0 0 Defendant Salim Akil ( Defendant ) hereby answers the Complaint of Plaintiff Amber Dixon Brenner ( Plaintiff ) as follows: GENERAL DENIAL Pursuant to California Code of Civil Procedure Section.0(d), Defendant denies, generally and specifically, each and every allegation contained in Plaintiff s Complaint, denies that Plaintiff has sustained any injury or loss by reason of any act or omission on the part of Defendant, and denies that Plaintiff is entitled to any relief or damages whatsoever. AFFIRMATIVE DEFENSES FIRST AFFIRMATIVE DEFENSE (Failure to State a Claim). Plaintiff s Complaint fails to state a claim upon which relief may be granted. Plaintiff s claims are barred, in whole or in part, because the alleged implied-in-fact contract with Defendant never existed, and/or is void, invalid, and/or unenforceable. TENTH AFFIRMATIVE DEFENSE (Lack of Injury/Damage) 0. Plaintiff s claims are barred, in whole or in part, because Plaintiff has not suffered any injury or damage as a result of any action taken by Defendant.

TWELFTH AFFIRMATIVE DEFENSE (No Punitive Damages). Plaintiff s request for an award of punitive or exemplary damages against Defendant violates Defendant s right to due process under the California and United States Constitutions. THIRTEENTH AFFIRMATIVE DEFENSE (No Attorneys Fees). Plaintiff cannot state a claim or cause of action that entitles Plaintiff to an award of attorneys fees against Defendant. FOURTEENTH AFFIRMATIVE DEFENSE (Unjust Enrichment). Plaintiff s claims are barred, in whole or in part, because Plaintiff would be unjustly enriched if she were allowed to recover on any part of the damages alleged in her claims. FIFTEENTH AFFIRMATIVE DEFENSE (Reservation of Other Defenses). Defendant reserves the right to assert other affirmative defenses as this action proceeds up to and including the time of trial.
