151 The Board of Chosen Freeholders of the County of Warren met in Regular Session in its offices in the Wayne Dumont, Jr. Administration Building, Belvidere, New Jersey on March 11, 2015 at 7:00 p.m. The meeting was called to order by Director Smith and upon roll call, the following members were present: Freeholder Edward Smith, Freeholder Jason Sarnoski and Freeholder Richard Gardner. Also attending were County Engineer William Gleba, CFO Dan Olshefski, County Counsel Joseph J. Bell and County Administrator Steve Marvin. The Pledge of Allegiance was led by Director Smith. PROCLAMATION 141-15 On motion by Mr. Gardner, seconded by Mr. Sarnoski, the following proclamation was AMERICAN RED CROSS MONTH, MARCH 2015 WHEREAS, American Red Cross Month is a special time to recognize and thank our Everyday Heroes those who reach out to help people in need; WHEREAS, American Red Cross heroes help disaster victims recover. They give blood to help a hospital patient. They brighten the day of an injured service member. They step forward to help someone having a heart attack;
152 WHEREAS, we would like to remember our heroes here in Warren County who help people in need. They work tirelessly to assist their neighbors when they need a helping hand; WHEREAS, across the country and around the world, the American Red Cross responded to disasters. When an injured service member ended up in a hospital far from home, the American Red Cross offered comfort. When a hospital patient needed blood, American Red Cross blood donors helped them. When a lifeguard jumped in to save a drowning child or someone stepped up to help a heart attack victim, the American Red Cross was there. WHEREAS, we dedicate the month of March to all those who support the American Red Cross mission to prevent and alleviate human suffering in the face of emergencies. Our community depends on the American Red Cross which relies on donations of time, money and blood to fulfill its humanitarian mission. NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Warren does hereby proclaim the month of March 2015 as AMERICAN RED CROSS MONTH and encourages all Americans to support this organization and its noble humanitarian mission. I hereby certify the above to be a true copy of a proclamation adopted by the Board of Chosen Freeholders of the County of Warren at a meeting held on March Mr. Gardner said this is a very strong organization that dates back to around the 1890 s,helping people that have fallen victim to floods, mudslides, fires no matter what, they re always there, he said. We need to remember that without the assistance of the American Red Cross, many would be without shelter in times of crisis. Mr. Sarnoski said he had the pleasure of working with the American Red Cross two years ago on its Heroes Campaign. He really believes in their mission, noting that when disaster strikes, they are still there helping after the cameras leave. Mr. Sarnoski looked forward to working with the organization in the future as it implements more pre-emptive measures such as fire protection systems, to help avoid certain situations in the first place. Mr. Smith said the proclamation speaks for itself and his colleagues made good points. Having seen a Red Cross vehicle in the parking lot this evening, he briefly wondered if there was a disaster in the area as they are always there on the spot. Mr. Sarnoski welcomed Lori Gill, Regional Care Manager of the American Red Cross to accept the proclamation. Ms. Gill said she was excited and honored to accept this recognition on behalf of the American Red Cross. She said she was very proud of the relationships established with the residents of Warren County and looked forward to building on those relationships. 153 NATIONAL NUTRITION MONTH, MARCH 2015 WHEREAS, the Warren County Community Health Improvement Coalition s (CHIC) initiatives through a ShapingNJ Healthy Community Grant are promoting nutrition and healthy lifestyles to enable residents to gain knowledge and skills to lead healthy lives; and WHEREAS, the Warren County CHIC, through the Healthy Menu Options program at county restaurants, is promoting healthful nutrition choices to assist restaurant owners in highlighting options for customers, who can then consider these options to help them lead healthier lives through improving their diet; and WHEREAS, the Warren County CHIC is promoting physical activity through the installation of bike racks in different locations throughout the county to give residents the opportunity to ride their bikes to their favorite park or trailhead; and WHEREAS, the Warren County CHIC is promoting participation by municipalities in the Mayor s Wellness Campaign, a statewide community health initiative in partnership with the New Jersey State League of Municipalities that gives mayors the tools and strategies to champion health and active living and to improve the overall health of their communities; NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Warren designates March 2015 National Nutrition Month ; encouraging residents to take advantage of the promotions and educational opportunities that the Warren County CHIC is offering families, communities and individuals through the ShapingNJ Healthy Community Grant, as these programs strive to always make the healthy choice the easy choice in Warren County. I hereby certify the above to be a true copy of a proclamation adopted by the Board of Chosen Freeholders of the County of Warren at a meeting held on March Mr. Sarnoski said he was glad to support this. Too often, we tend to lose sight of the importance of good nutrition and indulge in bad habits at home. We should pursue healthy alternatives at home and when dining at restaurants. Our agricultural environment helps facilitate healthy choices in season with the abundance of local produce. Mr. Sarnoski expressed appreciation to Rutgers Cooperative Extension for its efforts in this regard. Mr. Gardner said he thought the proclamation covered the gamut; it s not only about good nutrition, but also physical activity. The younger generations today are heavier than in the past. He said a healthier society is better for everybody in the long run. The proclamation was accepted by Sherri Cirignano, Family and Community Health Sciences Educator/Agent for Rutgers Cooperative Extension of Warren County and Sarah Shoemaker, Public Health Planner. Ms. Shoemaker elaborated on a grant recently awarded to the County that includes the installation of bike racks at various locations and partnering with restaurants for a Healthy Menus Initiative in Hackettstown.
154 Public Comments (Agenda Items Only) Before opening the floor to comments, Mr. Smith said the Board was going to hold off on a vote on Agenda Item E1, a reauthorization to advertise the sale of Warren Haven. The matter was to be discussed in Executive Session. Lisa Smith of Bangor, PA inquired about G1, the rejection of all bids received for the sale of Warren Haven. She asked if there was going to be another auction. Mr. Smith said that is what the Freeholders still had to discuss. Ms. Smith said shouldn t the County have known that the successful bidder was not in compliance prior to the auction held last month? She had been in attendance and noted how many potential bidders had been turned away and not given the opportunity to participate. Mr. Smith said there were certain financial qualifications required to participate. I would have preferred that we would have not had this problem, needless to say, Mr. Smith said. An insufficiency was discovered during the due diligence period. Ms. Smith implored the Board to look deep beyond the surface of the companies bidding. She said she has been to Forest Manor and it s a beautiful building, but she has not heard very nice things about it. If we get this information so can you, said Ms. Smith. Mr. Sarnoski said we set very strict requirements and pledged to stick to those requirements. We are relying on professionals to monitor that process. Tammy Kelson, also of Bangor and a Warren Haven employee, asked why the bid is being rejected. Mr. Smith said there were certain contractual provisions required and not all such qualifications were fully met by the high bidder. Mr. Sarnoski said letters are being sent and a legal process is being followed so he didn t feel comfortable divulging too much more at this point. 156 WHEREAS, the Board of Chosen Freeholders hereby determines that a two percent increase in the budget for said year, amounting to $ 1,092,338 in excess of the increase in final county tax levy otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS, the Board of Chosen Freeholders hereby determines that any amount authorized herein above that is not levied as part of the final budget shall be retained as an exception to final county tax levy in either of the next two succeeding years. NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2015 budget year, the budget of the County of Warren shall, in accordance with this resolution and N.J.S.A. 40A: 4-45.14, be increased by 2.0%, amounting to $ 1,092,338, and that the CY 2015 county budget for the County of Warren be approved and adopted in accordance with this resolution; and, BE IT FURTHER RESOLVED that any amount authorized hereinabove that is not levied as part of the final budget shall be retained as an exception to the final county tax levy in either of the next two succeeding years; and, BE IT FURTHER RESOLVED that a certified copy of this resolution as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER RESOLVED that a certified copy of this resolution upon adoption, with the recorded vote included there on, be filed with said Director within 5 days after such adoption. Freeholders of the County of Warren at a meeting held on March RESOLUTION 145-15 On motion by Mr. Sarnoski, seconded by Mr. Gardner, the following resolution was RESOLUTION ADOPTING TAX LEVY CAP TO BE APPLIED TO THE 2015 COUNTY BUDGET WHEREAS, the County introduced its 2015 County Budget on March 11, 2015, which is scheduled for adoption by the Warren County Board of Chosen Freeholders on April 8, 2015, and WHEREAS, the County s Budget has to be reviewed and approved by the Division of Local Government Services within the New Jersey Department of Community Affairs; and WHEREAS, the Division has reviewed the County s Budget, has determined that the 1977 and 2010 maximum allowable amount to be raised by taxation is the same and is requiring that the County signify adoption of a tax levy cap by Resolution of its Board of Chosen Freeholders; and
157 WHEREAS, a careful review of the New Jersey Local Budget Law which governs the formulation, approval and adoption of a County Budget, specifically N.J.S.A. 40A:4-45.45a(1) requires that the amount to be raised by taxation in the case of a County shall not exceed the amounts permitted under the 1977 Tax Levy Cap Law; and WHEREAS, based upon a review of the Local Budget Law provisions, the County Counsel and County Chief Financial Officer believe that the law requires the County to adhere to the tax cap levy provisions established pursuant to N.J.S.A. 40A:4-45.4 and 40A:4-45.45; NOW, THEREFORE, BE IT RESOLVED by the Warren County Board of Chosen Freeholders that the County does hereby adopt the 1977 tax levy cap provisions provided for in the aforementioned statutes and that said provisions shall govern the enactment and enforcement of Warren County s 2015 Budget. Freeholders of the County of Warren at a meeting held on March RESOLUTION 146-15 On motion by Mr. Sarnoski, seconded by Mr. Gardner, the following resolution was RESOLUTION APPROVING THE ANNUAL BUDGET AND COUNTY PURPOSE TAX LEVY OF THE COUNTY OF WARREN FOR THE FISCALYEAR 2015 BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren that the following statements of revenues and appropriations herein set forth shall constitute the County Budget for the year 2015; BE IT FURTHER RESOLVED that a summary of said budget shall be published in the Star Ledger in the issue of March 25, 2015. 158 RESOLUTION 147-15 On motion by Mr. Sarnoski, seconded by Mr. Gardner, the following resolution was ORDINANCE 2015-A AN ORDINANCE AUTHORIZING CERTAIN CAPITAL IMPROVEMENTS AND THE APPROPRIATION OF $8,618,780 FROM THE WARREN COUNTY GENERAL CAPITAL FUND BUDGET FOR SUCH PURPOSES BE IT ORDAINED AND ENACTED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OF WARREN, STATE OF NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: Section 1. The capital improvements described in Section 2(A) of this Ordinance are hereby authorized as General Improvements to be made by the County of Warren, New Jersey. There is hereby appropriated the sum of $7,968,780 from the General Capital Improvement Fund, $250,000 from the Open Space, Farmland and Historic Preservation Trust Fund and $400,000 from the General Capital Library Reserve Account for the said improvements or purposes stated in Section 2(A). Section 2(A). The improvements hereby authorized and the proposed appropriations are for the following purposes: (1) Road Resurfacing Improvements $ 996,950 (2) Road and Drainage Improvements $ 1,260,000 Design, construct or reconstruct and improve various county roads and intersections. The maximum amount of money to be appropriated for said purposes is $ 8,618,780, no part of which is to be borrowed. Section 3. The said purpose(s) described in Section 2(A) of this Ordinance are not Current Expenses and can be funded by the issuance of bonds if they were not being permanently funded by capital funds on hand. Section 4. These appropriations are made as a result of the need to improve existing county infrastructure and facilities.
159 Section 5. This Ordinance shall be published, together with a Notice of Introduction thereof and of the Date of Final Passage in the manner provided by law. Freeholders of the County of Warren at a meeting held on March RESOLUTION 148-15 On motion by Mr. Sarnoski seconded by Mr. Gardner, the following resolution was RESOLUTION AUTHORIZING THE TRANSFER OF $905,000.00 FROM THE HEALTHCARE RESERVE TRUST TO THE GENERAL FUND BALANCE (SURPLUS) WHEREAS, employee and retiree medical contributions are deposited into the Health Care Trust and WHEREAS, the State Health Benefits Plan & Prescription Coverage premium for medical is increasing 7.4 percent in 2015. NOW, THEREFORE, BE IT RESOLVED that a fund transfer in the amount of $905,000.00 be made from the Health Care Trust to the General Fund Balance to be utilized to offset the increase. I hereby certify the above to be a true copy of a resolution adopted by the Board of Chosen Freeholders of the County of Warren at a meeting held on March Regarding the Budget, Mr. Sarnoski expressed appreciation to CFO Dan Olshefski and others for helping the Board put together a solid budget it can stand behind. 160 RESOLUTION 149-15 RESOLUTION AUTHORIZING SHARED SERVICES AGREEMENT WITH THE WARREN COUNTY PEQUEST RIVER MUNICIPAL UTILITIES AUTHORITY FOR MOTOR FUELS SERVICES WHEREAS, the Warren County Pequest River Municipal Utilities Authority has a need for motor fuels services, and the County has the ability to make the services of its motor fuels systems available to provide such services in consideration of payment therefore on a reimbursement basis. WHEREAS, the County is authorized, pursuant to N.J.S.A.40:65-1 et.seq. to enter into a shared services agreement with the Warren County Pequest River Municipal Utilities Authority to contract for said services. NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren as follows: The County shall make available to the Warren County Pequest River Municipal Utilities Authority the services of its motor fuels systems, as needed, in accordance with the terms of the Shared Services Agreement attached as Exhibit A hereto. This Resolution shall take effect immediately. Freeholders of the County of Warren at a meeting held on March RESOLUTION 150-15 RESOLUTION TO EXTEND THE GRANT WITH WASHINGTON TOWNSHIP FOR THE CONTINUED FREISE ESTATE/MORRIS CANAL RESTORATION PROJECT FOR THE PERIOD OF TWELVE MONTHS WHEREAS, the Board of Chosen Freeholders of the County of Warren has, by resolution, established the Warren County Open Space Farmland Recreation and Historic Preservation Trust Fund Procedures and Rules, (hereafter Trust Fund Rules ); and WHEREAS, on February 27, 2013, Washington Township entered into a two-year grant agreement with the county for financial assistance on this historic restoration project in the amount of $120,000; and WHEREAS, the Department of Land Preservation, on behalf of the Municipal and Charitable Conservancy Trust Fund Committee, has reviewed and considered a written request for an extension of the grant agreement for the Freise Estate/Morris Canal Restoration Project; and WHEREAS, the county finds that this project has, to-date, made progress warranting an extension pursuant to the Trust Fund Rules and the terms of the existing grant agreement; and
161 WHEREAS, extending the grant of funds for this project is fully in keeping with the intent and purpose of the Trust Fund Rules and grant agreement, which states that an extension of up to 12 months is allowable upon written request; and WHEREAS, adequate funds are available and already encumbered in account 03893-5065 8931203 5065. NOW, THEREFORE BE IT RESOLVED by the Board of Chosen Freeholders of the County of Warren that the grant agreement with the Washington Township for the Freise Estate/Morris Canal Restoration Project restoration project be extended for a period of twelve months, concluding on February 27, 2016. 170 Freeholders of the County of Warren at a meeting held on March RESOLUTION 167-15 RESOLUTION CREATING A FULL-TIME POSITION OF PROSECUTOR S AGENT, UNCLASSIFIED AND ABOLISHING A FULL-TIME POSITION OF DEPUTY CHIEF, UNCLASSIFIED, WITHIN THE WARREN COUNTY PROSECUTOR S OFFICE BE IT RESOLVED by the Warren County Board of Chosen Freeholders that a full-time position of Prosecutor s Agent, unclassified, is created within the Warren County Prosecutor s Office for the efficiency and effectiveness of operations; and BE IT FURTHER RESOLVED by the Warren County Board of Chosen Freeholders that a full-time position of Deputy Chief, unclassified, is hereby abolished. NOW, THEREFORE BE IT RESOLVED that the newly created full-time position of Prosecutor s Agent is created at a salary of $77, 267 and made effective immediately. Freeholders of the County of Warren at a meeting held on March Mr. Sarnoski clarified that the position in the Prosecutor s Office was just a title change; there was to be no change in cost. Reports and Comments County Counsel Joe Bell said he had matters for Executive Session concerning contract negotiations. County Engineer Bill Gleba reported that NJ DOT will be reinstating bridge funding for the current year and the bridge structure pavement on county Route 620 (Belvidere) has been repaired by NJ DOT. There had been significant heaving and bumps. They will be back later in the spring to take care of some of the approach work, but they did a good job fixing the major issue. Mr. Sarnoski asked about pothole repairs. Public Works Director Alex Lazorisak said the County is prepared; major areas will be addressed right away. Neither County Planner Dave Dech nor County CFO Dan Olshefski had reports.
171 County Administrator Steve Marvin had the latest position Vacancy Report for the Board s review and confirmed with them that Boards of School Estimate are scheduled for March 25 Warren County Technical School at 6:00 p.m. followed by Special Services School District at 6:30 p.m. Freeholder Comments Mr. Sarnoski said he planned to go out to municipalities to which he is liaison to discuss the County s Budget introduced this evening. Mr. Gardner had plans to attend an NJAC Meeting the coming Friday. He thought surely Transportation Trust Fund issues would be discussed. Mr. Smith said it has been a very busy couple of weeks. There were no Closing Public Comments or comments from the press.
