Page 2 I. Opening of the session (Agenda item 1) A. Host Government welcoming ceremonies 1. On Monday, 28 September 2009, a welcoming ceremony organized by the Government of Thailand was held to mark the opening of the ninth session of the Ad Hoc Working Group on Further Commitments for Annex I Parties under the Kyoto Protocol (AWG-KP) and the seventh session of the Ad Hoc Working Group on Long-term Cooperative Action under the Convention (AWG-LCA). 2. Statements were made by Mr. Yvo de Boer, Executive Secretary of the UNFCCC, Ms. Noeleen Heyzer, Executive Secretary of the United Nations Economic and Social Commission for Asia and the Pacific (ESCAP), Mr. Suwit Khunkitti, Minister of Natural Resources and Environment of Thailand, Ms. Connie Hedegaard, Minister of Climate and Energy of Denmark, and Mr. Abhisit Vejjajiva, Prime Minister of Thailand. 3. On Monday, 2 November 2009, a welcoming ceremony organized by the Government of Spain was held to mark the resumption of the ninth session of the AWG-KP and the seventh session of the AWG-LCA. 4. Statements were made by Mr. Yvo de Boer, Ms. Núria Marín i Martínez, Mayor of Hospitalet, Mr. Jordi Hereu i Boher, Mayor of Barcelona, Ms. Connie Hedegaard, Ms. María Teresa Fernández de la Vega, Vice-President of Spain, and Mr. José Montilla i Aguilera, President of the Generalitat of Catalunya. B. Opening and resumption of the session 5. The first part of the ninth session of the AWG-KP was held at the United Nations Conference Centre at UNESCAP in Bangkok, Thailand, from 28 September to 9 October 2009. The session was resumed at the Fira Barcelona Convention Centre in Barcelona, Spain, from 2 to 6 November 2009. 6. The Chair of the AWG-KP, Mr. John Ashe (Antigua and Barbuda), opened the first part of the ninth session on 28 September. He welcomed all Parties and observers, and expressed his appreciation to the Government of Thailand for hosting the first part of the ninth session of the AWG-KP. The Chair encouraged Parties to work hard in order for the AWG-KP to be in a position to forward the results of its work to the fifth session of the Conference of the Parties serving as the meeting of the Parties to the Kyoto Protocol with a view to their adoption. 7. The Chair of the AWG-KP opened the resumed ninth session on 2 November. He welcomed all Parties and observers, and thanked the Government of Spain and the Generalitat of Catalunya for their hospitality. The Chair reminded Parties and observers that the agenda had been adopted at the first part of the session. II. Organizational matters (Agenda item 2) A. Adoption of the agenda (Agenda item 2 (a)) 8. At its 1 st meeting, on 28 September, the AWG-KP considered a note by the Executive Secretary containing the provisional agenda and annotations (FCCC/KP/AWG/2009/11).

Page 3 9. At the same meeting, the agenda was adopted as follows: 1. Opening of the session. 2. Organizational matters: (a) (b) Adoption of the agenda; Organization of the work of the session. 3. Consideration of further commitments for Annex I Parties under the Kyoto Protocol. 4. Other matters. 5. Report on the session. B. Organization of the work of the session (Agenda item 2 (b)) 10. The AWG-KP considered this sub-item at its 1 st, 4 th and 5 th meetings, on 28 September, 2 November and 3 November, respectively. 11. At the 1 st meeting, the Chair drew delegates attention to the scenario note prepared for the first part of the session, contained in document FCCC/KP/AWG/2009/13. At the same meeting, the Chair proposed that issues relating to the future work of the AWG-KP in 2009 be taken up under item 4 of the agenda. The AWG-KP agreed to the proposed organization of work for the first part of the ninth session. 12. Also at the 1 st meeting, statements were made by representatives of 19 Parties, including one speaking on behalf of the Group of 77 and China, one on behalf of the Alliance of Small Island States (AOSIS), one on behalf of the African Group, one on behalf of the Umbrella Group, one on behalf of the least developed countries (LDCs), one on behalf of the European Community and its member States, and one on behalf of the Environmental Integrity Group. 13. At the 4 th meeting, the Chair drew delegates attention to the addendum to the annotations prepared for the resumed ninth session contained in document FCCC/KP/AWG/2009/11/Add.1. The Chair made a proposal to continue with the organization of work as agreed for the first part of the ninth session. 14. At the same meeting, statements were made by representatives of five Parties, including one speaking on behalf of the Group of 77 and China, one on behalf of the European Community and its member States, one on behalf of the African Group, one on behalf of the Umbrella Group and one on behalf of AOSIS. 15. At the 5 th meeting, pursuant to the statement by Gambia on behalf of the African Group referred to in paragraph 14 above, the Chair reported that he had consulted Parties on the organization of work for the resumed ninth session, with the aim of ensuring progress in the work of the group on the scale of emission reductions both aggregate and individual for Annex I Parties. The AWG-KP agreed that the following issues would be considered in Barcelona, with the main focus and time being dedicated to the first issue: (a) (b) (c) The scale of emission reductions by Annex I Parties, both aggregate and individual; Land use, land-use change and forestry; Emissions trading and the project-based mechanisms;

Page 4 (d) (e) Methodological issues; Consideration of information on potential environmental, economic and social consequences, including spillover effects, of tools, policies, measures and methodologies available to Annex I Parties (hereafter referred to as potential consequences). 16. At the same meeting, statements were made by representatives of 10 Parties, including one speaking on behalf of the African Group, one on behalf of the Group of 77 and China and one on behalf of AOSIS. III. Consideration of further commitments for Annex I Parties under the Kyoto Protocol (Agenda item 3) 17. The AWG-KP considered this item at its 1 st, 2 nd, 3 rd, 4 th and 6 th meetings, on 28 September, 2 and 9 October, and 2 and 6 November, respectively. It had before it documents FCCC/KP/AWG/2009/9, FCCC/KP/AWG/2009/10/Rev.1 and Rev.2, 1 FCCC/KP/AWG/2009/10/Add.1/Rev.1, FCCC/KP/AWG/2009/10/Add.2, FCCC/KP/AWG/2009/10/Add.3/Rev.1 and Rev.2, 2 FCCC/KP/AWG/2009/10/Add.4/Rev.1 and Rev.2, 3 FCCC/KP/AWG/2009/12 and Rev.1, 4 and FCCC/KP/AWG/2008/8. 18. At its 1 st meeting, the AWG-KP agreed to establish four contact groups to advance the work at the first part of its ninth session, on: (a) (b) (c) (d) Issues identified in paragraph 49 (a) and (b) of the report of the AWG-KP on its resumed sixth session, 5 to be co-chaired by Mr. Leon Charles (Grenada) and Ms. Gertraud Wollansky (Austria); Other issues identified in paragraph 49 (c) of the report of the AWG-KP on its resumed sixth session, to be chaired by the Vice-Chair of the AWG-KP, Mr. Harald Dovland (Norway); Potential consequences, to be co-chaired by Mr. Mama Konaté (Mali) and Mr. Andrew Ure (Australia); Legal matters, to be convened as needed and co-chaired by Ms. María Andrea Albán Durán (Colombia) and Mr. Gerhard Loibl (Austria). 19. At the 2 nd meeting, the Chair invited the Vice-Chair and the co-chairs to provide an oral report on the status of the work of the four contact groups. This was then summarized by the Chair to enable the AWG-KP to take stock of progress made in the negotiations. 20. At the same meeting, statements were made by representatives of 18 Parties, including one speaking on behalf of the Group of 77 and China, one on behalf of the small island developing states (SIDS), and one on behalf of the European Community and its member States. Page 5 made on behalf of the environmental non-governmental organizations (ENGOs) and the business and industry non-governmental organizations (BINGOs). 21. At the 3 rd meeting, the Chair invited the Vice-Chair and the contact group co-chairs to provide an update on the work of the groups in another oral report. The Chair then summarized the work reported in order to give the AWG-KP an overview of progress made in the negotiations during the first part of the ninth session. 22. At the same meeting, statements were made by representatives of 20 Parties, including one speaking on behalf of the Group of 77 and China, one on behalf of the African Group, one on behalf of the SIDS, one on behalf of the LDCs and one on behalf of the European Community and its member States. Statements were also made on behalf of the ENGOs, BINGOs, the women and gender nongovernmental organizations, and a representative of the youth constituency. 23. At the 4 th meeting, the Chair proposed that the contact groups established during the first part of the ninth session, as outlined in paragraph 18 above, continue their work during the resumed session and that the chair and co-chairs who assisted the contact groups in the first part of the session continue in these functions. 24. At the 6 th, the Chair invited the Vice-Chair and the co-chairs to provide an oral report on the status of the work undertaken by the respective contact groups. IV. Other matters (Agenda item 4) 25. The AWG-KP considered this item at its 1 st, 3 rd, 4 th and 6 th meetings, on 28 September, 9 October, 2 November and 6 November, respectively. 26. At the 1 st meeting, the Chair proposed holding informal consultations with Parties on the working arrangements for the resumed part of the ninth session in Barcelona. 27. These consultations took place, and at the 3 rd meeting the Chair reported that agreement was reached on maintaining the same working arrangements throughout the entire ninth session of the AWG-KP. 28. At the 4 th meeting, the Chair proposed holding further informal consultations with Parties on the work plan of the AWG-KP for the remainder of 2009. 29. At the 6 th meeting, the Chair reported on the outcome of those informal discussions, informing the AWG-KP that agreement was reached to maintain the same working arrangements for its tenth session informing the AWG-KP.

At its 6 th meeting, the AWG-KP considered and adopted the draft report on its ninth session. 6 At the same meeting, on a proposal by the Chair, the AWG-KP authorized the Rapporteur to complete the report on the session, with the assistance of the secretariat and under the guidance of the Chair. VI. Closure of the session 31. At the 6 th meeting, the Chair thanked the Vice-Chair, the Rapporteur and the secretariat for their work. The Chair also thanked delegates for their contributions.
