City of Derby WPCA Wednesday, May 25, 2011 Special Meeting Call to Order - The meeting was called to order at 6:06 p.m. Pledge of Allegiance - all rose and pledged allegiance. Roll Call - Leo DiSorbo, Richard Bartholomew, John Saccu, James Gildea and Carolyn Duhaime. Also present: WPCA Superintendent - Lindsay King, WPCA Assistant - Denise Cesaroni, and Weston & Sampson Engineers - Tony DeSimone, Sheila O'Malley - Director of Economic & Community Development. Public Portion - no one from the public spoke. Public portion closed. Harvey Finkle - Orangewood East Condominium - Pool Back Flush Connection Mr. Finkle - 270 Shagbark Drive. Mr. Finkle introduced Mark Lancor of Dymar Engineering. Mr. Lancor stated the association went through an upgrade of drainage and paving over the last three to four months. There is a pool and pool house. The pumps and back wash system is located in the basement of the building. Historically the back wash has gone to the sanitary sewer. The connection to the sewer went through a floor drain that was undersized. The back wash would back up on the floor. The improvements were to upsize and solve that problem. The back wash pumps pump about 170 gallons a minute for two to three minutes a day. Often during the week, they may not have to back wash at all. The four inch trap was increased to an eight inch trap. Mr. Lancor is requesting approval from the board for the upgrade as a legal connection. Mr. King felt Mr. Lancor should be here tonight to discuss possible additional requirements. Mr. DeSimone felt the water should be metered. Mr. Lancor stated there is a meter there. A MOTION to approve the work by Mr. Saccu, second by Mr. Barthlomew, all in favor, motion Access Road Pump Station - Sheila O'Malley Ms. O'Malley addressed the board. The road will be constructed in July. Bids went out and will be due June 15th. The road is an 1800 linear foot road starting at the back of BJ's ending in a culde-sac opening up twenty two acres with all utilities. The City created a design for the road with money from a grant. A pump station was also designed, but was a very cost effective design, not meeting the design desired by the W.P.C.A. City of Derby Page 2

The City is prepared to pay for the add on's, for the pump station provided the bids come in under what the City anticipates. The City proceeded forward with the design of the road based on the grant monies the City received. It is anticipated this property will generate new tax dollars and new fees for the WPCA. A MOTION by Mr. Gildea, second by Ms. Duhaime to approve the redesign of the Access Road pump station, pending approval from Corporation Counsel, with a letter from the City stating reimbursement will be provided if bids come in lower than anticipated, all in favor, motion Tracy Lewis, Lewis Associates - Tie Into Sewer - 360 Seymour Avenue Mr. Lewis is looking for approval to tie into the sewer. The property is currently on septic system. The new owner is looking to change the property's use from a full service gas station to a gas station & convenience store. There is one manhole 100 feet from the site. Mr. Lewis is looking for approval to connect the new convenience store into the sanitary sewer system. The usage will be more than what it is now. Mr. Lewis stated they would like to extend up from the manhole to connect in. There may be a stub already installed that accesses the property. Mr. DeSimone reviewed the plans. He would need a full design before the W.P.C.A. can take action. If the sewer is 100 feet up, Mr. DeSimone suggests the sewer be extended to the property so the manhole will come straight out, instead of a long service connection. A check valve should also be installed. The W.P.C.A. staff will have to do a building inspection to make sure there are no sump pumps, roof leader tied into sewer. If there is food served, a grease trap may have to be installed. Finally, a storm water pollution prevention program should be in place. A MOTION by Mr. Saccu, second by Ms. Duhaime pending final approval by Weston & Sampson to put in a convenience store/gas station for connection to the sanitary sewer, all in favor, motion Edward Hull/Edward McManus - 277 Roosevelt Drive - Impact Fee A meeting will be scheduled for next week. Mr. Saccu recommends going out to bid for sludge removal. Resolution Required to Obtain Clean Water Fund Financing Be it Resolved, that it is in the best interest of the City of Derby to enter into contracts with the Department of Environmental Protection in furtherance of this resolution, Leo DiSorbo, Chairman is duly authorized to enter into and sign said contracts on behalf of the Derby the Chairman is further authorized to provide such additional information and execute such other documents as may be required by the state or federal government in connection with said contracts and to execute any amendments, rescissions and revisions thereto. A MOTION to approve the resolution to obtain clean water funding by Mr. Bartholomew, second by Mr. Saccu, all in favor, motion City of Derby - Sewer Use Bills 42 Fifth Street 96-98 Olivia Street 44 Lafayette Street 97 Sodom Lane 25-27 Hawkins Street 36 Lafayette Street The buildings have been demolished with the exception of 97 Sodom Lane. A MOTION by Mr. Gildea, second by Ms. Duhaime to waive the current sewer use fees and future fees, excluding 97 Sodom Lane, pending investigating by W.P.C.A. staff for sewer capping. 97 Sodom Lane was left to the City of Derby to be used for passive recreation. Office Report - Accounts Receivable Aging - Status of Outside Collection Accounts Ms. Cesaroni presented data of delinquent sewer use fees collected by attorneys. There is a total of 106 accounts with attorneys. Activity has been slow. Some properties are in foreclosure. In house delinquent accounts - 36 accounts were paid in full in the amount of $15,046.00 for the month of April. City of Derby Page 4

Total accounts receivable at April 30 2011 (includes outside collections) is $277,874.30-685 delinquent accounts. Current work- final demand statements were sent out in April prior to referring for outside collection. Demands were sent to a small group of delinquent homeowner mortgage companies with the field cards and mortgage deeds. The Tax Collector and Ms. Cesaroni will be looking at the use of collection agencies and lien assignments in the fall. Mr. DeSimone will draft a roof leader letter to be mailed with this year's sewer bills. Updates regarding upgrades should be posted on the website. Danz Magic - 35 Seymour Avenue - Check Valve There were heavy rains last week. There was a call out for manholes overflowing. The property had sewage backing up into the building. It appears excess rainwater is getting into the sewer and causing the back up into the building. When the tenant refurbished the building they put a commode and sink in. This is where the backup occurred. Mr. King had a dye test performed of the property and it did not show in the sewer. It did not show in the storm sewer either. A check valve can be placed on their lateral line to prevent more backups as a short term solution. Mr. King placed a call to the Building Inspector to check the plumbing. It's above grade, which is generally alright. Mr. DeSimone stated the commode is four feet above the street. The sewer in the street is ten feet deep and is a fourteen inch pipe. Mr. DeSimone inspected the outside building and found roof leaders tied in to the sewer. Those were dye tested also and couldn't find it either. The question is where is the water going. Mr. King suggests a cesspool may be tied into the sewer and the dye is stuck in the cesspool. Mr. King will meet with the tenant and request them to have a television inspection of their sewer lateral. If it is a City issue they will be reimbursed the cost of the inspection and take care of the problem. If there is a block in the owners lateral, it is not a City issue. Superintendent Report The Route 8 pipe lining is done. They missed a manhole. Mr. DiSorbo requests the contractor to correct the mistake prior to payment for services. A contractor performed work at 20 High Street. The lateral line may have been ripped up. There were issues with the Division Street pump station. The door to door surveys have not gone well. There has to be thirty five answers and have only received thirteen. Mr. DiSorbo instructed Mr. King to go out with staff during the day to get the surveys completed. This is a chance to get a pump station for free. Engineer Report - Weston & Sampson City of Derby Page 5

The flow meters come out at the end of the month. There were two responses from the surrounding community letters. Woodbridge and Orange stated there are no plans to send flow to Derby. Still waiting on Seymour, Ansonia and Shelton. Met with Sheila O'Malley to talk about redevelopment and additional flows. If no one else ties into the system outside, you will have approximately two million gallons a day, which is what the plant can handle. Mr. DeSimone and Mr. King spoke at the career fair at the Derby Middle School.
