FINAL DISCIPLINARY ACTION William Grimes Settlement Stipulation - Case Nos. 2018-001332 & 2018-026665 PCP: Demers, Gathright, and White Mr. Grimes was present at the meeting and was sworn in by the court reporter. Mr. Michael H. Bowling, Esquire, was present at the meeting on behalf of Mr. Grimes. Vice Chair Gathright and Mr. White were recused from the matter since they served on the Probable Cause Panel. Mr. Tom Thomas, Deputy General Counsel, DBPR, presented the facts in these cases stating that case number 2018-001332 was dismissed. With regards to case number 2018-26665, Mr. Grimes agreed to a Settlement Stipulation imposing an administrative fine of $500, costs in the amount of $250; stayed suspension; one-year probation with one appearance before the Board, on October 17, 2019, meeting, complete a live, continuing education course of at least four hours in the laws and rules category (in addition to the continuing education required for renewal) within one year of the final order. Mr. Clark Jennings, Assistant Attorney General, informed the Board that there were typographical errors in the Settlement Agreement. The Settlement Agreement should replace the Construction Industry Licensing Board with the Building Code Administrators and Inspectors Board. It was agreed that Mr. Grimes would appear before the Building Code Administrators and Inspectors Board. After discussion, Mr. Bolduc made a motion to approve the Settlement Stipulation, as amended. Mr. Barthlow seconded the motion. The motion passed unanimously. Juan F. Hernandez, Jr. Settlement Stipulation - Case No. 2018-026659 PCP: Waived Mr. Hernandez was present at the meeting and was sworn in by the court reporter. Mr. Tony Bajoczky, Jr., Esquire was present at the meeting on behalf of Mr. Hernandez. Mr. Tom Thomas, Deputy General Counsel, DBPR, presented the facts in the case and stated that Mr. Hernandez had agreed to a Settlement Stipulation imposing an administrative fine of $500, costs in the amount of $250; stayed suspension; one-year probation with one appearance before the Board on October 17, 2019, complete a live, continuing education course of at least four hours in the laws and rules category (in addition to the continuing education required for renewal) within one year of the final order. REQUEST FOR EXTENSION OF PROVISIONAL LICENSE Marc Gerard Banville Provisional 1&2 Family Dwelling Inspector Mr. Banville was present at the meeting and was sworn in by the court reporter. Mr. Greg Ferrone, Building Official, Alachua County, was present at the meeting on behalf of Mr. Banville and was sworn in by the court reporter. Mr. Barthlow recused himself from this matter. After discussion, Vice Chair Gathright made a motion to approve the extension of the Provisional 1&2 Family Dwelling Inspector license through June 10, 2019. Mr. Jones seconded the motion. The motion passed with Mr. Lopresto voting against the motion. Peter Winters Provisional Building Plans Examiner Mr. Winters was present at the meeting and was sworn in by the court reporter. Mr. Douglas Newbanks, Building Official, Marion County, was present at the meeting on behalf of Mr. Winters and was sworn in by the court reporter. approve the extension of the Provisional Building Plans Examiner license through June 11, 2019. Vice Chair Gathright seconded the motion. The motion passed unanimously. RULES & LEGISLATION COMMITTEE Legislative Report There was no Legislative Report to discuss at this time. Rules Report Rule 61G19-9.001(4), F.A.C. Richard Gathright The Board discussed revising Rule 61G19-9.001(4), F.A.C. Mr. Bolduc made a motion to establish a Continuing Education Committee. Mr. Leuzinger seconded the motion. The motion passed unanimously. Chair McCormick, Vice Chair Gathright, Mr. Bolduc and Mr. Leuzinger volunteered to serve on the Continuing Education Committee. It is the intent of the Committee to meet at the February 2019 meeting or soon thereafter and conduct a workshop at a future meeting. OLD BUSINESS There was no old business to come before the Committee at this time. NEW BUSINESS There was no new business to come before the Committee at this time. Building Inspector (F-3313, A-4078) After discussion, Vice Chair Gathright made a motion to deny A1 for failure to comply with Rule 61G19-7.005, F.A.C., and Rule 61G19-7.006, F.A.C., in that the program outline lacks sufficient detail to demonstrate the programs composition and compliance. The motion was seconded by Chair McCormick. The motion passed unanimously. CITY OF MELBOURNE Mr. Steve Innes and Mr. Ed Gast were present at the meeting and were sworn in by the court reporter. B1. Building Inspector (F-3303, A-4068) B2. Building Plans Examiner (F-3319, A-4087) After discussion, Vice Chair Gathright made a motion to approve B1-B2 with the agreement to change Chapter 486 with Chapter 468. The motion was seconded by Mr. Lopresto. The motion passed unanimously. Ms. Ann Russo, Building Officials Association of Florida volunteered to reach out to the City of Deltona and the City of Altamonte Springs in an effort to correct the timeline presented with these internship programs. The amendment would remove all the ewise (Live Online) information and add a self-paced online program. After discussion, Vice Chair Gathright made a motion to eliminate the Ewise (Live Online) information and replace it with the selfpaced online program. The motion was seconded by Mr. Barthlow. REPORTS CHAIR S REPORT BOB MCCORMICK Chair McCormick informed the Board that Mr. Rick Holmes had contacted him stating that they were in need of roofing inspectors to help in the recovery effort from Hurricane Michael. APPLICATION REVIEW COMMITTEE RICHARD GATHRIGHT Vice Chair Gathright reported that the Committee reviewed 175 applications, of which 148 were approved, six were withdrawn, and 21 were denied. He read the denials into the record at this time. Mr. Lopresto made a motion to approve the actions of the Committee as reported. Mr. Bolduc seconded the motion. The motion passed unanimously. RATIFICATION LIST RICHARD GATHRIGHT Mr. Bolduc made a motion to approve the Ratification List as submitted. Vice Chair Gathright seconded the motion. The motion passed unanimously. RULES AND LEGISLATION COMMITTEE Mr. Jennings Informed the Board that there were no pending rules at this time. EXAMINATION AND CONTINUING EDUCATION COMMITTEE TIM BOLDUC Mr. Bolduc reported that the Committee reviewed 11 internship certification programs and three were approved and eight were denied. The Board discussed the denied internship programs. After discussion, Chair McCormick made a motion to reconsider the applications from City of Deltona and City of Altamonte Springs. Mr. Raines seconded the motion. The motion passed unanimously. Chair McCormick authorized Ms. Barineau to communicate with the City of Deltona and the City of Altamonte Springs to obtain an amended timeline. Chair McCormick made a motion to overturn the denials of C1-C6 and D1 with a conditional approval that the City of Deltona and the City of Altamonte Springs provide an amended timeline related to rounding up every ¼ hour to the nearest ¼ hour within 20-days. Mr. Leuzinger seconded the motion. The motion passed with Mr. Bolduc voting against the motion. BOARD COUNSEL CLARK JENNINGS Mr. Jennings reminded the Board that this is his last meeting as Board Counsel due to his retirement. He stated that he is humbled and grateful to have had the privilege to serve as Board Counsel. He thanked all the members for their support. Mr. Jennings announced that Mr. Milne will serve as Board Counsel. Mr. Milne stated that he was eager to serve. EXECUTIVE DIRECTOR ROBYN BARINEAU Licenses Issued from Null & Void Ms. Barineau reported that there were no licenses issued from null and void status since the last Board meeting. FINANCIAL REPORT SEPTEMBER 30, 2018 Ms. Barineau reported that the balance in the Board s operating account was $14,410,882. The unlicensed activity account balance was $435,392.
