Presentation on Special Dispensation in awarding PMGSY works with Non Responsive Tenders in selected IAP Districts
14 District of the state is effected with Naxal problem out of 27 Districts. 1185 No. of the road works measuring length of 5831 Km. is effected with the Naxal problems. The sanctioned works could not be awarded even after repeated call of the tender.
Though these roads may not constitute a substantial percentage related to the total no of PMGSY road works and length involved, these roads are extremely critical to open up areas for enhancing Govt. presence. Improving the program delivery and maintaining peace in these areas for the welfare of the habitant. Timely completion of these road works is of upmost critical importance. Govt. of India has provided Special Dispensation in awarding PMGSY works with Non Responsive Tenders in identified 27 IAP Districts in the country.
In the state of chhattisgarh, Balarampur, Bastar, Bijapur Dantewada, Kondagaon, Kanker, Narayanpur & Sukma Districts are included. In above IAP Districts the work could not be awarded in repeated calls, efforts were made to award the work by using special relaxation given by Govt. of India. No bidders participated in repeated calls, the packages were split-up, tender for a part of road invited, even the agency for the stage construction could not be fixed.
Basis for Selection of contractor 1.Priority to local contractors. 2.If not available similar difficult condition working contractor were chosen. In the last resort other than 1 & 2 category were chosen.
Action Prior Award Contractor were called for discussion and also to give them all information about nomination. for implementation, proposed concessions/ relaxation information were provided. Contractor doubts were cleared and for adverse condition departmental help and security was promised. In few Districts due to non availability of local contractors, collector did special effort to get outside contractor.
Procedure for Deciding Rates For consented work, 15 days time given to the interested contractor for submission of rates. Notice for the same was published on notice board. So other contractor would also know and may participate.
The procedure for award on nomination Such nomination were decided by the committee headed by District Magistrate / Collector of the District & comprising of SSP /SP, DFO and head of concern PIU of PMGSY projects presenting the SRRDA. The committee looked in to every such work and decided on merit to award the same on a nomination basis with full justification was recorded in the file. All the other specification parameters and the condition of the PMGSY Scheme will continue to apply in respect of such road works.
Sanctioned works on Nomination One balance work of Kondagaon Districts of sanctioned year2003 04. One balance work of Dantewada District of sanctioned year 2005. Three works of Narayanpur District sanctioned year 2008 09. Have been awarded on nomination basis.
Works in process of award on nomination basis 25 works of phase XII which was sanctioned in March 2013 could not be awarded even after repeated calls. Now 10 proposals of Kanker District, 4 proposals of Kondagaon District & 8 proposals of Narayanpur Districts are in process for which tender premium 17.0 crores is required. Part of a road from Bairamgarh to Keshkutul length 4.5 km is in process of award to CRPF. Apart from above, 84 balance works have been indentified to take up the works on nomination basis for which addition amount of Rs. 30 crores will be required.

No bidder participated even after 7 calls, for completion of the balance work hence decided to execute the work on nomination basis. Notice to work on on nomination basis was issued by Executive engineer kondagaon on dated 24.04.2014 from interested contractor. The last date for the submission of rate was 30.04.2014.
Two contractors submitted sealed envelope on 30.04.2014 which was open on the same day in the following rates were quoted. 1. Ravi Ghosh 48.00% above SOR 2013 2. Dharmendra Mishra 46.% above SOR 2013 The rates received from the contractor was submitted to the District Collector Kondagaon on dated 2.05.2014 by Executive Engineer, with the permission,meeting of the District committee comprising of District Collector, SP, DFO and PIU was scheduled for 05.05.2014. The rate received in the offer was discussed and was found reasonable by the committee and recommended for sanction.
Executive Engineer submitted the proposal with the minutes of the meeting to superintending Engineer on dated 06.05.2014. SE jagdalpur recommended for sanction to CEO, CGRRDA, and 10.05.2014. CEO, CGRRDA after getting Administrative Approval from Govt. the sanction order was issued
The precaution required for award on nomination The justification of the rates offered by the agency should be properly examined on the basis of the rate analysis. It is essential to watch that the contractors carry out the works of culverts simultaneously with the earth work & GSB
Arrangement of extra cost For award of the works on nomination basis generally the offered rates are higher side which required extra cost. The present trend of the offered rate is between 30% to 45% above the SOR of February 2013. It is proposed to bear the required extra cost by Govt of India for the works to be carried out on nomination basis or by Central/ State share of 75% and 25%.
Relaxation for award on nomination basis As per SBD contractor is required to deposit 5% of contract cost as performance guarantee out of which 2.5% at the time of agreement and remaining 2.5% are deducted from running bills. For the works on nomination basis the entire amount of 5% as performance guarantee should be deducted from running bills to attract the contractors to works on nomination basis In IAP district first/single call & negotiation should be allowed in tendering process.
More district to be included for Nomination Rajnandgaon and Gariyaband district are also IAP district theses district are not included in the list of the district for relaxations under nominations basis. As similar condition exist in these districts hence it is proposed to include in the above category.
