The Government in their letter cited, (Copy along with its enclosures sent herewith) have requested to issue suitable instructions to all Collectors, making them personally responsible for the delay in sending reports on the genuineness of the Community Certificates referred to them. It has been suggested that if reply by the Collectors District Magistrates concerned is not sent to the authorities concerned within the period of one month, it should be treated that the caste certificate already issued is a false one. 2. Although the above points have been pointed out in several D.O letters issued from this office, it is noticed that no tangible progress is forthcoming in this regard. Due to abnormal delay in sending verification reports the appointment orders to selected candidates by various agencies are kept pending. At the same time, persons who manpowered and obtained false Community Certificates are allowed to enjoy the benefit depriving the rights of genuine persons. So, delay in verification will cause undue hardship to the individuals in getting employment and job assurance. 3. It may be noted that in the cases referred to the District Collectors / district vigilance Committee the individuals whose Community Certificates is referred to for verification may be to prolong the enquiry by some reason or other due to lacks of possession of genuine evidences in their support. By such dilatory methods they may try to stealthily continue to enjoy an undue benefit. And in some cases the revenue authorities, who are concerned with conducting enquiry in the verification of the genuineness of the Community Certificates may

not realize the importance and pay proper attention to complete the enquiry and send report promptly. As noticed in the memorandum received in Lok Sabha Secretariat, Abnormal delay will lead to unnecessary legal problems also. 4. It is pointed out that, in this office reference No.RA.V (3) 89347/2000 dt: 9.5.2003, the Collectors of all Districts were requested to concentrate on the cases referred for verification of the genuineness of Community Certificates with utmost priority and should tone up the machinery involved in conducting the enquiry and verification with a timely drive for submission of full fledged report property. Further, the Collectors, were requested to take up review of the pending cases with subordinates regularly and critically so as to achieve an optimum result in the disposal of the cases without giving room for inordinate delay and adverse criticism from any quarter. 5. It is therefore requested that the Collectors should strictly follow the instructions already issued in this Office Circular No.RA.V(3) 89347/00 dt. 9.5.03. They are also requested to communicate the reply to the authorities concerned within the period of one month as specified by the Government. To 6. Copy of Lr.No.8(367/SCTC/2003 dt. 16.9.03 Lok Sabha Secretariat Office Memorandum. Sub: Issue of instructions /directions to Collectors to take speedy action in cases of false caste certificates referred to them for verification. The undersigned is directed to state that during the course of examination of the subject Reservation for, and employment of, Scheduled castes and Scheduled Tribes in Services in various Banks / Undertakings etc. by the Committee on the Welfare of Scheduled Castes and Scheduled Tribes, the Committee came to know the several candidates of Non-SC/ST categories particularly from Tamilnadu and Karnataka have got employment in those institutions by producing false caste certificates. The Committee were informed by the respective managements of these institutions that they have taken necessary actions against such employees but in some cases, actions are delayed /pending due to non-receipt of reply from the Collectors/District Magistrates concerned who had issued these caste certificates and to whom the cases of issuance of these caste certificates were referred for verification. Such delay on the part of Collectors give ample time to these defaulters who in the meantime obtain stay orders from Courts thereby resulting in further delay in taking action in these Scrutiny Committee for verification who takes long time in process and the cases are not settled in time and thus the person who committed the offence enjoys the benefits for years. 2. In view of the above position, the Committee decided to take up this matter with the Ministry of Social Justice and empowerment etc. so that corrective steps could be take up. Accordingly on 11 th July 2003, during evidence of the Ministry of Social Justice and Empowerment on the subject National Commission for SCs and STs; its mandate and achievement a review of its organization and working, the Committee brought this matter to the notice of the representatives of the Ministry and suggested that corrective measures may be taken in this regard. The Committee also suggested that instructions should be

issued to all Collectors / District Magistrates making them personally responsible for delay in these cases. The Committee have also desired that while issuing directions /instructions to Collectors / District Magistrates, it may be clearly indicated that if any case for verification of caste certificate is referred to them and reply thereto by the Collector/ District Magistrate concerned is not sent to the institution concerned within a specified period of one month, it should be treated that the caste certificate as issued ( by them) is a false caste certificate. 3. The Ministries of Social Justice & Empowerment, Tribal Affairs and Personnel, Public Grievances & Pensions (Department of Personnel and Training (DOPT)are, therefore, requested kindly to take necessary action in the matter in view of the above observations of the Committee. The action taken in the matter may kindly be communicated to this Secretariat within one month from the date of issue of this communication for placing the same before the Committee. 4.
