NQAKULA Minister for Safety and Security SCHEDULE REGULATIONS FOR MUNICIPAL (METROPOLITAN) POLICE SERVICES REGARDING MEDALS AND DECORATIONS 1. Wearing of decorations and medals (1) Decorations, medals, bars, clasps and ribbons, including any miniature reproduction thereof, must be worn with due regard to the provisions of the Warrants in terms of which they have been instituted. (2) The Executive Head of a municipal (metropolitan) police service may determine the occasions at and the circumstances in which a decoration, medal, bar and clasp, as well as any miniature reproduction thereof, may be worn.

4 NO.30523 GOVERNMENT GAZETTE, 4 DECEMBER 2007 (3) A decoration, medal, bar, clasp or ribbon, including any miniature reproduction thereof, may be worn only by a person to whom it has been awarded. 2. Certificate of award and undertaking by recipient (1) The Executive Head of a municipal (metropolitan) police service or an officer designated by him or her, must issue a certificate of award in respect of each decoration or medal awarded. (2) Except in the case of a posthumous award, the Executive Head of a municipal (metropolitan) police service may require from any person to whom a decoration or medal has been awarded, to give a written undertaking that he or she will- (a) not, at any time, give away, throwaway, sell, pledge, barter or in any way other than by bequest, alienate such decoration, medal, bar, clasp or ribbon, including any miniature reproduction thereof, or the certificate of award in respect of such decoration or medal; (b) immediately report the loss thereof to the Executive Head of a municipal (metropolitan) police service in writing; and (c) immediately return to the Executive Head of a municipal (metropolitan) police service any such decoration or medal and the bar, clasp or ribbon, including any miniature reproduction thereof as well as the certificate of award in respect thereof which, in terms of these Regulations, have been cancelled, annulled or declared forfeited.

Presentation of decorations and medals (1) A decoration, medal, bar, clasp or ribbon, including any miniature reproduction thereof, or the certificate of award in respect of such decoration or medal shall, if at all possible, be presented- (a) to the person on whom it is conferred himselfor herself, and in the case of a posthumous conferment, tothe next-of-kin, other relative or legal heir of the deceased person, as the Executive Head of a municipal (metropolitan) police service may decide; and (b) on parade or at a special gathering. 4. Forfeiture (1) The Mayor of a municipal (metropolitan) council, upon the recommendation of the Executive Head of a municipal (metropolitan) police service, may cancel or annul the awarding of a decoration or medal and declare that it is forfeited, if the person to whom it was awarded - (a) deserts from a municipal (metropolitan) police service, or is discharged therefrom on account of misconduct; or (b) is convicted of any crime contemplated in Schedule 1 of the Criminal Procedure Act, 1977 (Act No. 51 of 1977). (2) The cancella.tion or annulment and forfeiture of a decoration or medal in terms of subregulation (1) also means the forfeiture of any bar, clasp or miniature reproduction thereof, as well-as any certificate of award. (3) If a decoration or medal has been cancelled or annulled and declared forfeited, the person to whom it was awarded must forthwith return to the Executive Head of a municipal (metropolitan) police service the decoration or medal and the bar, clasp or ribbon, including any miniature

(4) Any person whose decoration or medal was cancelled or annulled and declared forfeited in terms of this regulation, may make written representations to the Mayor of the municipal (metropolitan) council for the restoration of the forfeited decoration or medal. (5) The Mayor of the municipal (metropolitan) council may restore the awarding of a decoration or medal if, after consideration of the written representations contemplated in subregulation (4), he or she is satisfied that the restoration of the decoration or medal that was cancelled or annulled and declared forfeited, will not bring the said decoration or medal in disrepute. (6) If the Mayor of the municipal (metropolitan) council has restored a decoration or medal as provided for in subregulation (5), the decoration or medal and any bar, clasp or ribbon relating thereto, including any miniature reproduction thereof, and the certificate of award in respect of such decoration or medal, must be returned to the person to whom it was awarded. 5. Record keeping regarding the awarding and forfeiture of medals and decorations (1) The Executive Head of a municipal (metropolitan) police service or an officer designated by him or her, must ensure that a copy of the certificate of award in respect of each decoration or medal which was awarded to a person in terms of regulation 2 above, is forwarded to the office of the National Commissioner for purposes of filing such certificate of award and making an entry in a register for the awarding of medals and decorations by municipal (metropolitan) police services for record keeping purposes.

STAATSKOERANT, 4 DESEMBER 2007 No.30523 7 (2) If a medal or decoration has been cancelled, annulled or declared forfeited in terms ofthese Regulations, the Executive Head of a municipal (metropolitan) police service must inform the National Commissioner accordingly to ensure that an appropriate entry be made in the register referred to in subparagraph (1) above that reflects that the medal or decoration has been cancelled, annulled or declared forfeited. 6. Theft, loss, destruction or damage (1) The person to whom a decoration or medal was awarded must forthwith report to the Executive Head of a municipal (metropolitan) police service the theft, loss or destruction of or damage to a decoration, medal, bar, clasp or ribbon, including any miniature reproduction thereof, or the certificate of award in respect of such decoration or medal. (2) The Executive Head of a municipal (metropolitan) police service may authorize the replacement of a decoration, medal, bar, clasp or ribbon, including any miniature reproduction thereof, or the certificate of award in respect of such decoration or medal, if he or she is satisfied that it has been stolen, lost, destroyed or damaged. (3) The Executive Head of a municipal (metropolitan) police service shall decide whether the replacement of a decoration, medal, bar, clasp or ribbon, or the certificate of award in respect of such decoration or medal, which has been stolen, lost, destroyed or damaged, shall be issued atthe expense ofthe recipient, or at the expense ofthe municipalityconcerned: Provided that, a miniature reproduction of a decoration, medal, bar, clasp or ribbon shall be issued only at the expense of the recipient.

Specimens for museums A specimen of a decoration, medal, bar, clasp or ribbon, including any miniature reproduction thereof, may be made available to recognized museums or similar institutions with the written approval of all the Executive Heads of the various municipal (metropolitan) police services. 8. Short title These Regulations shall be known as the Regulations for Municipal (Metropolitan) Police Services regarding Medals and Decorations, 2007.

Ora van dekorasies en medaljes (1) Dekorasies, medaljes, balke, gespes en linte, insluitende enige miniatuur reproduksie daarvan, moet met behoorlike inagneming van dievoorskrifte van die Bevelskrifte waarvolgens dit ingestel is, gedra word. (2) Die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens kan die geleenthede en omstandighede waaronder 'n dekorasie, medalje, balk en lint, asook enige miniatuurreproduksie daarvan gedramag word, bepaal.

Toekenningsertifikaat en onderneming deur ontvanger (1) Die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens of 'n offisier deur hom of haar aangewys, moet 'n toekenningsertifikaat ten opsigte van elke dekorasie of medalje toegeken, uitreik. (2) Behalwe in die geval van 'n postume toekenning, kan die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediensvan enige persoon aan wie 'n dekorasie of medalje toegeken is, vereis om 'n geskrewe onderneming te gee dat hy of sy - (a) nie te enigertydsodanigedekorasies, medalje, balk, gespe of lint, insluitende 'n miniatuur reproduksie daarvan of die toekenningsertifikaat ten opsigte van sodanige dekorasie of medalje sal weggee, weggooi, verkoop, verpand, verruil of op enige ander wyse as deur 'n bemaking, sal vervreem nie; (b) onmiddellik die verlies daarvan skriftelik aan die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens sal rapporteer; en (c) enige sodanige dekorasie of medalje en die balk, gespe of lint insluitende enige miniatuur reproduksie daarvan asook die toekenningsertifikaat ten opsigte daarvan wat kragtens hierdie Regulasies gekanselleer, nietig of verbeurd verklaar word, onmiddellik aan die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens sal terugbesorg. 3. Oorhandiging van dekorasies en medaljes (1) 'n Dekorasie, medalje, balk, gespe of lint insluitende enige miniatuur reproduksie daarvan of die toekenningsertifikaat ten opsigte van

STAATSKOERANT, 4 DESEMBER 2007 No.30523 11 sodanige dekorasie of medalje moet, indien enigsins moontlik oorhandig word- (a) aan die persoon aan wie dit toegeken is self en in die geval van 'n postume toekenning aan die naasbestaande, anderfamilielid of een wettige ertgenaam van die oorlede persoon soos wat die Uitvoerende Hoofvan 'n munisipale (metropolitaanse) polisiediens mag besluit; en (b) op parade of by 'n spesiale byeenkoms. 4. Verbeuring (1) Die Burgemeester van 'n munisipale (metropolitaanse) raad, op die aanbeveling van die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens, kan die toekenning van 'n dekorasie of medalje kanselleer of nietig verklaar en dit verbeurd verklaar indien die persoon aan wie dit toegeken is- (a) uit 'n munisipale (metropolitaanse) polisiediens dros of weens wangedrag daaruit ontslaan word; of (b) skuldig bevind word aan enige misdryf bedoel in Bylae 1 van die Strafproseswet, 1977 (Wet No. 51 van 1977). (2) Die kansellasie, nietig- of verbeurdverklaring van 'n dekorasie of medalje kragtens subregulasie (1) beteken ook dat die balk, gespe of miniatuur reproduksie daarvan, asook die toekenningsertifikaat verbeur word. (3) Indien 'n dekorasie of medalje gekanselleer of nietig en verbeurd verklaar is, moet die persoon aan wie dit toegeken is, die dekorasie of medalje en die balk, gespe of lint insluitende enige miniatuur reproduksie daarvan asook die toekenningsertifikaat ten opsigte van sodanige dekorasie of medalje onverwyld aan die Uitvoerende Hoof van die munisipale (metropolitaanse) polisiediens terugbesorg.

12 No.30523 GOVERNMENT GAZETTE, 4 DECEMBER 2007 (4) Enige persoon wie se dekorasie of medalje kragtens hierdie regulasie gekanselleer of nietig en verbeurd verklaar is, kan skriftelike vertoe aan die Burgemeester van die munisipale (metropolitaanse) raad rig vir die herstelling van die verbeurdverklaarde dekorasie of medalje. (5) Die Burgemeester van die munisipale (metropolitaanse) raad kan die toekenning van 'n dekorasie of medalje herstel indien na oorweging aan die skriftelike vertoe bedoel in subregulasie (4) hy of sy tevrede is dat die herstel van die dekorasie of medalje wat gekanselleer of nietig en verbeurd verklaar is, nie die genoemde dekorasieof medalje nie in oneer sal bring nie. (6) Indien die Burgemeester van die munisipale (metropolitaanse) raad 'n dekorasie of medalje herstel het 5005 voorsiening gemaak in subregulasie (5), moet die dekorasie of medalje en enige balk, gespe of lint met betrekking daarmee insluitende enige miniatuur reproduksie daarvan en die toekenningsertifikaat ten opsigte van sodanige dekorasie of medalje aan die persoon aan wie dit toegeken is, terugbesorg word. 5. Byhou van rekords aangaande die toekenning en verbeuring van medaljes en dekorasies (1) Die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens of 'n offisier deur hom of haar aangewys, moet verseker dat 'n afskrif van die toekenningsertifikaat ten opsigte van elke dekorasie of medalje wat aan 'n persoon ingevolge regulasie 2 hierbo toegeken is, na die kantoor van die Nasionale Kommissaris gestuur word vir doeleindes van die liassering van sodanige sertifikaat of toekenninq en die aanbring van 'n inskrywing in 'n register vir die toekenning van medaljes of dekorasies deur munisipale (metropolitaanse) polisiedienste vir rekord houding doeleindes. (2) Indien 'n medalje of dekorasie ingevolge hierdie Regulasies gekanselleer, nietig- of verbeurd verklaar is, moet die Uitvoerende Hoof

STAATSKOERANT, 4 DESEMBER 2007 No.30523 13 van 'n munisipale (metropolitaanse) polisiediens die Nasionale Kommissaris dienooreenkomstig inlig ten einde te verseker dat 'n gepaste inskrywing in die register waarna in subparagraaf (1) hierbo verwys word, gemaak word wat reflekteer dat die medalje of dekorasie gekanselleer, nietig- of verbeurd verklaar is. 6. Diefstal, verlies, vernietiging of beskadiging (1) Die persoon aan wie 'n medalje of dekorasietoegeken is, moet onverwyld die diefstal, verlies van of beskadiging van 'n dekorasie, medalje, balk, gespe of lint insluitende enige miniatuur reproduksie daarvan, of die toekenningsertifikaatten opsigte van sodanigedekorasieof medalje aan die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens rapporteer. (2) Die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens kan magtiging vir die vervanging van "n dekorasie, medalje, balk, gespe of lint insluitende enige miniatuur reproduksie daarvan of die toekenningsertifikaat ten opsigte van sodanige dekorasie of medalje magtig indien hy of sy tevrede is dat dit gesteel, verloor, vernietig of beskadig is. (3) Die Uitvoerende Hoof van 'n munisipale (metropolitaanse) polisiediens moet besluit of die vervanging van 'n dekorasie, medalje, balk, gespe of lint of die toekenningsertifikaat ten opsigte van sodanige dekorasie of medalje wat gesteel, verloor, beskadig of vernietig is, teen die koste van die ontvanger of teen die munisipaliteit uitgereik moet word: Met dien verstande dat 'n miniatuur reproduksie van 'n dekorasie, medalje, balk, gespe of lint slegs teen die koste van die ontvanger uitgereik sal word. 7. Eksemplare vir museums 'n Eksemplaar van 'n dekorasie, medalje, balk, gespe of lint insluitende enige miniatuur reproduksie daarvan kan slegs aan erkende museums of soortgelyke instellings beskikbaar gestel word met die skriftelike goedkeuring van al die
