Pursuant to rule 16.01(2) of the Supreme Court (General Civil Procedure) Rules 2005 (Vic): (a) Michael Charles Vicar be appointed as the representative of the Growers in the 2006 Timbercorp Olive Project (ARSN 119 182 179); (b) Pamela Jan Dry be appointed as the representative ofthe Growers in the 2007 Timbercorp Olive Project (ARSN 123 155715); (c) David Butterfield be appointed as the representative of the Growers in the 2008 Timbercorp Olive Project (ARSN 129 307 722). 4. The persons appointed pursuant to paragraph 3 above, be joined as the seventh, eighth, ninth defendants in the proceeding pursuant to rule 9.02 /or rule 9.06(b) of the Supreme Court (General Civil Procedure) Rules 2005 (Vic). 5. The plaintiff is granted leave to file serve an amended originating motion on the defendants on or before 4pm on 26 March 2010: (a) incorporating a declaration as to what, if any, right the Growers represented by the seventh, eighth, ninth defendants have to the sale proceeds held on trust by the first defendant pursuant to paragraph 8 of the Orders; (b) amending paragraph 5 of the Originating Motion to read ita declaration as to how the sale proceeds held on trust by the first defendant pursuant to paragraph 8 of the Orders ought to be distributed between the plaintiff the second, seventh, eighth ninth defendants.
