SPECIAL SESSION OF THE MOWER COUNTY BOARD OF COMMISSIONERS February 1, 2005 The Mower County Board of Commissioners in and for the County of Mower, Minnesota, met in Special Session February 1, 2005 at 1:00 p.m. at the Courthouse in Austin, Minnesota. All members present, viz: Raymond Tucker, Chair David Hillier Dick Lang Garry Ellingson Richard Cummings Craig Oscarson, County Coordinator Introduction of Stephen King, Correctional Services Director. Debra Schmitt, Probation Officer, recognized as Employee of the Month. Motion by Commissioner Hillier, seconded by Commissioner Ellingson to change the job description for Engineering Technician I to reflect in the licensing portion that enrollment in a vocational or trade school in the area of civil engineering or related curriculum is preferred, not required. Motion carried. Motion by Commissioner Ellingson, seconded by Commissioner Hillier to require all out of state travel for training and conferences be brought to the Personnel Committee for recommendation and to the full Board for approval. This excludes performance of job duties such as transporting clients or inmates to other facilities and client visits. Motion carried. Motion by Commissioner Hillier, seconded by Commissioner Ellingson to approve the following miscellaneous bills for immediate payment: Mower County SWCD $2,658.64 KKE Architects $1,659.00 Motion carried. Date: February 1, 2005 Res. #10-05 RESOLUTION On motion of Commissioner Cummings, seconded by Commissioner Lang, the following Resolution was unanimously passed and adopted by the Mower County Board of Commissioners at a meeting held February 1, 2005 at the Courthouse, Austin, Minnesota 55912. 020105.doc Page II - 25

BE IT RESOLVED that pursuant to M.S. Chapter 375.34 & 375.35, the sum of up to $100.00 be paid and the same is hereby appropriated out of the General Revenue Fund of Mower County to each of the recognized Military Persons Organizations or Societies filing bills showing expenses in this amount, for the purpose of Memorial Day Exercises and the County Auditor is expected to draw his warrant for the amount shown on the itemized bill not to exceed $100.00. Chair Coordinator Motion by Commissioner Ellingson, seconded by Commissioner Lang to authorize the Chair, Coordinator and Finance Director to sign a letter of understanding with the State Auditor in regard to services for the 2004 audit. Motion carried. Motion by Commissioner Lang, seconded by Commissioner Hillier to deny the following applications of abatement of penalty and interest on taxes payable in 2004 of Roland and Lenore Anderson, parcel number 06-009-0010. The basis for denial is consistency with current policy and practice by the County Board and the recommendation of the County Treasurer. Motion carried. Motion by Commissioner Cummings, seconded by Commissioner Ellingson to approve the minutes of January 25, 2005. Motion carried. Richard Peterson, County Assessor, met with the Board to discuss a proposed settlement agreement in regard to tax court petition Aquila vs. 51 counties and the Department of Revenue for taxes payable in 2003, 2004 and 2005. Motion by Commissioner Ellingson, seconded by Commissioner Cummings to approve the settlement agreement as proposed by the Department of Revenue in regard to tax court petition Aquila vs. 51 counties and the Department of Revenue for taxes payable in 2003, 2004 and 2005. Motion carried. Motion by Commissioner Cummings, seconded by Commissioner Hillier to approve a grant application for federal funds for the Shooting Star Trail from Adams to Rose Creek. Motion carried. Motion by Commissioner Cummings, seconded by Commissioner Lang to set a letting date for seasonal bids including, crushed rock and seal coat aggregate, salvaged crushed concrete aggregate and bituminous mixture; weed spraying; striping; gasoline and diesel fuel; calcium chloride; and bituminous materials, for March 7, 2005 at 1:00 p.m. Motion carried. 020105.doc Page II - 27

Date: February 1, 2005 Res. #11-05 RESOLUTION On motion of Commissioner Hillier, seconded by Commissioner Ellingson, the following Resolution was unanimously passed and adopted by the Mower County Board of Commissioners at a meeting held February 1, 2005 at the Courthouse, Austin, Minnesota 55912. WHEREAS, Minnesota Statute 162.08, subdivision 4(3d), provides that accumulated fund balances in excess of two years of municipal account apportionments may be spent on projects located outside of municipalities under 5,000 population when approved solely by resolution of the County Board, and WHEREAS, Mower County s municipal construction account fund balance has exceeded two years of apportionments, and NOW THEREFORE BE IT RESOLVED that the Mower County Board of Commissioners request that the Commissioner of the Minnesota Department of Transportation transfer and all amounts of municipal construction account fund balance in excess of two years of municipal account apportionments into Mower County s regular construction fund account. Adopted this 1 st day of February, 2005. Chair Coordinator Date: February 1, 2005 Res. #12-05 RESOLUTION On motion of Commissioner Cummings, seconded by Commissioner Hillier, the following Resolution was unanimously passed and adopted by the Mower County Board of Commissioners at a meeting held February 1, 2005 at the Courthouse, Austin, Minnesota 55912. WHEREAS, The Minnesota Department of Transportation (Mn/DOT) wishes to cooperate closely with local units of government to coordinate the delivery of 020105.doc Page II - 28

transportation services and maximize the efficient delivery of such services at all levels of government; and WHEREAS, Occasionally, opportunities arise for local governments to provide services to Mn/DOT; and WHEREAS, the parties wish to be able to respond quickly and efficiently to such opportunities for collaboration, and have determined that Mn/DOT s ability to write work orders against a master contract would provide great flexibility. NOW THEREFOR BE IT RESOLVED: 1. That the County of Mower enters into a Master Contract with Mn/DOT. 2. That the Chairperson of the County Board of Commissioners and the County Coordinator be authorized to execute such contract, and any amendments thereto. 3. That the County Engineer is authorized to negotiate work order contracts pursuant to the Master Contract, which work order contracts will provide for payment of the County by Mn/DOT, and that the County Engineer may execute such work order contracts on behalf of the County without further approval by this Board. Adopted this 1 st day of February, 2005.
