ORDINANCE(S) 5486-2017 AN ORDINANCE AMENDING ORDINANCE NUMBER 5427-2017 OF THE CITY OF NORTH RIDGEVILLE, OHIO, PROVIDING APPROPRIATIONS FOR THE PERIOD COMMENCING JANUARY 1, 2017 AND ENDING DECEMBER 31, 2017 AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to amend the appropriations for certain funds and appropriate other amounts for the operations of the City of North Ridgeville, Ohio. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH RIDGEVILLE, LORAIN COUNTY, OHIO: SECTION 1. That to provide for current and other expenditures for the City of North Ridgeville, Ohio for the period commencing January 1, 2017 and ending December 31, 2017, Ordinance No. 5427-2017 be and the same are hereby supplemented in the following amounts so that from and after the effective date of the Ordinance, the appropriation Ordinance shall include the following, being adjusted for the similar terms in the preceding appropriation Ordinance. SECTION 2. That there be appropriated from the respective funds listed below, the total sums as follows: Fund Personal Number Fund/Department Services Other Total 433 Lorain Road/I-480 Improvement Fund $0 $504,100 $504,100 SECTION 3. That the Auditor of the City of North Ridgeville is hereby authorized to draw warrants on the Treasury of the City of North Ridgeville for payments on any of the foregoing appropriations, upon receiving proper certification and vouchers therefore, approved by officers authorized by law to approve the same or by an Ordinance or Resolution of Council to make the expenditure and provide that no warrants may be drawn or paid for salaries or wages, except to persons employed by authority of or in

That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were in an open meeting of this Council and that all meetings open to the public in accordance with all legal requirements. SECTION 5. This Ordinance is hereby declared to be an emergency measure, the emergency being the immediate necessity to get the contract approved. Wherefore, this Ordinance shall take effect and be in full force and effect immediately upon its passage and approval by the Mayor. 5487-2017 AN ORDINANCE ESTABLISHING THE LORAIN ROAD I-480 IMPROVEMENT FUND AND DECLARING AN EMERGENCY. WHEREAS, the City of North Ridgeville (the City) entered into an agreement with the Ohio Department of Transportation, whereby improvements are to be made to the intersection of Lorain Road and I-480; and WHEREAS, the City has been awarded a federal grant in the amount of $414,000 through the Ohio Department of Transportation representing ninety percent (90%) of the construction costs; and WHEREAS, pursuant to 5705.09(F), a special fund for each class of revenues derived from a source other than the general property tax, which the law requires to be used for a particular purpose is required. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH SECTION 1. That there is hereby established the Lorain Road I-480 Improvement Fund to account for the grant proceeds and related project expenditures. SECTION 2. That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were in an open meeting of this Council and that all meetings open to the public in accordance with all legal requirements. SECTION 3. This Ordinance is hereby declared to be an emergency measure, the emergency being the immediate necessity to provide proper accounting for grant funds to be in compliance with state law. Wherefore, this Ordinance shall take effect and be in full force and effect immediately upon its passage and approval by the Mayor.

5488-2017 AN ORDINANCE AUTHORIZING THE MAYOR TO ADVERTISE FOR BIDS AND ENTER INTO A CONTRACT, ACCORDING TO LAW AND IN A MANNER PRESCRIBED BY LAW, WITH THE LOWEST AND BEST BIDDER FOR THE CONSTRUCTION, FURNISHING, EQUIPPING AND OTHERWISE IMPROVING THE NEW CENTRAL FIRE STATION AND REAL ESTATE INTERESTS NECESSARY FOR THE SITE, NOT TO EXCEED $7,272,000.00 AND DECLARING AN EMERGENCY. WHEREAS, at the November 3, 2015 General Election, the electorate passed a levy to fund the construction of a new fire station that will be located at 7000 Ranger Way as a replacement for the antiquated Fire Station #1 that is currently located at 7090 Avon Belden Road; and WHEREAS, on the question of issuing bonds and notes in the aggregate principal amount of $8,200,000 ($6.7 million for bonds, $1.5 million for notes), the citizens of North Ridgeville passed the issue for the purpose of constructing, furnishing, equipping and otherwise improving a new central fire station and acquiring, preparing, equipping and otherwise improving real estate and interests therein for its site and of levying taxes outside the ten-mill limitation to pay the debt charges on those bonds and any anticipatory securities. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH SECTION 1. The Mayor of the City of North Ridgeville, Ohio, is hereby authorized to advertise for bids pursuant to the Charter of the City of North Ridgeville and enter into a contract, according to law and in a manner prescribed by law, with the lowest and best bidder for the construction, furnishing, equipping and otherwise improving of the new central fire station and real estate and interests necessary for the site, not to exceed $7,272,000.00. The City reserves the right to reject any and all bids as is deemed appropriate to serve the best interest of the municipality as owner and operator of the fire station facility. SECTION 2. The cost of the new central fire station project shall be paid from the appropriate City fund. SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were conducted in an open meeting of this Council, and that all meetings open to the public in accordance with all legal requirements, including 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure, the emergency being the immediate necessity to go to bid within thirty days. Wherefore, this Ordinance shall take effect and be in full force and effect immediately upon its passage and approval by the Mayor.

RESOLUTION(S) 1412-2017 A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR AND DECLARING AN EMERGENCY. (Revised Code 5705.34-35) The Council of the City of North Ridgeville, Lorain County, Ohio met in regular session on Monday, October 16, 2017 at the office of the North Ridgeville City Council with the following members present: Ward 1 Council member Gregg A. Westover Ward 2 Council member Dennis J. Boose Ward 3 Council member Bruce F. Abens Ward 4 Council member Bob Chapek Council member At-Large/President Kevin Corcoran Council member At-Large Roseanne Johnson Council member At-Large/President Pro-Tem Bernadine Butkowski WHEREAS, this Council, in accordance with the provisions of law, previously adopted a tax budget for the next succeeding calendar year commencing January 1, 2018; and WHEREAS, the Budget Commission of Lorain County, Ohio has certified its action thereon to this Council together with an estimate by the County Auditor of the rate of each tax necessary to be levied by this Council and what part thereof is without, and what part within, the ten mill tax limitation. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH SECTION 1. The Council of the City of North Ridgeville, Lorain County, Ohio, hereby accepts at the amounts and rates as determined by the Budget Commission in its certification; and SECTION 2. That there be and is hereby levied on the tax duplicate of said City the rate of each tax necessary to be levied within and without the ten mill limitation as follows in Exhibit A attached hereto and incorporated herein as reference; and SECTION 3. That the Clerk of this Council be and hereby is directed to certify a copy of this Resolution to the County Auditor of said county.

SECTION 6. This Resolution is hereby declared to be an emergency measure, the emergency being the immediate necessity to meet the County Auditor s deadline. Wherefore, this Resolution shall take effect and be in full force and effect immediately upon its passage and approval by the Mayor. 1413-2017 A RESOLUTION TO APPROVE THE EXPENDITURE OF FUNDS TO MCMAHON DEGULIS, LLP FOR LEGAL SERVICES RENDERED IN CONNECTION WITH THE STORMWATER AND CLEAN WATER ACT ISSUES. WHEREAS, O.R.C. 5705.41 provides that City Council may authorize the payment of amounts due, wherein legislation shall be passed within thirty days from receipt of a certificate of the fiscal officer in accordance with O.R.C. 5705.41(D)(1); and WHEREAS, the fiscal officer does certify that the expenditure was and is properly appropriated and otherwise lawful, sufficient funds were and are available or in the process of collection to the credit of the proper fund, and the funds were and are free from any previous encumbrance; and WHEREAS, McMahon DeGulis, LLP is currently providing legal services to the City in connection with the Stormwater and Clean Water Act issues and serves a necessary public purpose; and

1413-2017 Continued WHEREAS, Invoice no. 70978 for legal services rendered in August of this year by McMahon DeGulis, LLP has exceeded the City Fiscal Officer s certification of available funds by $2,550.00 and there is the expectation that other invoice(s) will be forthcoming. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH SECTION 1. Council hereby authorizes payment(s) to McMahon DeGulis, LLP for legal services provided to the City in connection with the Stormwater and Clean Water Act issues which has exceeded the Auditor s certification thru August 31, 2017. SECTION 2. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Resolution were conducted in an open meeting of this Council, and that all meetings open to the public in accordance with all legal requirements, including 121.22 of the Ohio Revised Code. SECTION 3. This Resolution shall take effect and be in full force from and after the earliest period allowed by law.
