The City s 10% local match for this grant is $466,932.00. This is part of a multi-year grant totaling $4,881,196.00. 2. 2014-R-89 Ordering and proclaiming a Special Recall City Election for District VII to be held on Tuesday, November 4, 2014; designating polling places; providing for publication; and authorizing the City Manager to enter into a contract with Webb County Elections Administrator for the purpose of conducting a joint election with Webb County, United Independent School District (UISD), Laredo Independent School District (LISD) and Laredo Community College (LCC). (Action needed on item No. 4, prior to action on this Resolution) 3. 2014-R-90 Resolution directing publication of notice of intention to issue City of Laredo, Texas Combination, Texas Combination and Revenue Certificates of Obligation, in one or more series, in the maximum principal amount of $8,500,000.00, for the purpose of (1) constructing, improving and repairing city streets and sidewalks, together with drainage, traffic and street signalization and lighting improvements; (2) acquisition of municipal equipment and municipal vehicles for various departments, to wit: City Administration, Health and Welfare Departments, Engineering Department, Parks and Recreation Department, Public Safety Departments, and Public Works Departments; (3) acquiring, constructing and improving municipal parks, including constructing related drainage improvements and for the payment of legal, fiscal, and engineering fees in connection with such projects. The City s 10% local match for this grant is $466,932.00. This is part of a multi-year grant totaling $4,881,196.00. The Airport Operations will be advancing $678,815.00 to the Airport Construction Fund and also authorizing the City Manager to appropriate said funds. PREVIOUS COUNCIL ACTION Resolution 2014-R-038 approved on 4/21/2014 BACKGROUND The City of Laredo International Airport received a grant offer from the Federal Aviation Administration in the amount of $4,202,381.00 for airport development improvements which include the Rehabilitation of the General Aviation Apron (Phase 8), improvements to the Terminal Apron and the acquisition of a vacuum sweeper. The required local match in the amount of $466,932.00 is available in the Airport Construction Fund. This project is part of a multi-year grant. The total United States share of the project is $4,881,196.00 of which $4,202,381.00 were awarded during FY2014 and $678,815.00 is to be awarded in FY2015. The proposed project will enable the airport to use this area as an active aircraft parking area for the cargo aircraft fleet currently utilizing the airport. The structural capacity of the existing pavement section is inadequate for the current aircraft fleet mix. The average Pavement Condition Index (PCI) for this area is 36.5, which corresponds to a Very Poor rating. Foreign Object Debris (FOD) is a problem in this area, in large part due to the pavement condition and poses a safety concern. The Terminal Apron will be rehabilitated. Spalls and cracks will be repaired and failed panels will be replaced. A regenerative air sweeper will be purchased to clean airfield pavement and reduce FOD. A rubble pile, identified as a hazard in the Wildlife Hazard Management Plan, will be removed. COMMITTEE RECOMMENDATION

On July 08, 2014, the Airport Advisory Board recommended approval. STAFF RECOMMENDATION Approve this ordinance. PUBLIC HEARING AND INTRODUCTORY ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT AND APPROPRIATE THE FEDERAL AVIATION ADMINISTRATION (FAA) GRANT NO. 3-48-0136-77-2014 IN THE AMOUNT OF $4,202,381.00 AND AMENDING THE CITY OF LAREDO FY2014 AIRPORT CONSTRUCTION BUDGET FOR THE PURPOSE OF AIRPORT IMPROVEMENTS. THE CITY S 10% LOCAL MATCH FOR THIS GRANT IS $466,932.00. THIS IS PART OF A MULTI-YEAR GRANT TOTALING $4,881,196.00. THE AIRPORT OPERATIONS WILL BE ADVANCING $678,815.00 TO THE AIRPORT CONSTRUCTION FUND AND ALSO AUTHORIZING THE CITY MANAGER TO APPROPRIATE SAID FUNDS WHEREAS, the City of Laredo approves and appropriates revenues from a grant received from the Federal Aviation Administration Airport Improvement Program in the amount of $4,202,381.00 for the Laredo International Airport Construction Budget; and WHEREAS, said transfer will fund future grant funds and the local match towards Federal Aviation Administration FAA Grant(s) to initiate project work to Rehabilitate General Aviation Apron (Phase 8), Rehabilitate Airport Terminal Apron Design and Construction, rubble pile removal, and acquire vacuum sweeper; and WHEREAS, the Airport Manager recommends that the City Council approve the proposed budget amendment to the City of Laredo FY 2014 Airport Construction Budget to recognize the additional revenues and to appropriate like expenditures; and WHEREAS, the Airport Advisory Board finds that amending the budget is in the best interest of the City of Laredo; and WHEREAS, the City Council of the City of Laredo is of the same opinion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT: Section 1: The City Manager be and is hereby authorized to amend City of Laredo FY 2014 Airport Construction Budget to appropriate revenues from a grant received from the Federal Aviation Administration Airport Improvement Program being Grant Project No. 3-48-0136-77- 2014 in the amount $4,202,381.00 and a transfer from Airport Operations. Said transfer will fund future grant funds and the local match towards Federal Aviation Administration FAA Grant(s) to initiate project work to Rehabilitate General Aviation Apron (Phase 8), Rehabilitate Airport Terminal Apron Design and Construction, rubble pile removal, and acquire vacuum sweeper and authorizing the City Manager to implement said budget amendment. (Action needed on item No. 4, prior to action on this Resolution) PREVIOUS COUNCIL ACTION None BACKGROUND City Charter Article XI Section 11.01 Recall Provisions Any elected official may be removed from office by recall. A petition stating the specific grounds on which removal is sought shall be signed by the registered voters equal in number to ten (10%) percent of the votes cast in the City or District election to which the elected official was elected to office and shall be filed with the City Secretary by any registered voter who is eligible to vote in the proposed recall election. The recall petition shall have a time limit of six (6) months from the earliest date of any signature on the petition to the date of its filing with the City Secretary. Section 11.03 Filing, Examination, and Certification of Recall Petition All petition papers comprising a recall petition shall be assembled and filed with the City Secretary as one instrument. Within twenty (20) days after filing, the City Secretary shall determine whether each paper of the recall petition is properly attested and whether the petition is signed by the requisite number of registered voters. Upon completing the examination, the City Secretary shall certify the results to the Council. If the recall petition is deemed to lack the required number of verified registered voters, the City Secretary shall set forth in detail the particulars in which it is defective; provided, however that except as to the particulars certified to be defective, the petition shall be deemed to be valid in all other respects. Section 11.05 Recall Election Ordered If a recall petition, is certified by the City Secretary to be sufficient, he shall at once submit it to the Council and notify the person whose removal is sought of such action. The Council shall order a recall election which shall be held at the next allowable election date under the Texas Election Code but, in no event, less than thirty (30) days after the petition has been certified. Resignation prior to the recall election shall cancel the election. COMMITTEE RECOMMENDATION

RESOLUTION 2014-R-89 ORDERING AND PROCLAIMING A SPECIAL RECALL CITY ELECTION FOR DISTRICT VII TO BE HELD ON TUESDAY, NOVEMBER 4, 2014 ; DESIGNATING POLLING PLACES; PROVIDING FOR PUBLICATION; AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH WEBB COUNTY ELECTIONS ADMINISTRATOR FOR THE PURPOSE OF CONDUCTING A JOINT ELECTION WITH WEBB COUNTY, UNITED INDEPENDENT SCHOOL DISTRICT (UISD), LAREDO INDEPENDENT SCHOOL DISTRICT (LISD) AND LAREDO COMMUNITY COLLEGE (LCC). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAREDO: Section 1: That a special recall election be and the same is hereby ordered to be held and conducted within and for the City of Laredo on Tuesday, the 4th day of November, 2014, for the purpose of submitting to the voters of District 7 the following: Shall Jorge A. Vera be removed from the office of City Council Member District 7 by recall? Section 2: That the mode and manner of holding and conducting said election shall be in accordance with the Texas Election Code and the City Charter of the City of Laredo, and that only resident qualified voters of District 7 shall be eligible to vote at said election. Section 3: That the polls at each designated polling place, as set forth in "Exhibit A" which is attached hereto and made a part of this resolution for all purposes, on said special recall election day shall be open from 7:00 o'clock A.M. to 7:00 o'clock P.M. Section 4: That the Presiding Judges shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. Section 5: That the period for early voting by personal appearance shall begin on October 20, 2014 and shall continue through the fourth day preceding the date of the election, October 31, 2014. The main polling place for early voting shall be the County Justice Center, located at 1100 Washington St., Laredo, Texas and such other early voting and mobile voting places and dates as set forth in "Exhibit A" attached hereto. The main early voting polling place shall remain open from 8:00 o'clock A.M. to 5:00 o'clock P.M. on each day designated for early voting, except for Saturday, October 25 th and Monday, October 27 th through Friday, October 31st when the main early voting polling place shall be open from 8:00 a.m. through 8:00 p.m and Sunday, October 26 th when the place shall be open from 1:00 p.m. through 6:00 p.m. The designated polling places shall not be open on Saturdays, Sundays or official holidays, except as otherwise provided for in schedule of "Exhibit F." Section 6: That the Early Voting Clerk for said election shall be appointed by the Webb County Elections Administrator. Section 7: Application for ballots by mail shall be conducted by The Webb County Elections Administrator. All ballot applications and ballots voted by mail shall be sent to the Webb County Election Administrator, 1110 Washington, Suite 103, P.O. Box 29, Laredo, Texas 78042-029. Section 8: That notice of said elections shall be given by posting a substantial copy of this resolution at the City Hall on the bulletin board used for posting notices of the meetings of the City Council. A substantial copy of this resolution also shall be published in a newspaper of general circulation published in said City, the date of publication to be not earlier than the 30th day or later than the 10th day prior to the date set for said election.

Section 9: That said election shall be conducted at each designated voting place and the ballot to be used at such election shall be printed in the form required by the Texas Election Code and manufacturer's specifications with names of candidates printed thereon in full and prepared in such manner as specified by the Texas Election Code. That this election is to be conducted utilizing ivotronic Electronic Units during the election and the AIS 315 Tabulation System Tuesday, November 4, 2014. Section 10: That immediately after the votes at such regular and special recall election have been conducted and proper returns thereof made to the City Council, said City Council shall meet on Thursday, November 13, 2014 at 12:00 Noon at the City Council Chambers, 1st floor, 1110 Houston, to canvass the election and cause to be entered in the proper records of the City of Laredo, Texas, its official declaration of, or order showing the actual and true results of said special election. Certification of Recall Petition Pursuant to Laredo City Charter, Article XI, 11.03, I, Gustavo Guevara, Jr., as City Secretary for the City of Laredo, hereby certify that the recall petition for the removal of District VII Council Member Jorge A. Vera, submitted to my office on August 14, 2014, is sufficient as follows: The petition states the specific grounds on which removal is sought and was submitted with one hundred and seventy three (173) supporting signatures nineteen (19) of which were disqualified leaving one hundred and fifty four (154) supporting signatures of registered voters from District VII which number is greater than ten percent of the votes cast in the district election to which Council Member Jorge Vera was elected to office. The petition was filed in my office by a registered voter who is eligible to vote in the proposed recall election. Council Member Jorge A. Vera has been in office longer than six months and has more than six months left until the end of his elected term. The petition consisted of twenty two (22) separate papers, each of which was supported by an affidavit of the person circulating the petition as required by Laredo City Charter, Article XI, 11.02.v All petition papers comprising the recall petition were filed with my office as one instrument.
