1 February 27, 2018 Statement: This meeting is being held in conformance with the Sunshine Law. Notice has been furnished to The Record and The Ridgewood News stating the time and place of this meeting. Notice has also been posted on the bulletin board of the Administration Building. A regular meeting of the Mayor and Council of the Borough of Waldwick was called to order by Mayor Giordano at 7:30 p.m. in the Council chambers of the Administration Building. Roll Call: Also Present: Mayor Giordano Councilman Bjork Councilwoman Dellavechia Councilman Farricker Councilman Oravetz Councilman Schatz Councilman Sciolaro - absent Laura Harris, Administrator Paula Jaegge, Municipal Clerk Craig Bossong, Attorney Erica Davenport, Grants Administrator Kenneth Almeida, Clerk Typist Mayor Giordano led the Council in the Pledge of Allegiance and Ms. Jaegge led the Prayer. Reports of Committees Mayor s Report Mayor Giordano reported that he attended an Eagle Scouts ceremony on Friday, February 23. Griffin Lawler was elevated to Eagle Scout. Saturday morning the Mayor attended the Girl Scouts Pinewood Derby as a judge. He stated that the Pack 88 Cub Scouts met with the him and asked how government works and what the Mayor s responsibilities were. Jennifer is their leader and went on to explain the energy conservation experiment that the boys did at home and offered their services to help distribute new recycling bins to the parks in the spring. The boys then explained their challenges trying to avoid using very little electricity for one day. Mayor Giordano thanked Jennifer and the Scouts for offering their services to help the community. Mayor Giordano stated that tonight we are honoring certain employees for their time working in the Borough. He stated that every five years the Mayor & Council honor their workers. Mayor Giordano introduced Roy DeBoer. Roy has been working in the DPW for over thirty years and is very active in the community. The Mayor noted that he is also a dedicated firefighter

2 in the Fire Department. The Mayor went on to state that Roy DeBoer is always serving the community and an asset to the Borough. The Mayor then presented him with an award. Mayor Giordano introduced Susan Cubby. Susan had been a crossing guard for over 25 years. The Mayor stated that she is a very dedicated individual protecting the kids who cross the street every day. The Mayor stated that she is an asset to the community and presented her with an award. Mayor Giordano introduced Pete Flatten. Pete is a repairman at the DPW and was the Assistant Chief of the Fire Department. Pete and Roy DeBoer work together in the DPW and the Fire Department protecting and serving. Pete also helps the Girl Scouts deliver and distribute their Girl Scout Cookies to everyone. The Mayor stated that he is an asset to the community and presented him with an award. Mayor Giordano introduced Kate MacPhee. Kate has served the Borough for over twenty years working in the Tax and Water Department. Kate has a great repertoire with the elderly of Waldwick and always has patience guiding them in the right direction. The Mayor then stated that she is an asset to the community and presented her with an award. Mayor Giordano introduced Charles Bucky Joaquin. WHEREAS, Charles Bucky Joaquin began his career with the Borough of Waldwick on, April 19, 1982 as a Public Works Repairman. WHEREAS, Charles Bucky Joaquin has faithfully served the Borough of Waldwick and its citizens for 35 years during which period of time many projects were worked on by him such as working on the Pistol Range Combat Course Modifications and helped the PBA install the New Score Board in Borough Park. WHEREAS, these 35 years of service have been marked by dedication to the best interests of the community, and Bucky has worked constantly for the betterment of the public works system, which contributes to the health, safety and comfort of this community; and WHEREAS, the Borough of Waldwick has benefited greatly because of Bucky training and education in Confined Space Entry Seminars, Playground Safety Awareness Workshops, Power Tool Safety Seminars, Confined Space Operations and Awareness and Forklift Training, WHEREAS, Bucky is also a Machine Operator working on Small Machines as well as Backhoes. He also has aided the Water Department with Water Main Breaks. WHEREAS, on behalf of the entire Borough Council, I want to express my sincere appreciation to Bucky for his dedication & hard work to the Borough of Waldwick over the past 35 years and wish him much happiness as he begins a new chapter in his life. NOW, THEREFORE, BE IT Proclaimed that I, Thomas A. Giordano, Mayor of the Borough of Waldwick, on behalf of the entire Borough Council and the community does hereby extend to Charles Bucky Joaquin

3 Our thanks, appreciations for his dedication and hard work to our Borough BE IT FURTHER RESOLVED, that this resolution be spread upon the minutes of this meeting, and a copy thereof presented to Bucky Joaquin Financial & Administrative Committee Mr. Sciolaro was absent therefore no report was given. Public Safety Committee Mr. Schatz reported that he attended the Ambulance Corps. Meeting on the 26 th and also attended the Girls Scouts Pinewood Derby on Saturday, February 24. Recreational & Health Committee Ms. Dellavechia reported that the Waldwick Stigma Free Initiative will be holding an event on March 7 at Metro Church on Wyckoff Ave from 7pm 8pm, and will be free and open to the public. She stated that opioid and heroin abuse will be discussed and noted that Waldwick is one of the communities where this issue does not occur as frequently. She went on to mention that we need to keep it this way and make improvements where we can. Ms. Dellavechia then reported on the 5k race and the state of the roads. Ms. Dellavechia stated the Council needs to work with PSE&G to make sure that the roads are fixed before the race in May. Buildings & Grounds Committee Mr. Farricker reported on the Vietnam War discussion at the library. He stated that Mr. McGuinness took personal photos during the war that no one has seen before. Mr. Farricker reported that the American Legion has a breakfast on Sunday, March 4, and he will be attending the Board of Education meeting on March 5. He noted that the Booster Club breakfast was a success. Mr. Farricker stated that the high school graduation will be taking place on June 22. Public Works Committee Mr. Bjork reported that there is a lot of work that needs to completed on West Prospect Street for the 5K race coming up. He stated that the DPW has been maintaining the trucks and plows and has also been cleaning the leaves in Borough Park.

4 Fire Protection Committee Mr. Oravetz reported that the rescue truck is being serviced to fix an electrical issue. He stated the fast team responded to a house fire in Franklin Lakes and everyone remained safe. Consent Resolution and Resolutions of the Governing Body The Clerk read the following resolution: BE IT RESOLVED that the following resolutions herewith listed by consent having been considered by the governing body of the Borough of Waldwick are hereby passed and approved: (A) Approval of Minutes a. 2/6/2018 Budget Meeting b. 2/13/2018 Regular Meeting (B) Policy Votes a. Drew Churchson requests to reserve Park A on September 9 from 9am to dusk for the Waldwick Pistol & Rifle Club with rain date on September 16 at Park B. Alcoholic beverages to be served. b. Christine Doyle requests to reserve Park A on April 22 from 9am to 4pm for Earth Day. c. Michelle Collettis requests to reserve Park A on June 27 from 12pm 3pm for the Waldwick Golden Club. Alcoholic beverages to be served. d. Donna Palladino requests to reserve Park A on June 10 and August 19 from 9am 6pm for the IASCW. e. Renee Goodlin requests to reserve Park B on June 2 from 10am 4pm. f. The Village School requests permission to use the pool parking lot on February 26, from 7:30am 4pm, May 9 from 6pm 9pm, and May 20 from 10am 12 pm. g. Children s Librarian requests permission to use the Waldwick Swim Club on July 13 and August 10 at 12pm for kid s story time. h. WEF requests to hold the Town Wide Garage Sale and request the use of the Borough parking lot on April 28 and 29 to distribute the maps. Also requested is to hang a sign by Route 17 crosswalk and Sheridan Ave three weeks prior to sale. i. Senior Class Advisor requests to use the pool on June 18 from 12pm 3pm for the senior class barbeque with rain date of June 19. 5 Resolution moved by Mr. Farricker, seconded by Ms. Dellavechia. On the Question: Mayor Giordano reported that there are new rules and regulations for applying to use the parks in town. He also mentioned that resolutions E through L are all the payments of taxes. Roll Call: Mr. Bjork, yes; Ms. Dellavechia, yes; Mr. Farricker, yes; Mr. Oravetz, yes; Mr. Schatz, yes. Introduction of 2018 Budget BE IT RESOLVED, that the following statements of revenues and appropriations attached hereto constitute the local Budget of the Borough of Waldwick, Bergen County, New Jersey for the year of 2018. BE IT FURTHER RESOLVED, that the said budget will be published in the Ridgewood News in the issue of March 16, 2018 and that a hearing on the Budget will be held at the Municipal Building on March 27, 2018 at 7:30 o clock (P.M.) or as soon thereafter as the matter may be reached. Mayor Giordano introduced the 2018 Operating Budget. He stated that this is the seventh year in a row that there will not be a tax increase. He stated that the budget was presented by Ms. Harris, Ms. Ennis, and Mr. Kratz. Reports of Department Heads Referred to Council (A) Advertised Business Mayor Giordano requested the Clerk to read Ordinance 1-18 by title: ORDINANCE 1-18 BOND ORDINANCE TO AUTHORIZE THE MAKING OF VARIOUS PUBLIC IMPROVEMENTS AND THE ACQUISITION OF NEW ADDITIONAL OR REPLACEMENT EQUIPMENT AND MACHINERY, NEW COMMUNICATION AND SIGNAL SYSTEMS EQUIPMENT AND NEW INFORMATION TECHNOLOGY EQUIPMENT IN, BY AND FOR THE BOROUGH OF WALDWICK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $1,020,000 TO PAY THE COST THEREOF, TO APPROPRIATE BOROUGH OPEN SPACE TRUST FUND MONEYS AND A STATE GRANT, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO

6 PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS. Mayor Giordano asked if any Council member wished to comment on the ordinance just read. On the Question: Mayor Giordano stated that the items on this budget are the most important ones that help provide the tools and services for the community. He explained that the department heads met with the CFO and Administrator to discuss what items they need to help run their respective department. He stated that each year they manage to meet the Borough s needs while also keeping the budget as low as possible and are very proud of it. He thanked Gary Kratz, Colleen Ennis, Laura Harris, and the department heads for their work on the capital/operating budget. Ms. Harris briefly went over the list of items in the capital budget from each department. Mayor closed Council comments and asked if anyone from the public wished to be heard during the public hearing. Moved by Mr. Bjork, seconded by Mr. Farricker to move and pass this ordinance on second and final reading and that it be advertised in local, legal newspapers as required by law. Mayor Giordano requested the Clerk to read Ordinance 2-18 by title: ORDINANCE 2-18 BOND ORDINANCE TO AUTHORIZE THE UNDERTAKING OF VARIOUS WATER SYSTEM IMPROVEMENTS IN, BY AND FOR THE WATER UTILITY OF THE BOROUGH OF WALDWICK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $50,000 TO PAY THE COST THEREOF, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS. Mayor Giordano asked if any Council member wished to comment on the ordinance just read. On the Question: Bjork stated that the water department budget is different from the Borough s budget.

7 Mayor Giordano closed the Council comments and asked if anyone from the public wished to comment on the ordinances just read. No one wished to be heard therefore Mayor Giordano closed the public comment. Moved by Mr. Farricker, seconded by Mr. Shatz to move and pass this ordinance on second and final reading and that it be advertised in local, legal newspapers as required by law. Mayor Giordano requested the Clerk to read Ordinance 5-18 by title: ORDINANCE 5-18 AN ORDINANCE AMENDING CHAPTER 91, ENTITLED "VEHICLES AND TRAFFIC TO AMEND SECTION 91-35 ENTITLED VEHICLES AND TRAFFIC Mayor Giordano asked if any Council member wished to comment on the ordinance just read. On the Question: Mayor Giordano reported on the parking situation at the Borough Hall. He noted that people have been parking in the Borough s parking lot which is in between Valley National Bank and the restaurant Circolo. After attempts to prevent people from doing so, an ordinance had to be created to deal with the issue. On the Question: The Mayor reported that many residents were concerned about parking cars Dora Ave because commuters were parking in front or in resident s driveways in order to take the bus. He stated that there was a meeting held at Borough Hall which included the residents of Dora Ave and the commuters who have been parking there. An ordinance was created depicting twenty-five feet in between the resident s driveway and the commuter parking spots. Ms. Dellavechia and Mr. Bjork stated that they have changed their minds on this ordinance and now support it. She stated that several people were parking on this street that were non residents and we are now restricting the spots to Waldwick residents only. There will be an application for a lottery to obtain said parking spots which will be renewable every year. He also questioned the beautification of downtown Waldwick. Mayor Giordano replied stating that the police are taking this matter very seriously and are at the school patrolling at various times. They have been in the school training to prepare for any emergencies involving an active shooter. In regards to the vape store, Mayor Giordano stated that the owner must follow a strict set of regulations and swore under oath to uphold those regulations. Mr. Bossong stated that as long as the business is looked into and permitted, they are allowed to open up. In regards to the beautification of downtown, Mayor Giordano stated that the Council has tried to work with the private businesses that are across the street from the library on this issue, but they were not willing to change their storefronts.

11 Laura DiGiovanni, 14 Cypress Court, questioned the second vape store and had a general concern over its health effects in regards to the town of Waldwick. Mr. Bossong stated that this vape store is a legal business and allowed at this location. The Mayor stated that the Council can work on an ordinance in the future with regulations. Bill Burns, 117 Waldwick Ave, questioned about putting a Police Officer in the schools for protection. Mr. Burns offered to help the Borough in order to do so as he is a retired Police Officer. He stated that the Mayor & Council, Board of Education, and Police Department should work together in order to make progress on this issue. Mayor Giordano stated that he and the Police Chief both spoke with the Superintendent of Schools about this issue and they will be working on this issue. Mary Beth Nappi, 99 Manhattan Ave, thanked the Mayor & Council for working with the school. Marty Noble, 37, Woodside Road, expressed his concern about the deer population in Waldwick. He stated that he has contacted all of the organizations that the Council has provided for him and claims that they haven t done anything to help out with his situation. He stated that he has been on this issue for 15 years. He believes that a sixteen-foot fence should be put in place to help curb the deer issue. He also mentioned a coyote sighting on Hopper Ave. Mr. Oravetz explained that the Council has reached out to the NJ Division of Fish, Game, and Wildlife several times about this deer issue and they have stated that they will not kill deer or transport them because they carry ticks which would only be moving the disease. Mayor Giordano stated that he will reach out to Assemblyman Rooney about this issue. Chris Feltman, 46 Hudson Ave, asked about the Dora Ave ordinance and whether commuters would be pushed to park on his street. Ms. Harris stated that the parking spots that are on that street will accommodate the commuters parking there and should not push any commuters anywhere else in Waldwick. He asked about recognition for the recreation programs in town. Mayor Giordano stated the issue of recreation programs will be addressed once the budget is presented as he spoke with the Superintendent and the Baseball Association.

12 Sam Matthews, 22 Cypress Court, stated that he is very concerned about the second vape store and what can be done to prevent another store from opening up in Waldwick. Mr. Oravetz stated that he believes that there are health risks that come with vaping and that the Council will take a proactive approach to this issue. Sal Minervini, 119 Bergen Ave, asked about fines that the vape store could face in order to be shut down. He asked about a four way stop in town and accidents that have been occurring. He then asked about graffiti removal and had a general concern about the beautification of downtown Waldwick to attract new business. Mr. Oravetz stated vape stores would face the same consequences as a liquor store, so it should be a similar amount of violations in order to be shut down. Mayor Giordano stated in regards to downtown beautification the master plan for downtown revitalization is reviewed every four to five years. The Council tried to revitalize downtown but had no success as the store owners were against changing their storefronts and were also afraid that the Council was proposing eminent domain which was not the case. Dina Scardino, 33 Jon Dow Ave, stated that the first vape store has a lounge, but the second store is being restricted from having one. She then asked about certain rooms at the second location using them illegally for vaping. Mr. Bossong stated that the first vape store is allowed to have a lounge, while the second one is not. Mayor Giordano addressed her second concern and stated that the building inspector will be visiting the store frequently to make sure there aren t any room being used illegally. Carol Swarbrick, 78 Hopper Ave, expressed her concern about the distance between the vape store and child friendly businesses. Mayor Giordano addressed her concern stating that this store is being monitored frequently and they understand how close it is to other kid friendly businesses, however the town does have loitering laws in place to stop anyone from vaping in front of the store. Trish Jahnke, Lotus Lane, stated her concerns about minors being allowed into the vape store. She then asked about how many fines it would take in order to close the vape store down. Mayor Giordano addressed her concern that anyone under twenty-one is strictly not allowed to enter the store under any circumstances. Mr. Bossong stated that it depends on the amount of times they are fined and the severity of each one.

13 John McGowan, 39 Malcolm Street, noted that he is very concerned about the vape store and why it can t be shutdown. Mr. Bossong reiterated that this is a legal business, is permitted to sell and has followed their regulations. Mayor Giordano reiterated that the Council and Mr. Mysliwiec will be closely monitoring the store. Anastasia Matthews, 22 Cyprus Court, requested the Mayor & Council to carefully consider future ordinances to prevent any other stores like the vape shop from opening in Waldwick. Athena Matthews, 22 Cyprus Court, expressed her opinion on vaping and how she can see other kids her age using vapes. She is strongly against the vape store and vapes in general.
