Employment & Discrimination Olinga has a busy employment practice, which involves advising and representing claimants and respondents in Employment Tribunal hearings spanning TUPE, unfair dismissal, discrimination, protected disclosure detriment and unpaid wages. Recent cases include: A v Corporate Officer of House of Lords Advised on and pleaded a reasonable adjustments claim for a disabled employee of the House of Lords. WL v Santander UK Plc Successfully represented Santander UK Plc in defending a claim for unfair dismissal on jurisdictional grounds. Mills v East Sussex NHS Trust Represented the Claimant in an unfair dismissal claim involving the dismissal of a porter by an NHS Trust following allegations that he had sexually assaulted a patient. ET ordered reinstatement of the Claimant and awarded a sum for payment that the Claimant would have received but for his dismissal. Judgment available here. K v NP Ltd Judicial mediation. Represented the Claimant in a case involving disability discrimination and less favourable treatment under the Part-time Workers Regulations. Obtained favourable reference and financial settlement. Pensions & Trusts Olinga s experience in pensions & trusts law includes: AB v The Board of the PPF Acted for the successful appellant in a High Court appeal from a determination of the Pension Protection Fund Ombudsman. The appeal concerned a narrow but important point of law regarding the construction of Paragraph 26 of Schedule 7 to the Pensions Act 2004 (led by David E. Grant). Drafted skeleton argument on behalf of the Claimant (assisting David E. Grant). HCL Ltd Advised a large employer on the feasibility of using the NOW pension scheme as the scheme by which it fulfils its auto-enrolment duties (assisting Saul Margo). Personal Injury Olinga has a wide ranging personal injury practice. He advises, drafts pleadings and regularly appears in court hearings, including costs and case management hearings and infant settlement approval hearings. Recent cases include: DH v SB Ltd Drafted Particulars of Claim and a Schedule of Loss in a brain injury case involving a young claimant who fell three metres onto a concrete floor in the course of his work insulating a loft. HW v A Student Union Successfully represented a claimant in a fast-track personal injury trial in a tripping case, securing an award of nearly 20,000. JK v ER Advised on quantum in a case involving a child who suffered an amputation of his left index finger on a log splitter. A v B Advised on the merits of appending an Article 2 ECHR claim onto an ordinary civil claim in negligence (assisting Eliot Woolf). In addition to domestic claims, Olinga advises on cases with an international element or where injuries are sustained abroad. Recent cases include: HW v GLBR Advised on a case involving a child claimant who suffered a significant wrist injury whilst cycling in France as a result of a collision with a car. Clinical Negligence Olinga is developing a wide ranging clinical negligence practice. He advises, drafts pleadings and attends court hearings, including costs and case management and interim hearings. Olinga is highly numerate and is adept at drafting complex schedules of loss. Recent cases include: Combination Metal-on-Metal Hip Prosthesis Litigation Olinga is acting for c.25 claimants who bring claims against a number of NHS Trusts and individual surgeons arising out of the practice of mixing and matching total hip replacement component parts (led by Christopher Gibson QC and Eloise Power). RM v an NHS Trust Advised on quantum in a wrongful birth case in which the Claimant, who was HIV positive, fell pregnant whilst protected by a contraceptive implant following a failure by the Defendant to advise of the risk of drug interactions. OL v an NHS Trust Fatal Accident Act case involving delayed diagnosis of cancer. Conducted pre-action conference with breach and causation experts and drafted Particulars of Claim. During pupillage, Olinga assisted various members of Chambers in a wide variety of clinical negligence claims including spinal injury, delayed diagnosis of multiple sclerosis and various forms of bowel injury. Public Inquiries and Inquests Since the start of September 2017, Olinga has been instructed as one of a team of junior counsel working on the Independent Inquiry into Child Sexual Abuse, the largest ever public inquiry in the UK. Olinga was originally instructed in the investigation into the Anglican Church and appeared as of one of the junior counsel to Fiona Scolding QC in the three week public hearing in March 2018. Since then, Olinga has been instructed in the investigation into the Nottinghamshire Councils, which has been examining the abuse of children in residential and foster care across Nottinghamshire, as well as harmful sexual behaviour between children in care across the county. Olinga appeared in the three week public hearings in October 2018. Olinga s work on the Inquiry has involved careful analysis of vast quantities of documentary evidence and complements his personal injury and clinical negligence practice. Public Law Olinga has experience in a range of public law matters. He regularly drafts grounds of resistance in immigration cases on behalf of the Secretary of State for the Home Department. Aside from this, his recent work includes: A County Council v AG Drafted a position statement in Court of Protection case involving an 18 year old man with diagnoses of autism and ADHD. AG had been moved from his family home to a placement which he had subsequently left following concerns about its suitability (assisting Fiona Scolding QC). A Borough Advised on the question of whether the duty of aftercare under s117 MHA 1983 is engaged when a patient is given s17 MHA 1983 leave of absence (assisting Mark Mullins). R(MR) v a Borough Acting for the Borough in an application for judicial review in which the Claimant was challenging the Defendant s failure to consider providing him with accommodation under the Care Act 2014 (assisting Mark Mullins).
