Higgins County rezoning and annexation Date: April 11, 2016 In March, the City received notice that the owner of the property at 10 S. Higgins had submitted an application to Cook County to have the property rezoned to an industrial zoning district (I-1). The City Council subsequently adopted a resolution objecting to the County s proposed rezoning, which was filed with the County last month. The City Council also discussed and directed City Staff and the City Attorney to publish and send the required notices to allow the City Council to annex the property to the City at the April 18, 2016 City Council meeting. After the rezoning objection and annexation notices were filed, the owner of 10 S. Higgins approached the City Council to discuss the proposed development of the property and stated that it would agree to defer its rezoning application at the county to allow the owner and City to discuss alternative ways to protect the City s interest in ensuring that the use of 10 S. Higgins would not negatively impact the neighbors or the City. The City Council agreed to defer the annexation decision while the parties discussed various options. These discussions are ongoing. Because all of the annexation notices have already been sent out and published, there may be individuals present at the April 18 th meeting who are interested in the annexation issue. Consequently, the Ordinance annexing 10 S. Higgins will be listed on the April 18th agenda; however, based on the direction from the April 4 th meeting, the Ordinance will not be voted on at the April 18 th meeting. Instead, the City Council will continue the Ordinance to a future meeting. The date of that future meeting must be identified in the motion so individuals who received notice or are otherwise interested in the annexation have notice of the continued meeting. Move to continue the Ordinance Annexing Territory Pursuant to 65 ILCS 5/7-11-13 (10 W. Higgins) to the May 2, 2016 meeting. For purposes of this example, I referenced the May 2 nd meeting. CITY OF PARK RIDGE ORDINANCE NO. 2016- AN ORDINANCE ANNEXING TERRITORY PURSUANT TO 65 ILCS 5/7-11-13 (10 W. Higgins Road) WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, 65 ILCS 5/7-1-13, the City has the authority to annex unincorporated territory containing 60 acres or less that is wholly bounded by one or more municipalities and a forest preserve district; and WHEREAS, the City of Park Ridge desires to annex the territory commonly located at 10 W. Higgins Road in unincorporated Cook County, consisting of approximately 22,440 square feet in area, legally described on Exhibit A attached to this Ordinance, and depicted on the Plat of Annexation attached to this Ordinance as Exhibit B ( Property ); and WHEREAS, the Property contains less than 60 acres, is wholly surrounded by the City of Park Ridge and City of Chicago, is contiguous to the corporate limits of the City of Park Ridge, and is not within the corporate limits of any municipality; and WHEREAS, notice of the Annexation has been published in a newspaper of general circulation within the Property to be annexed in accordance with Section 7-1-13 of the Illinois Municipal Code and delivered to all persons, entities, and officials in accordance with Sections 7-1-1 and 7-1-13 of the Illinois Municipal Code. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Park Ridge, Cook County, Illinois, pursuant to its home rule authority provided under Article VII of the Illinois Constitution of 1970 as follows: SECTION 1: Pursuant to 65 ILCS 5/7-1-13 and all other applicable authority, the Property legally described on Exhibit A is hereby annexed to the City of Park Ridge. SECTION 2: The Plat of Annexation of the Property attached as Exhibit B is hereby approved and found to be an accurate depiction of the annexed Property. SECTION 3: The City Clerk shall be, and is hereby, authorized and directed to record in the Office of the Cook County Recorder of Deeds promptly after the effective date of this Ordinance, a certified copy of this Ordinance, including the Plat of Annexation, and the affidavits of service of notice as required by law. The City Clerk is further authorized and directed to file in the Offices of the Cook County Clerk and Election Authorities a copy of this Ordinance, in accordance with Section 7-1-13 of the Illinois Municipal Code. The City Clerk is further authorized and directed to notify the Election Authorities, as defined in Section 7-1-1 of the Illinois Municipal Code, and the United States Post Office branches serving the Property, of the Annexation by registered or certified mail within 30 days after the effective date of this Ordinance. SECTION 4: The City Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form according to law. SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
