Tenderers are requested to go through the instructions carefully and furnish complete information along with their tender offer, failing which their offer may not be considered at all. Corporation Limited,DLW Bhikharipur, Varanasi. Tenders received. Tenders received late shall not be considered. 1.03 The tenders will be publicly opened in this office at 15.00 hrs on 16.04.2015 in presence of tenderer or their authorized representatives who wish to be present. In case, the offer is not with the valid earnest money/experience of similar nature of work, part-ii of the tender bid shall not be opened. No further consideration of the tender shall be made in such cases. 1.04 Only such firms need tender who can produce satisfactory evidence that they have necessary resources and organization to under take the work tendered for to the satisfaction of the purchaser. 1.05 Tenderer are requested to submit the price schedule in the prescribed proforma, the appendices/annexure duly filled in it by them as required by following strictly the instructions and notes supplementary there-to, to facilitate purchaser to prepare comparative statement. Failure to do so may prevent the tenderer from being considered. 1.06 The successful tenderer will have to execute an agreement in specified contract form for the proper fulfillment of the contract. -2-1.07 The tenderer shall be deemed to have carefully examined the general conditions, special conditions, specifications, schedule etc, attached with the tender specification. 1.08 Any portion of the terms and conditions as laid down in the specification which is not clear to the tenderer should be got clarified before submission of the tender. Tenderer are requested to adhere to all clauses of the contract form A and other terms and conditions to facilitate finalization of the contract. 1.09 The purchaser does not pledge to accept the lowest or any other tender and reserves the right to accept the whole or any portion of any tender as he may think fit without assigning any reason for non-acceptance or selection or reject all tenders without assigning any reason thereof. 1.10 Superintending Engineer, Electricity Transmission Circle, Varanasi, U.P. Power Trans. Corporation Limited, Varanasi, may revise or amend the specifications and drawings prior to the date notified or opening of the tenders. Such revision and amendment, if any, will be communicated to all tenderers and amendment/agenda to this invitation of the tenders. 1.11 Any action on the part of the tenderer to revise the prices /or to change the structure of price/prices at his own instance after the opening of tenders may result in rejection of the tender and/also debarring him from submission of the tenders to the Corporation at least for one year and/or forfeiture of amount of earnest money. 1.12 Any approach etc. officially or otherwise on the part of the tenderer or his representative shall render his tender liable to be summarily rejected. 1.13 The tender documents once submitted will not be returned back. 1.14 The prices of tender specification will not be refunded under any circumstances what-so-ever. 1.15 Tender proforma should be filled completely by the tenderers in accordance with the instruction contained herein otherwise their tender may be ignored. 1.16 The works will be governed by the General Conditions of the Contract Form A for execution of work enclosed with the specification and the stipulation made in instructions to tenderers. 1.17 Tenderer must be registered under U.P. Vanijyakar /Central Sales Tax department and they must specify such registration nos. 1.18 Photocopy of PAN NUMBER should be enclosed by the tender. 1.19 Conditional offers shall not be entertained in any case. 1.20 Completion period to be quoted from the date of acceptance should be mentioned clearly. 1.21 Preference shall be given to experience firms/contractors/ in the finalization of the tender. -3-1.22 Such firms/contractors who have no experience in execution of works of similar nature of job may not be considered. 1.23 If the schedule date of tender opening is holiday due to any reason the tenders shall be received and opened on next working days at the same time and place. 2. GENERAL CONDITIONS (i) In no case, payment shall be made by letter of credit. (ii) In case of ambiguous or self contradictory terms/conditions mentioned in the tender, interpretation on any disadvantageous to the tenderer shall be taken without any reference to the tenderer. (iii) In case, tenderers offer any deviation from these special conditions the same should be clearly brought out in tender bid part-i in the prescribed proforma enclosed. However, the purchaser reserves the right whether to accept the deviations or not. (iv) Any over-writing/cutting in the tender should be duly signed and stamped. (v) (vi) (vii) The purchaser shall have the right to award full or part of the work to any of the successful tenderer without assigning any reason thereof. At the time of tender opening, any authorized representative of the tenderer present to attend the same may be asked by this office to produce the certificate of authority from the tenderer, failing which this office reserves the right not to allow him to attend the tender Opening The rates should be quoted in the form of schedule of quantities and prices of tender documents. SPECIAL CONDITIONS AGAINST TENDER NO.-118-ETC(V)/2014-2015 1. PRICES : The tenderer should quote FIRM PRICES for the entire period of agreement. 2. PAYMENT:- 90% payment shall be made to the contractor by Executive Engineer, Electricity Transmission Division-II, Varanasi, against duly pre-receipted bill in duplicate after successful completion of the work in satisfactory condition and certificate having been issued by JE/AE that work has been satisfactorily completed as per specifications. Balance 10% will be kept as performance guarantee and shall be released after 6 months from the date of satisfactory completion of work. Alternatively, if 10% performance guarantee for valid period is deposited by the contractor for full value of work, 100% payment as running payment shall be released. All payment shall be made through account payee cheques only, drawn on the banker of the concerned division. Proper receipt of the cheques must be given in the office before the cheque is delivered to the contractor. 3. COMPLETION PERIOD:- The work shall be completed by the contractor within stipulated time as per agreement subject to the availability of shutdown/material. If the execution of certain part of work is delayed on account of non-availability of shutdown/material to contractor by the department that delay shall not be treated as delay on part of contractor. 4. DELAY IN COMPLETION OF WORK:- If the contractor fails to execute the work within above stipulated time, the penalty @ ½ % per week subject to the maximum 10% shall be deducted on the value of incomplete work. If the contractor fails to execute the work after expiry of time as given in the notice served to contractor, the engineer shall get the work executed from other agency and the excess expenditure so incurred in completion of balance work shall be recovered from the contractor s pending bill against the agreement or any where else. 5. SUPERVISION OF WORK:- The work shall be carried-out under the supervision of Executive Engineer, Electricity Transmission Division-II, Varanasi. 6. VALIDITY:- The quoted rates should be valid for 120 days from the date of opening of tender 7. SECURITY:- 1% amount of contract value, shall be deposited by the contractor as security in shape of FDR/CDR. The security shall be released after successful completion of work. 8. Variation:- The quantity may vary + 10% on either side. 9. TOOLS AND PLANT:- All skilled/unskilled labour, T&P required for the completion of work shall be arranged by the contractor at his own cost, risk and responsibility. 10. SAFETY AND WORKMANSHIP:- The contractor shall be fully responsible for completion of works as mentioned in the schedule of price and quantity for which all the required,skilled and unskilled labour,including Tools and Plant shall be arranged by the contractor at his own cost. During the execution of above work if any accident to men and material takes place the contractor shall be responsible for the same. Any loss occurred to UPPTCL during the execution of work, the cost of the same shall be recovered from the contractor. If any loss or theft of contractor s men and property occurs during the execution of the work, contractor shall be fully responsible for the same 11. MINOR WORKS FOR COMPLETION OF WORK :- The contractor shall do the minor works which have either not been specifically mentioned in this specification or in the tender submitted and which are essential to complete the work satisfactorily as per technical specification. No extra payment shall be made on account of this. The nature of minor work shall be decided by the Supervisory Engineer. Contd 2
-2-12. SUBSTANDARD WORK:- Any work or part thereof not being found as per technical specification shall not be accepted. The contractor shall have to do the defective part of work again at his own cost. 13. THEFT & LOSSES:- In case of any theft and losses, of material duly handed over to the contractor he shall be fully responsible for the same. Necessary FIR shall be lodged by him with the concerning Police Station. And in case of losses so incurred, not having been recovered by Police, the recovery of same shall be made from the contractor s pending bill and in case the recovery being found in excess of all claims of the contractor arising out the same shall be recovered from bills of other contract in the Dn. Or from other Dn. of UPPTCL 14. RECORDING MEASUREMENT:- As soon as any work is completed, its measurement shall be recorded in the MB by JE immediately without waiting for bills to be raised by the contractor. AE will also ensure that JE records all measurement timely and if he does not do so, he will take all actions as deemed fit under intimation to higher officers. In case of any dispute in measurement and the contractor not agreeing with it, he will immediately bring the matter to the notice of AE or the Engineer giving his reasons for incorrect measurement. 15. VERIFIATION OF BILLS:- After the work has been satisfactorily completed as per specification and measurement recorded in the MB, the bill duly verified by JE and AE shall be submitted in division office through a covering letter within 7 days or earlier from the submission of bills. Any delay beyond shall have to be justified by JE & AE in the covering letter. There should not be any substantial gap between the date of verification of bills in MB and its submission in the office of EE 16. INCOME TAX:- The Corporation shall deduct Income tax as legally applicable from every bill of the contractor as Income tax for remittance of the same to Income tax office as laid down in Income Tax Law. The contractor shall contact Income Tax authorities for refund if any on this account. 17. Service Tax :- Service tax as legally applicable shall be payable extra on the part/cost of service only against legal documentary evidences. 18. Work Contract Tax :- The Corporation shall deduct Work Contract Tax as legally applicable from every bill of the contractor. 19. LEGAL DISPUTE :- Any dispute arising out of the contract shall be under the jurisdiction of local courts Varanasi and Hon ble High Court, Allahabad. 20. Experience The tenderer must have experience of execution of similar nature of work in UPPTCL/Govt. organization or any other Semi Govt. Organisation for which attested copies of such orders/agreements should be attached with the offer. 21. The undersigned reserves the right to accept / reject any/ all tenders without assigning any reason thereof. 22 The contractor shall comply with all labour laws as applicable at site of work. 23.
