( Task Force Plaintiffs, by and through their counsel, hereby file their opposed motion for extension of time to file responses to Defendants Motion to Dismiss and Motion for Summary Judgment. Following their successful request for a three-week extension of the deadline for dispositive motions, Defendants State of Texas, et al. ( Texas or State filed their Motion to Dismiss (Dkt. 995 and Motion for 3

Because discovery has not yet ended, Task Force Plaintiffs seek a similar extension of time to file their responses to these motions until June 18, 2014. Task Force Plaintiffs state the following facts in support of this motion: 1. Defendant Texas was granted an extension of the deadline for filing dispositive motions, with the agreement of the remaining parties in this case, from April 23, 2014 to May 14, 2014. 2. Discovery regarding the claims challenged in both of Texas's motions is ongoing pursuant to the schedule established by the Court. Thus far, Task Force Plaintiffs have taken ten depositions and defended seven depositions. The transcripts for a number of these depositions are still being prepared by court reporters. 3. Task Force Plaintiffs and the other parties have scheduled depositions for every business day remaining before the end of discovery on May 30, 2014. Under the current schedule, Task Force Plaintiffs must file their responsive briefs to the dispositive motions on May 28, 2014, two days before the close of discovery. 4. In order to respond fully to Defendant Texas s motions, Task Force Plaintiffs require the transcripts of depositions of witnesses whose testimony relates to the claims challenged in Texas s motions. Many of these transcripts are not yet available. 5. Task Force Plaintiffs request an extension of time to allow them to receive the deposition transcripts related to their claims and to provide relevant evidence in response to Texas's motions to dismiss and for summary judgment. 4
