1. Call to Order. VILLAGE OF WHITEFISH BAY PLAN COMMISSION MINUTES January 15, 2019 6:00pm Whitefish Bay Village Hall 5300 N. Marlborough Dr., Whitefish Bay, WI 53217 President Siegel called the meeting to order at 6:00pm. Present: President Siegel, Commissioners Roth, Huber, Sauer, Serebin and Moore. Also Present: Assistant Manager Tim Blakeslee and Village Manager Paul Boening. 2. Approval of the Minutes of the Regular Meeting of December 17, 2018. Commissioner Sauer moved, seconded by Commissioner Serebin to approve the minutes of the regular meeting of December 17, 2018. Motion Carried, 6-0. 3. PUBLIC HEARINGS a. On Conditional Use Grant Application for the Milan Laser Spa Milwaukee North LLC 304 E. Silver Spring Drive. Assistant Manager Tim Blakeslee summarized the request highlighted the recommended approval conditions as listed in the staff memo. Mr. Matt Chappell was present on behalf of the proposed tenant, and Mr. Kevin Schmoldt was in attendance as representative for the building owner. Discussion followed regarding ownership, surrounding locations and number of employees. Commissioner Serebin asked how the company had decided to locate in Whitefish Bay. Mr. Chappell replied that the decision was based on demographics. In response to a question from Commissioner Sauer, Mr. Chappell confirmed that the business had signed a 5- year lease. There were no public comments. President Siegel closed the Public Hearing at 6:05pm. With the consent of the Commission, President Siegel moved item 4a to next on the agenda. 4. NEW BUSINESS a. Review and action on Conditional Use Grant Application for the Milan Laser Spa Milwaukee North LLC 304 E. Silver Spring Drive. Commissioner Moore moved, seconded by Commissioner Roth to approve the Conditional Use Application as submitted with the conditions as listed in the staff memo dated 1/9/19 and to approve the maximum hours of operation as permitted by Village Ordinance. Motion Carried, 6-0.

3. PUBLIC HEARINGS b. On proposed Ordinance No. 1845 to amend portions of Chapter 16 (Zoning Code) pertaining to ARC submittal deadline and definition of Design Area. There were no public comments. President Siegel closed the Public Hearing at 6:06pm. 4. NEW BUSINESS b. Review and recommendation to Village Board on proposed Ordinance No. 1845 to amend portions of Chapter 16 (Zoning Code) pertaining to ARC submittal deadline and definition of Design Area. Assistant Manager Tim Blakeslee summarized the proposed ordinance. Discussion followed regarding current vs proposed design area, calculation of design area, specific examples, etc. President Siegel, Trustee Serebin and Village Manager Boening spoke further about the process to date involving an ad hoc review committee and subsequently the Village Board. In response to a question from Commissioner Huber, Village Manager Boening confirmed that the Village s Building Inspector would continue to possess authority related to design area determination. Commissioner Huber moved, seconded by Commissioner Moore to recommend that the Village Board adopt Ordinance No. 1845. Motion Carried, 6-0. 4. Diversey Blvd into two parcels. Executive Summary In early January, the Village was approached by Infinity Renovations, LLC about splitting the lot at 4820 N. Diversey Blvd into two separate lots. The intention of Infinity Renovations, LLC is to remove the existing structure, split the lot, and build two new homes on the two newly created lots. Infinity Renovations, LLC submitted a Certified Survey Map (CSM) to Village Staff requesting to split the lots in mid-january. This CSM is included as Attachment 1. Len Roecker, PE, PLS, with R.A. Smith has reviewed the initial CSM on behalf of the Village and found that it was technically acceptable subject to conditions outlined in Attachment 2. Infinity Renovations, LLC revised and submitted the required corrections to the CSM to Village Staff. Tim Barbeau, PE, PLS with R.A. Smith reviewed the corrections and recommends approval of the CSM as outlined in Attachment 3. Village Staff reviewed the CSM with regards to zoning which is outlined in Attachment 4. This review includes the condition that the Village not formally execute the CSM until the existing dwelling is removed. The existing dwelling must be removed because it straddles the newly proposed lot line and a new lot cannot be created that is nonconforming. Infinity Renovations, LLC is has applied for a demolition permit to remove the existing structure. Staff recommends the approval of the CSM, subject to the demolition of the exsisiting structure. Recommended Motion Recommend that the Village Board approve the Certified Survey Map for 4820 N. Diversey Blvd, subject to the demolition of the exsisiting structure. Attachments 1. CSM for 4820 N. Diversey Blvd. Tim, We have reviewed and marked up (in red color) the attached preliminary CSM document and recommend approval subject to the following: 1. If monuments cannot be set at the corners, witness monuments should be set. A monumentation waiver form must be submitted and approved by WDOA (attached). 2. Lead in bearing is incorrect. 3. Spelling errors on the CSM document need to be corrected. 4. Legal description dimensions are short 7.5 feet east-west? (120.00 v 127.50 )? 5. The legal description must be tied to section corners unless the plat depicts ties. The surveyor should provide copy of subdivision plat depicting the ties to the section lines so it can be determined if ties to the section corners on the CSM is not needed. 6. Parcels should be changed to Lots. 7. The final CSM format shall be in conformance with the Municipal Code of the Village of Whitefish Bay. 8. The revised final CSM should be resubmitted to the Village for final review and approvals.
