Motion carried unanimously. 9:49:18 AM Out of Executive Session: No Action Taken 9:49:31 AM Travel to site for first view of Ditch 2122-Swancreek Ditch 2122-Swancreek Twp View 10/22/2013 Barnaby convened the view at 10:14 a.m. at a location between 6667 CR 2 and 6711 CR in Swancreek Twp, near the site of the petitioned waterway. He then turned the view over to Chief Deputy Engineer, Rod Creager. Mr. Creager explained that the petition, filed by Swancreek Township, is for the cleaning and brush removal of Branch 23 of Swan Creek. He handed out a packet to each of the landowners, and representatives thereof, that were in attendance thereby outlining the ditch improvement process as it follows Chapter 6131 of the Ohio Revised

Code. He explained that this area was last petitioned in 1946 by H. Steusloff, which is now the Schmitz property. The new drainage laws did not go into effect until the 1950s so this ditch did not fall under the provisions of maintenance. He presented a plat of the 1946 petition stating that this new petition would follow the same route and termini. There were 25 parcels at the time of the 1946 petition. This area has since been split several times and has become much more residential with almost 100 parcels. He presented an aerial map of the petitioned area and answered questions regarding the calculation of assessments. It is based on the acres drained into the watershed, the calculated benefit to the land, the proximity of the parcel to the ditch, and the land use. He will have tentative assessments available at the first hearing on November 5 th. Although a proper survey will need to be completed to determine what needs to be done to answer the prayer of the petition, Mr. Creager advised that this would include brush removal on both sides, up to the top; a channel clean out to remove sand bars, sediment and wash-ins. Erosion control measures would be put in places. They would also assess the size of the tiles and culverts at that time also. He explained that since the brush is the landowners responsibility anyway, the brush is cut and left for the landowners to dispose of. They can either burn, haul away, chip, or leave for wildlife cover. He further encouraged that landowners contact the Soil and Water Conservation District regarding the installation of Filter Strips for possible cost sharing. The corn has not been harvested yet so a complete tour of the area was not possible but at 10:31 a.m. Mr. Creager conducted further view of areas downstream near CR F & CR 2. The 1 st public hearing will be held on November 5 th in the s Chambers, beginning at 10:00 a.m. The landowners, and representatives, thereof will be given the opportunity at that time to present testimony for or against the project. This concluded the view.

Fulton St., Wauseon, Ohio, with the following members present: moved for the adoption of the following resolution: WHEREAS, Ohio EPA requires the removal and proper disposal of scrap tires as received at the Fulton County Transfer Station; and WHEREAS, Ohio EPA requires all facilities that receive scrap tires to be a registered transporter to removal more than 10 tires; and WHEREAS, Fulton County Transfer Station receives an average of 100 scrap tires every month; and WHEREAS, Bob s Tire Services, LLC (Ohio EPA registered tire transporter) has submitted a quote for the removal and disposal of scrap tires as collected at the Fulton County Transfer Station; and WHEREAS, after reviewing said quote and comparing it to the Fulton County s current cost to remove and dispose of scrap tires, the Director of Fulton County Public Utilities recommended to contract with Bob s Tire Services, LLC for said service. THEREFORE BE IT RESOLVED, that the Board of Fulton County s enters into Contract 2013-103 with Bob s Tire Services, LLC for the scrap tires removal and disposal for the Fulton County Transfer Station based on the rates as specified in the attached contract document.
