FIFTH NORTHERN MARIANAS COMMONWEALTH LEGISLATURE HOUSE BILL NO. 5-93, H.D.l, S.D.2 SIXTH SPECIAL SESSION, 1986 AN ACT To appropriate the sum of $8,102,000 in Fiscal Year 1986 for Capital Improvement/Development Project funds and $3,187,000 in other Federal construction funds, and for other purposes. BE IT ENACTED BY THE FIFTH NORTHERN MARIANAS COMMONWEALTH LEGISLATURE: Section 1. Short Title. This act may be cited as the Fiscal Year 1986 Capital Improvement Project Appropriation Act. Section 2. Resources. Notwithstanding any requirement of the Planning and Budgeting Act of 1983, 1 CMC Div. 7 (as amended) to the contrary, the Legislature adopts the fol 1 owing resource identification for Capital Improvement Project funds in Fiscal Year 1986 for the fol 1 owing purposes and amounts : CIP FUNDING FISCAL YEAR 1986 CIP ALLOTMENT UNDER COVENANT SECTION 702(b)... $ 8,102,000 DIRECT U.S. CONGRESSIONAL APPROPRIATION FOR EMERGENCY WATER PROJECT... $ 2,711,000 DIRECT U.S. CONGRESSIONAL APPROPRIATION FOR THE COMMONWEALTH HEALTH CENTER CONSTRUCTION PROJECT... $ 476,000 TOTAL AVAILABLE FOR CIP IN FISCAL YEAR 1986.. $11,289,000 Section 3. Appropriation. There is appropriated the sum of $8,102,000 and the sum of $3,187,000 for other construction in Fiscal Year 1986 Capital Improvement/Develo.pment projects from Covenant Section 702(b) for the following purposes and amounts:

Construction of Elementary School Cafetorium... 66,000 To augment Fiscal Year 1985 funding for the construction of San ~icente El ementary School Cafetorium. 4. Recreational Faci 1 i ty/ground Improvement... 33,000 To construct storm drainage at San Roque El ementary School, construction of retaining wall at San Vicente Elementary School and paving of parking lot at W.S. Distribution and Extension of Power... To continue the outreach programs to outlying areas and to upgrade main distribution lines. Extension and Upgrading of Water Systems... To continue the establ i shment of a dependabl e water supply and distribution system. Expansion of Sewer System... To meet matching funds requirements for U.S. EPA funding of sewer system improvements. A/E and Construction of Primary Road... To augment U.S. FWHA funding for design and construction of major roads. The local appropriation of federal funds in Section 3 is contingent upon their appropriation by the federal government. Page 6

Unless the Governor certifies to the presiding officers of the legislature that there is an emergency, awards for the projects for which funds are appropriated by this act shall only be made after public notice and bidding. The Commonwealth shall give a preference in awarding the contracts funded by the funds appropriated in this act to Commonwealth contractors, unless a contractor who is not a Commonwealth contractor is equally qualified and submits a bid which is 20% lower than the lowest bid submitted by a responsi bl e Commonweal th contractor. A Commonweal th contractor means any business which is not less than 75% owned by citizens of the United States, Interim U.S. citizens as defined in Section 8 of the Schedule on Transitional Matters in the Commonwealth Constitution, or lawful ly admitted permanent residents. Section 6. (a) Expenditure Authority. Pursuant to 1 CE4C Section 7401(a) and unless otherwise specified in this section, the Governor or his designee may expend the funds appropriated in this act. (b) The Mayors of Rota and Tinian shall expend the funds appropriated by Section 3 (b) (1-2) and (c) (1,2, 4-9) of this Act. The Marianas Pub1 ic Land Corporation shall expend the funds appropriated by Section 3 (c) (3) of this Act; provided, however, that in the event that EDA approves CNMI Funding Appl ication for Sinapal o Water Project under Section B(2) of this Act, said funds shall be made available for reprogramming by the Mayor and the Page 7
