OFFICIAL PROCEEDINGS KINGSBURY COUNTY BOARD OF COUNTY COMMISSIONERS De Smet, South Dakota February 2, 2016 The Kingsbury County Board of County Commissioners met Tuesday, February 2, 2016 at 8:30 AM in the County Commissioners meeting room in the Courthouse with Commissioners Shelley Nelson, Roger Lee, Joe Jensen, and Delmer Wolkow present. Roger Walls was absent. Chm. Lee presided. APPROVE AGENDA Wolkow moved and Jensen seconded to approve agenda as updated. All APPROVE MINUTES Nelson moved and Wolkow seconded to approve the minutes of the January 19, 2016 meeting as presented. All LAND LEASE Jensen moved and Nelson seconded to advertise the land leases for March 8, 2016, and to change the terms from one year to three years. All OFFICE REPORTS The Register of Deeds and Director of Equalization office reports for the month of January were reviewed by the Board. Wolkow moved and Jensen seconded that the Auditor s report with the Treasurer as of the close of business January 31, 2016 be accepted and placed in the Auditor s office for review. She will work on getting a cost estimate. HIGHWAY Dave Sorenson, Hwy Supt met with the Board to discuss highway matters. Annual bids will be advertised for March 8, 2016. Parking Lot Contract Jensen moves and Wolkow seconded to sign the parking lot contract with Pierce and Harris awarding the bid to Castlerock Construction. All Striping Agreement Nelson moved and Jensen seconded to authorize the Chairman to sign the striping agreement with the State of South Dakota. All present voting aye, PERSONNEL Tammy Anderson, DOE, met with the Board. Wolkow moved and Jensen seconded to adjourn from regular session and move into executive session at 9:15 AM for personnel. All present Nelson moved and Wolkow seconded to adjourn from executive session and move back into regular session at 9:20 AM. All present voting aye, Extra Hours Jensen moved and Wolkow seconded to allow Deputy Auditor, Echo Steffensen, to work two days a week in the DOE office for the month of February. All JUVENILLE DETENSION CONTRACT Nelson moved and Jensen seconded to allow Chairman Lee to sign the juvenile detention contract with Beadle County. All present voting aye, PERSONNEL Elaine Blachford, Treasurer, met with the Board.
Jensen moved and Wolkow seconded to adjourn from regular session and move into executive session at 9:50 AM for personnel. All present Nelson moved and Jensen seconded to adjourn from executive session and move back into regular session at 10:18 AM. All present voting aye, TAX DEED Elaine Blachford, Treasurer, Gregg Gass, State s Attorney, and Robert Jenkins met with the Board to discuss a tax deed property. Wolkow moved and Jensen seconded to adjourn from regular session and move into executive session at 10:20 AM for potential litigation purposes. All Mr. Jenkins left the meeting at 10:27 Nelson moved and Wolkow seconded to adjourn from executive session and move back into regular session at 10:34 AM. All present voting aye, Quit Claim Deed Jensen moved and Wolkow seconded to pass Resolution #2016-02: Given that Trina Parker has redeemed property under a tax deed taken by the county by paying the full amount of taxes, penalty and interest in relation to Lot 12, Block 4, Original Plat to the City of Arlington, Kingsbury County, South Dakota. Jensen moved and Wolkow seconded that the county issue a Quit Claim Deed to Trina Parker and that said deed be issued 20 days after the signing of the Resolution approving said transfer. All BIG DITCH Gregg Gass, State s Attorney, Wayne Soren, Paul Johnson, Scottie Hojer, Gary Lestico, Jason Peterson, and Kerry Bretch met with the Board to discuss the Big Ditch, and the next step needed to move towards cleaning out the Big Ditch. Nelson moved and Wolkow seconded to adjourn from regular session and move into executive session at 11:27 AM for contract negotiation purposes. All present voting aye, Retain Engineering Services Jensen moved and Nelson seconded to pass Resolution #2016-03: That the Kingsbury County Commissioners hire Civil Design, Inc. to do an engineering study at a cost of less than $50,000.00, to be billed by the
hour, to evaluate the flow capacity of the Big Ditch. All present Retain Legal Services Wolkow moved and Jensen seconded to pass Resolution #2016-04: That the Kingsbury County Commissioners retain the services of Gary Lestico, up to $10,000.00, for legal consultation on the Big Ditch. All present Establish Project Nelson moved and Wolkow seconded to pass Resolution #2016-05: That the Kingsbury County Commissioners establish a project to review maintenance and repair procedures of Ditch #4 (The Big Ditch). All present voting aye, EXECUTIVE SESSION Jensen moved and Wolkow seconded to adjourn from regular session and move into executive session at 12:00 PM for consultation with their attorney for legal advice.
