I/We hereby tender for the above subject work as per TENDER DOCUMENT as separately signed and accepted by me/us at the schedule of rates quoted by me/us for the whole work in accordance with Notice/Letter Inviting Tender, General Conditions of Contract, Schedule of Rates, Specifications for materials and workmanship, time schedule of completion of job and other documents and papers all as detailed in the Tender Documents. 2. It has been explained to me/us that the time stipulated for jobs and completion of Works in all respects and in different stages mentioned in the "Time Schedule" of completion of jobs and signed and accepted by me/us is the essence of the contract. I/We agree that in the case of failure on my/our part to strictly observe the Time of Completion mentioned for jobs or any of them and to the Final Completion of work in all respects accordingly to the schedule set in the said "Time Schedule" of completion of jobs, I/We shall pay compensation to the Owner as per provisions and stipulations contained in General Conditions of Contract and I/We agree to recovery being made as specified therein. The Earnest Money deposit along with the tender (This Earnest Money Deposit shall remain as security deposit which shall be released after satisfactory completion of the work and cleaning / levelling of the site). c) Time allowed: (15) Fifteen days from the date of issue of Letter of Commencement of the work to the tenderer. 4. Should this tender be accepted, I/We hereby agree to abide by and fulfil all terms and conditions referred to above and in default thereof, to forfeit and pay to the Owner or its successors or its authorised nominees such sums of money as are stipulated in conditions contained in General Tender Notices and other Tender Documents. 5. I/We hereby pay the Earnest Money of Rs.25,000.00 (Rupees Twenty Five Thousand Only) in the form of DD vide Draft No. issued by (name and office of any Nationalised Bank) in favour of APMC, Azadpur, 6. GENERAL TERMS & CONDITIONS OF TENDER Name of work :- Dismantling and Disposal of collapsed shed No. 14 having MS columns, trusses & Purlins etc in NFM Azadpur on as is where is basis 1. SCOPE OF WORK: Details of scope of work is given at Schedule I of these tender papers. Bidder is required to quote the rates as per schedule. The bidder can inspect the area to be demolished, disposed off all serviceable & non serviceable material at any lead from the site of APMC, AZADPUR site located at NFM Phase-II, Azadpur, Delhi during working hours on any day between 1000 hours to 1700 hours before submitting the tender. 2. MODE OF SUBMITTING TENDER: Tender in the prescribed form as given under schedule - I of these tender papers should be loaded on web site or reach either or personally dropped in the tender box, kept at above mentioned address in sealed envelope super-scribing Quotations for Dismantling and Disposal of collapsed shed No. 14 having MS columns, trusses & Purlins etc in NFM Azadpur on as is where is basis latest by 1500 hrs. on 12.06.2014 addressed to The Secretary APMC, AZADPUR, DELHI - 110033 and accompanied by a separate cover containing D.D. for earnest money as given at clause 3 below. The tenders will be opened at 1530 hrs. on the same day in presence of those tenderers or their agents who may choose to be present. The rate quoted should either be typed or written in ink in clear legible terms both in figures and in words. Overwriting in the tender is not allowed. Correction made in the tender should be initiated by the tenderer and each page of the terms and conditions, schedule and tender forms duly filled in should be signed by the tenderer. 3. EARNEST MONEY: Earnest money for Rs.25,000/- in the form of bank draft in favour of APMC, AZADPUR on any Schedule Bank payable at Delhi should be enclosed in the separate envelope. FORFEITURE OF EARNEST MONEY: If any tenderer subsequently withdraws his bid or makes any modification / alteration in the bid after opening of the bid unilaterally shall be subject to forfeiture of Earnest money. 5. ACCEPTANCE OF TENDER: APMC, AZADPUR, reserves the right to accept or reject any or all the bids without assigning any reason and can also award the work to more than one bidders. APMC, AZADPUR may negotiate or seek clarifications on the price bid and the terms and conditions before accepting any bid. 6. VALIDITY OF TENDER: The bid should be valid for a period of 90 days for acceptance from the date of opening of the bid. 7. INCOMPLETE TENDER OR LATE TENDER: Bids received late, unsealed or without superscription and without earnest money deposit or in-complete in any; other respect are liable to be rejected. 8. AWARD OF CONTRACT: The successful tenderer shall be informed of the intention of APMC, AZADPUR to accept the offer through a letter of intent in writing before the date of expiry of the validity of the tender. 9. SECURITY DEPOSIT AND PAYMENT TERMS: For Schedule I : Dismantling and Disposal of collapsed shed No. 14 having MS columns, trusses & Purlins etc in NFM Azadpur on as is where is basis. i). SECURITY DEPOSIT shall be the EMD deposit which shall be released after successful completion of the work and on cleaning and levelling of the site. Earnest money of the tenderer as deposited in accordance with clause 3 above shall also remain with APMC, AZADPUR as Security Deposit. APMC, AZADPUR will have the right to appropriate in full or in part to make good any loss incurred by APMC, AZADPUR due to non-fulfilment of the work order/contract entered into after acceptance of the tenders. If the work is not done as per our terms and conditions or any breach of contract, the security deposited with APMC, AZADPUR shall be forfeited. ii) Bid amount:- On acceptance of the offer, the bidder will deposit 50% of the bid amount in the form of Demand Draft of any scheduled bank payable at Delhi/New Delhi in favour of APMC, AZADPUR within 3 days from the date of issue of LOA/LOI by APMC, AZADPUR. The remaining 50% of bid amount shall require to deposited within 3 days of issue of letter of commencement. However the bidder shall be at liberty to deposit even 100% of bid amount within 3 days of issue of LOA/LOI. On receipt of entire bid amount the contractor shall be allowed to enter in the premises for carrying out dismantling. 10. COMMENCEMENT AND COMPLETION OF THE WORK: The Contractor shall have to commence the work immediately on receipt of the LOI and complete the entire work within 15 days. The period of contract shall not be extended further, except in special circumstances beyond the control of Department as well as agency. 11. INCREASE OR DECREASE IN THE SCOPE OF WORK: APMC, AZADPUR reserves the right to increase or reduce the quantity of work even after acceptance of the rates/tender. 12. MEASUREMENT OF WORKS: Quantities/Area given in schedule I are approximate and for reference only. Actual area/quantity may vary, hence bidder may judge himself before quoting their rates for demolition. 13. SUB-CONTRACT: The contractors shall not be allowed to subcontract the work to any other bidder in part or full unless approved by APMC, AZADPUR in writing. 14. FORCE MAJEURE: If the execution of the work by the successful tenderer is delayed beyond the stipulated period given in the work order as a result of outbreak of war, acts of God, fire, flood and earth quakes, strikes, riots or acts of nature, the contractor shall not be held responsible for such delay and APMC, AZADPUR and the contractor shall immediately consult with each other to determine the measures to be taken. 15. ARBITRATION AND LEGAL JURISDICTION: In case of dispute arising between the contractor and APMC, AZADPUR shall be settled as per the prevailing guidelines of Indian Council of Arbitration applicable for PSUs. All legal matters pertaining to the work order/contract shall be subject to jurisdiction of Delhi Court. 16. INSURANCE OF PERSONNEL: The contractor will be liable in respect of any type of claim of his employees working in APMC, AZADPUR's premises. Claim arising out of the Workmen's Compensation Act or any other legislation for the time being in force applicable to such employees and to insure his employees under 'Personal Injuries' (Compensation Insurance) Act, 1963. The contractor's failure to adhere to the provisions of the said act and the scheme. In any case it will be the responsibility of the contractor in case of any type of claims by the employees of the contractor working in APMC, AZADPUR's premises and APMC, AZADPUR will have no connection whatsoever with the employees of the contractors to that effect. 17. LOSS/DAMAGE TO APMC, AZADPUR: Any loss/damage due to the negligence or omission of the contractor or his personnel working at the premises of APMC, AZADPUR will have to be made good by the contractor. 18. COMPENSATION FOR DELAY: In case the contractor fails to complete the work in all respect with in stipulated period, then, unless such failure is due to Force Majeure, the contractor shall pay to the Owner by way of compensation for delay,a sum @ Rs.500/- per day, subject to maximum 10 days from the stipulated completion date. Thereafter, the Security amount deposited shall be forfeited and work shall be got done by APMC, AZADPUR at contractor s risk & cost. 19. TIME SCHEDULE: Entire job of dismantling of truss, Disposal and removal of Malba & Leveling of Land at APMC, AZADPUR site as per scope of work annexed at schedule I is to be completed within 15 days from the date of issue of the LOA/LOII/handing over the site. Undertaking by the Bidder I have understood the terms & conditions given above and in case the bid is accepted, we shall abide by the terms and conditions as referred above without any further cause or reason. The area for truss dismantled under Schedule-I will be handed over on AS IS WHERE IS BASIS. Material recovered from demolition/dismantling of specified area will be taken by the bidder. 2. The bidder is to use his own equipments, tools & tackles required for the job. 3. The bidder should use all safety precautions as per safety code while working in APMC, AZADPUR and shall be responsible for the safety of himself and his staff while working in APMC, AZADPUR. 4. The bidder shall have to get the Insurance cover in respect of all the dismantling Labour deployed at site as a safety measures and for financial liabilities in the event if any misshappening occurred at site during demolition work. The bidder shall provide insurance cover of each and every labour engaged for demolition work. He will not engage any labour at site who does not have provided insurance cover. In the event if any labour is deployed at site without the insurance cover it shall be the sole and absolute responsibility of the contractor for any claim on this account. 5. The bidder is to make his own lighting arrangement at the demolition site for working in late hours and also for leveling. 5. The bidder is to abide by all the rules of APMC, AZADPUR and regulations governing the entry/exit of man and material as applicable in APMC, AZADPUR. 6. The rates to be quoted strictly as per the scope of work given in schedules 7. Work shall be carried out during working hours of the office/factory i.e. 0800 hrs to 1700 hrs and after 1700 hrs by taking permission from APMC, AZADPUR. 8. Bidder shall have to remove any obstruction coming in the way while leveling the ground. 9. The malba would be taken by agency himself while making the ground leveled and the area to be cleaned. Even after dismantling of columns foundations etc., entire space should be levelled. 10. Bidder will hand over the ground completely leveled. 11. After dismantling of all the trusses etc, the serviceable material i.e., Plates, Nut Bolts etc. should be stacked properly so that passage should not be blocked. 12. All statutory taxes, Octroi and transportation, loading & unloading at dumping ground will be borne by the tenderer, apart from the rate quoted. 13. Bidder will be allowed to take out the serviceable material only after leveling the plot, however, bidder shall have to remove the malba side by side of dismantling. In case the contractor fails to remove the malba side by side in that event malba can be removed by the dept. on the risk and cost of the contractor out of his EMD amount. Page-7
14. The dismantling contractor shall control the movement of labour within the boundary/ barricading of the dismantling site. He shall ensure that no labour in the premises enters/ works without compliance of all safety precautions. In case if any accident occurs at site due to this failure the contractor shall be sole and absolute responsible for any legal/ financial implications arising out of it. 15. The contractor shall dismantled the buildings as per the specifically specified rates/ status under the Schedule-I, II and shall not start the dismantling of any other building until and unless once he has taken up for dismantling the individual building has been completed. I have understood the terms & conditions as given above and in case the bid is accepted, we shall abide by the terms and conditions as referred above without any further cause or reason.
