMC; 5) Providing storm water runoff calculations that demonstrate that there will be no net increase in runoff associated with the 2, 10 and 100 year storms; 6) Submittal of storm sewer design computations and final plans to Douglas County for review that relate to the handling of roadway and site drainage along the plat boundary adjacent to 180 th Street; 7) Submitting plans to the Papio-Missouri River Natural Resources District showing the overflow paths for storm water from the water quality ponds during larger storm events; 8) Sediment and erosion control measures being installed and operational prior to grading; 9) Coordinating the proposed site grades along the western and southern boundaries of the plat adjacent to 180 th and Pacific Streets with the future improvement of 180 th and Pacific Streets; 10) Submittal of cross section information to Douglas County for review that shows the relationship of the proposed site grading to the existing and future 180 th Street (future 6-lane) and Pacific Street (future 4-lane) improvements; 11) Approval of the plan and trail costs by the Park and Recreation Advisory Board prior to Planning Board approval of a final plat; and 12) Providing for the use, ownership and maintenance of the outlots in the subdivision agreement. Rezonings 3. C10-09-081 (D) Rezoning from R8 to MU AP Investments LLC Northwest of 186 th Avenue and West Dodge Road DISPOSITION: LAID OVER 6-0. Laid over rezoning from R8, Multiple Family Residential High Density to MU, Mixed Use to allow the applicant time to meet with the neighbors and time to submit work on an acceptable Mixed Use Development Agreement that address the following prior to the request being forwarded to City Council: 1) Work with the Planning Department on provisions to be included within the Development Agreement to guide future reviews of amendments; 2) The updated format of the Mixed Use Agreement should be used; 3) Include a statement that says the amount of residential floor area will not be less than 50 percent of the total floor area; 4) Include a statement that indicates the bufferyard along California will be 20 feet in width; 5) Include a statement that addresses the maximum height of the buildings if they will not meet the CC, Community Commercial Regulations; 6) Remove the statement that refers to a Center Identification sign; 7) Update Exhibit E and E-1 to comply with the monument sign regulations; 8) Provide a pedestrian connection to the future park on the west side; 9) The sidewalk and greenspace along California must comply with Section 55-924; 10) Indicate the

Page 3 location of service areas on the plan; 11) Provide eight (8) handicap stalls; and 12) Comply with all applicable regulations of the Urban Design Article. (REGULAR AGENDA) Master Plan Referrals 4. C3-09-127 Willie L. Mora Approval of LILLIE Js BLUES BISTRO, LLC TIF REDEVELOPMENT PROJECT CORBY STREET THEATER BUILDING REDEVELOPMENT PLAN 2801 North 16 th Street DISPOSITION: APPROVED 5-0. Approved the project concept and land use in compliance with current city ordinances and development regulations subject to securing waivers as may be required for the successful development and implementation of proposed project. The project will be brought into compliance with the Master Plan, appropriate ordinances and development regulations of the City. 5. C3-09-128 Planning Department on behalf of The City of Omaha Approval of an Amendment to the Storm Water Element of the Master Plan to enhance the water quality and flood control policies and the Watershed Master Plan and adopt an initial Implementation Plan Omaha and 3-mile extraterritorial jurisdiction, within the Papillion Creek Watershed DISPOSITION: APPROVED 6-0. Approved the proposed amendments to the Stormwater Element of the Omaha Master Plan. 6. C3-09-129 Planning Department on behalf of The City of Omaha Approval of Amendments to Chapter 32 and 53 of the Omaha Municipal Code to add a new minimum requirement for Post- Construction Storm Water Management Plans and to establish a mechanism for collection of Watershed Management Fees Omaha and 3-mile extraterritorial jurisdiction, within the Papillion Creek Watershed DISPOSITION: APPROVED 5-1. Approved the proposed amendments to Chapter 32 and 53 of the OMC. Subdivisions 7. C10-09-108 (D) C12-09-109 CR Investments, Inc. Preliminary Plat approval of WOOD VALLEY REPLAT ONE, a subdivision outside the city limits, with rezoning from R6 to DR and R4 Northeast of 142 nd and Ida Streets DISPOSITION: LAID OVER 6-0. Laid over preliminary plat to allow the applicant additional time to submit: 1) A preliminary plat that includes the redesign of Whitmore Circle so that the cul-de-sac is at the end of the street; 2) A plan for the proposed pervious paving that includes a maintenance

Page 4 plan (including costs), how ice/snow will be handled (sand/gravel cannot be used) and includes the additional costs for construction; 3) Storm sewer design computations and final plan to the Douglas County for review that relate to the handling of roadway and site drainage along the development boundaries adjacent to Military Road and Ida Street; 4) Detailed plans for storm sewer pipe outlets; 5) Cross sections, for review, that shows the relationship of the proposed site grading to the existing and future Ida Street improvements; 6) A sediment and erosion control plan; and 7) A complete Post-Construction Storm Water Management Plan. 8. C10-09-110(a) (D) C12-09-110 Tom Egan Preliminary and Final Plat approval of 'Q' STREET ACRES REPLAT 1, a minor plat inside the city limits, with rezoning from DR and GI to GI (portions of which property lie within the flood fringe and floodway) Southeast of 69 th and Q Streets DISPOSITION: APPROVED 5-0. Approved the rezoning from DR and GI to GI (portions of which property lie within the flood fringe and floodway); APPROVED the preliminary plat, subject to: 1) Providing specific language on the final plat for the street vacation; and 2) Retaining access and utility easements for the vacated street; and APPROVED the final plat subject to compliance with the conditions of approval for the preliminary plat. 9. C10-09-111 (D) C12-09-112 Mitchell Auto Auction, LLC Preliminary and Final Plat approval of INTRANSIT ADDITION, a minor plat inside the city limits, with a waiver of Section 53-8(4)(d) of the subdivision ordinance regarding lot frontage, and rezoning from CC and GI to CC and GI 5500 L Street DISPOSITION: APPROVED 6-0. Approved the rezoning from CC and GI to CC and GI (Lot 1/GI and Lot 2/CC); APPROVED the waiver of Section 53-8(4)(d) for street frontage; APPROVED the preliminary plat; and APPROVED the final plat. 10. C10-09-113 (D) C12-09-114 Serenada Properties LLC Preliminary and Final Plat approval of SERENADA PLACE, a minor plat inside the city limits, with rezoning from R2 and GC to R2 and GC 8114 Maple Street DISPOSITION: APPROVED 6-0. Approved the rezoning from R2 and GC to R2 (Outlot A ) and GC (Lot 1); APPROVED the preliminary plat, subject to submittal of an acceptable final subdivision agreement that provides for the use, ownership and maintenance of the outlot; and APPROVED the final plat, subject to submittal of an acceptable final subdivision agreement.

C7-09-123 (D) Tuesday s Pet Planet Approval of a Conditional Use Permit to allow a Kennel in a GC District 8114 Maple Street DISPOSITION: Approved the Conditional Use Permit to allow a Kennel in a GC District subject to: 1) Compliance with the proposed site plan; including paving any existing gravel parking areas; 2) Compliance with a landscape plan that provides four (4) trees along Maple Street and 4 foot tall screening adjacent to the parking lot in compliance with Sections 55-718 and 55-740 of the zoning ordinance; 3) Compliance with all other applicable regulations; and 4) Outdoor activities be limited to only normal operating hours. Vacations 20. C14-09-124 (D) Planning Board Vacation of the east 125 of Spring Street from 28 th Avenue to the north/south alley and the north/south alley east of this location from Deer Park Boulevard north to and including the east/west alley north of the vacated Oak Street DISPOSITION: APPROVED 6-0. C14-09-125 (D) Property Owner Vacation of 203 rd Avenue (aka Railroad Avenue) from Blondo Parkway to the southwest DISPOSITION: APPROVED 6-0. Approved the vacation of 203 rd Avenue (FKA Railroad Avenue) from Blondo Parkway subject to: 1) The dedication of the land adjacent to 204 th Street be submitted; 2) The applicant making an application for the Final Plat of this development; and 3) All easements will be reserved in the vacating ordinance.
