INTRODUCTIONS & PRESENTATIONS DONATE LIFE PROCLAMATION RECEIVED BY VERONICA COSME Veronica Cosme shared her personal story of receiving a kidney transplant from her niece Alyssa J. Galvin, and explained the importance of donating organs to save lives. Mayor Hernandez presented a proclamation to Veronica Cosme, Ambassador of One Legacy/Donate Life organization RECOGNITION OF MARTAND BHAGAVATULA FOUNDER OF KIDS AND SMILES Martand Bhagavatula spoke about how he established the non-profit organization Kids and Smiles. He said that the Kids and Smiles organization works with local children s PAGE 4
hospitals and delivers toys, books or other entertainment to children during long hospital stays. Mayor Hernandez presented Martand Bhagavatula with a certificate of recognition for hosting the Kids and Smiles Second Annual Easter Egg hunt to benefit local children s hospitals. UPDATE OF LAW ENFORCEMENT SERVICES GIVEN BY CHIEF OF POLICE SERVICES, LT. LANE LAGARET Chief of Police Services Lt. Lane Lagaret provided a PowerPoint presentation and gave an update of law enforcement services for the month of March. YORBA LINDA CHAMBER OF COMMERCE QUARTERLY UPDATE GIVEN BY PRESIDENT LYNN MELTON AND PRESIDENT ELECT JIM WITHROW Lynn Melton, Yorba Linda Chamber of Commerce President, gave an overview of past and upcoming Chamber events. Jim Withrow, Yorba Linda Chamber of Commerce President Elect, spoke of the relationship between the Chamber of Commerce and the City, and reported on the expenditures of past Chamber events. METROPOLITAN WATER DISTRICT PRESENTATION GIVEN BY DIRECTOR BRETT R. BARBRE Brett R. Barbre, Metropolitan Water District, spoke about the Average Annual Precipitation for Cities in California and the lack of water reserves in Southern California. He said that Governor Jerry Brown imposed restrictions to achieve a statewide 25% reduction in potable urban water usage to increase water conservation. Mr. Barbre also addressed a water allocation plan and responded to Council questions. YORBA LINDA WATER DISTRICT QUARTERLY UPDATE GIVEN BY BOARD PRESIDENT RIC COLLETT Ric Collett, Yorba Linda Water District Board (YLWD) President, gave an update of the water conservation challenges that the City will assume during the drought. He said that the City and the community will need to heavily reduce irrigation, especially if the YLWD implements a 36% cutback of water usage. ADMINISTRATIVE REPORT ITEM NO. 11 WAS TAKEN AT THIS TIME BUT PRESENTED IN ITS RESPECTIVE PLACE ON THE AGENDA PAGE 5
RECESS: Mayor Hernandez called a recess at 8:06 p.m. and reconvened the meeting at 8:13 p.m. PUBLIC COMMENTS Eddy Jackson, resident, provided Council with a handout and gave a PowerPoint presentation on landscape maintenance service reductions. He addressed five key reasons to reduce landscape maintenance and recommended that Council implement staff recommendations from the July 6, 2010 City Council meeting. Mark Stowell, resident, asked that Council review the history of the LMAD long term renovation plans, and urged Council to undertake a systematic approach to water conservation. Pat Nelson, resident, inquired about who to contact in the City to report horse trail fencing repairs. Peter Meng, resident, provided a PowerPoint presentation on forest fires and heavily landscaped areas, and said that the City s landscaping requirements are not up to code. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA The City Council/Successor Agency to the Yorba Linda Redevelopment Agency waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. APPROVAL OF THE MINUTES OF THE MARCH 31, 2015 CITY COUNCIL SPECIAL JOINT WORKSHOP WITH THE PLANNING, PARKS & RECREATION, TRAFFIC AND LIBRARY COMMISSIONS AND GENERAL PLAN AND LANDSCAPE MAINTENANCE CITIZEN ADVISORY COMMITTEES The City Council approved the minutes of the March 31, 2015 City Council Special Joint Workshop with the Planning, Parks & Recreation, Traffic and Library Commissions and General Plan Advisory and Landscape Maintenance Citizen Advisory Committees. 4. APPROVAL OF THE MINUTES OF THE APRIL 7, 2015 CITY COUNCIL/SUCCESSOR AGENCY TO THE YORBA LINDA REDEVELOPMENT AGENCY MEETING The City Council/Successor Agency to the Yorba Linda Redevelopment Agency approved the minutes of the April 7, 2015 City Council/Successor Agency to the Yorba Linda Redevelopment Agency joint meeting. 5. TREASURER'S REPORT - JANUARY 2015 The City Council received and filed this report. 6. ADOPTION OF ORDINANCE NO. 2015-1013 AND CLERICAL CORRECTION TO THE SOLID WASTE AGREEMENT The City Council adopted Ordinance No. 2015-1013, repealing and replacing Sections 8.20.010 through 8.20.310 of Articles 1 and 2 of Chapter 20 of Title 8, and amending Chapter 20 of Title 8 Section 8.20.520 of the Yorba Linda Municipal Code related to the collection of solid waste; and approved the clerical correction to the Solid Waste Agreement. 7. RENEWAL OF TRAUMA INTERVENTION PROGRAMS, INC. AGREEMENT FOR FISCAL YEAR 2015/2016 The City Council approved and authorized the Mayor to sign the one-year agreement with Trauma Intervention Programs, Inc. (TIP) for the period of July 1, 2015 through June 30, 2016. 8. APPROVAL OF CHANGE ORDER NO. 4 TO STANTEC CONSULTING SERVICES, INC. FOR PHASE TWO REMEDIATION SERVICES AT THE NORTHEAST CORNER OF IMPERIAL HIGHWAY AND LEMON DRIVE - FORMER ULTRAMAR GAS STATION SITE The City Council approved and authorized the Mayor to execute Change Order No. 4 for renewal of contract to Stantec Consulting Services, Inc. in the amount PAGE 7
of $249,630.13 for Phase Two Remediation System Operation and Maintenance at the former Ultramar Gas Station Site. 9. CONTRACT AGREEMENT EXTENSION FOR WEED ABATEMENT SERVICES - RON UBRUN FARMS The City Council approved a one (1) year Contract Extension for Weed Abatement Services between the City and Ron Ubrun Farms for Lighting and Landscape Maintenance Assessment District. End of Consent Calendar CITY MANAGER'S REPORT/MAYOR'S REPORT/MATTERS PRESENTED BY COUNCILMEMBERS/OTHER AGENCY REPORTS Mayor Pro Tem Lindsey thanked the Water District representatives for informing the public about the drought conditions in Southern California. Mayor Pro Tem Lindsey invited the public to assist in a major clean-up project at the Phil Paxton Equestrian Center on Saturday, April 25 th from 8:00 a.m. to 12 p.m. Councilmember Huang thanked the Water Districts for their insight on the drought conditions in Southern California. Councilmember Huang attended the Orange County Mosquito and Vector Control District board meeting and informed the public to be cognizant of free standing water to avoid mosquitoes which carry the West Nile virus. Mayor Hernandez attended an Eagle Scout Court of Honor ceremony for Andrew Hauptman, and the Friends of the Library volunteer luncheon. Mayor Hernandez stated that he had the honor of judging a Spelling Bee for the Placentia/Yorba Linda Unified School District at the El Dorado Cultural Center. He commended the students, parents, and teachers for an outstanding event. ADMINISTRATIVE REPORTS 10. REPORT OF PLANNING COMMISSION ACTIONS FROM THEIR LAST MEETING Principal Planner David Brantley gave a brief overview of the actions taken by the Planning Commission at their April 15, 2015 meeting. 11. EXECUTIVE ORDER B-29-15, MITIGATING THE EFFECTS OF THE STATE DROUGHT - ISSUED BY GOVERNOR BROWN Public Works Director/City Engineer Michael Wolfe gave an overview of the staff report and responded to Council questions. The following residents addressed questions and concerns regarding the statewide drought conditions: Pat Nelson, Eddy Jackson, Lee Day, Rosemarie Sauer, Stewart Rixson, Peter Meng, Ron Berry and Jim Schaffer The water district representatives, Mr. Brett Barbre and Mr. Ric Collette answered a series of questions from Council and the public. It was MOVED/SECONDED YOUNG/LINDSEY to direct staff to return to Council once the State Water Resources Control Board (Water Board) and the Department of Water Resources has developed and approved regulations related to Governor Brown's Executive Order B-29-16 regarding the water use restrictions to mitigate the effects of the California drought. MOTION CARRIED by the following roll call vote: AYES: NOES: ABSENT: Hernandez, Huang, Lindsey, Schwing, Young 12. OPPORTUNITIES FOR PUBLIC INPUT REGARDING THE PROPOSED ESPERANZA HILLS DEVELOPMENT PROJECT Mayor Pro Tem Lindsey left the dais due to a conflict of interest. City Manager Pulone gave a brief overview of the staff report and responded to Council questions. Ron Berry, resident, stated he was opposed to the proposed development in the foothills, especially with the past fires and the statewide drought conditions. Melanie Schlotterbeck, resident, spoke on behalf of the Protect our Homes and Hills organization and asked Council to conduct an informal meeting with them and the public to address their concerns regarding the Esperanza Hills development project. Council discussion ensued. There was Council consensus to direct staff to conduct an off-site, un-televised workshop with the community to receive public input regarding the proposed Esperanza Hills development project. Mayor Pro Tem Lindsey returned to the dais. 13. COIN DISCUSSION CONTINUED - DISCLOSURES OF PRIVATE COMMUNICATIONS - Tabled PAGE 9
OTHER BUSINESS 14. CALIFORNIAFIRST - PROPERTY ASSESSED ENERGY PROGRAM (HERNANDEZ) Jeremy Hutman, CaliforniaFirst Regional PACE Director, provided a background as well as a general overview of the requirements and steps of the program and responded to questions from the Council. Councilmember Schwing asked a series of financial questions and asked Mr. Hutman why CaliforniaFirst needs the City to endorse the PACE program as consumers can receive low cost loans from a bank. Councilmember Young asked Mr. Hutman about the PACE programs interest rates, property taxes, mortgage payments, titles, and equity requirements to participate in the program. He said that he was concerned about the protection of consumers. Council discussion ensued. It was MOVED/SECONDED HERNANDEZ/LINDSEY to direct staff to come back to Council at a future meeting with a resolution to participate in the Property Assessed Energy Program (PACE).
