RESOLUTION NO. A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK ORDERING THE CONDITIONAL VACATION OF A PORTION OF THE ALLEY ADJACENT TO 128-134, 140, 144 AND 150 SOUTH GLENOAKS BOULEVARD (V-402, Applicant: Cabrini Club, Inc., a California Corporation) and (V-362, Applicant: Richard Raad/Rare Enterprises LLC, a Limited Liability Company). THE COUNCIL OF THE CITY OF BURBANK FINDS: A. Pursuant to the Public Streets, Highways and Service Easements Vacation Law contained in Division 9, Part 3 of the California Streets and Highways Code, the Council of the City of Burbank on June 5, 2012, passed and adopted its Resolution No. 28,532 entitled " A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK DECLARING ITS INTENTION TO CONSIDER THE CONDITIONAL VACATION OF A PORTION OF A PUBLIC ALLEY ADJACENT TO 128-134 SOUTH GLENOAKS BOULEVARD (V-402) which said Resolution was duly published as required by law. The conditional vacation is identified as a portion of the alley adjacent to the street address 128-134 South Glenoaks Boulevard. B. Pursuant to the Public Streets, Highways and Service Easements Vacation Law contained in Division 9, Part 3 of the California Streets and Highways Code, the Council of the City of Burbank on June 5, 2012, passed and adopted its Resolution No. 28,533 entitled " A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK DECLARING ITS INTENTION TO CONSIDER THE CONDITIONAL VACATION OF A PORTION OF A PUBLIC ALLEY ADJACENT TO 140, 144 AND 150 SOUTH GLENOAKS BOULEVARD (V-362) which said Resolution was duly published as required by law. The conditional vacation is identified as a portion of the alley adjacent to the street address 140, 144 and 150 South Glenoaks Boulevard. C. Pursuant to the aforementioned resolutions, the Community Development Director gave and posted notices of said vacation in conformity with and in the manner provided by law. D. The two applicants desired to consolidate the hearing. THE COUNCIL OF THE CITY OF BURBANK RESOLVES: 1. The Council of the City of Burbank finds from all of the evidence submitted that the portion of the alley adjacent to the street address 128-134 South Glenoaks Boulevard, which is referred to as V-402, and more particularly shown and described in Exhibit A attached hereto, and by this reference made a part hereof, is unnecessary for present or prospective public alley purposes, and orders said portions of the alley vacated subject to the fulfillment of the conditions listed in Exhibit C, and subject to the reservation of certain easements identified in Exhibit C, which exhibit is attached hereto and incorporated by this reference. 2. The Council of the City of Burbank finds from all of the evidence submitted that the portion of the alley adjacent to the street address 140, 144 and 150 South Glenoaks Boulevard, which is referred to as V-362, and more particularly shown and described in Exhibit B attached hereto, and by this reference made a part hereof, is unnecessary for present or prospective public alley purposes, and orders said portions of the alley vacated subject to the fulfillment of the conditions listed in Exhibit C, and subject to the reservation of certain easements identified in Exhibit C, which exhibit is attached to and incorporated herein. 3. This Resolution shall be effective and recorded when the conditions set forth in Exhibit C of this Resolution have been satisfactorily completed. The Public Works Director is authorized to execute, on behalf of the City, all documents required in Exhibit C, and is authorized to approve and attach any legal descriptions that describe the easements reserved herein. 4. The City Clerk of this City is hereby authorized and directed to certify to the passage of this Resolution and to cause a certified copy thereof, attested by the City Clerk and under the seal of this City, to be recorded in the Office of the County Recorder of Los Angeles County, California, once the conditions have been satisfactorily completed and the Community Development Director sends a memorandum to the City Clerk stating that the conditions have been satisfactorily completed. From and after the date of recordation, the alley vacated herein will no longer be a public alley. 5. In the event the conditions set forth on Exhibit C of this Resolution have not been completed within two years after the adoption date of this Resolution, this Resolution shall be automatically terminated; however, this time period may be extended by the Public Works Director. 6. The proposed vacation has been determined to be exempt from the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines k:\reso\2012\mfr\v-402 and V-362 ordering con vac 06-26-12 Page 2

Sections 15301, pertaining to existing facilitates involving negligible or non-expansion of use, and the proposed vacation is consistent with the General Plan. PASSED AND ADOPTED this day of, 2012.
