EEPC INDIA RULES FOR ELECTION OF THE VICE-CHAIRMAN AND 5 OTHER MEMBERS OF THE COMMITTEE OF ADMINISTRATION (2015-17) 1. Composition of the Committee of Administration The Committee of Administration shall consist of a. the Chairman, Sr. Vice-Chairman and Vice-Chairman, b. four Regional Chairmen, c. nominee(s) from the Government, and d. five other members elected from amongst the Working Committee members. 2. Term of office The Senior Vice-Chairman shall hold office for a term of 2 years and immediately thereafter succeed the Chairman unless he is unwilling to accept Chairmanship or he has incurred any of the disqualifications enumerated in the Council s Memorandum & Articles of Association. Similarly, the Vice-Chairman shall be endorsed by the Committee to succeed the Sr. Vice Chairman unless he is unwilling to accept Sr. Vice Chairmanship or he has incurred any of the disqualifications enumerated in the Council s Memorandum & Articles of Association. 3. Election of the Vice-Chairman The Vice-Chairman of the Council shall be elected by the members of the Working Committee from amongst themselves. 4. Election of the other five members of the Committee of Administration Five members of the Committee of Administration shall be elected from amongst the members of the Working Committee. 5. How nominations would be filed for contesting election of the Vice-Chairmen and other five members of the Committee of Administration (i) Nomination The same Election Authority, who would conduct the elections of the Working Committee, shall within 7 (seven) days from the date of announcement of the result of election of the Working Committee, issue notice along with a Nomination Form (as enclosed) by Speed Post to each of the eligible members of the Working Committee
2 for sending their nomination in respect of any one post of Vice-Chairman or other members. The filled-up Nomination forms, completed in all respects must reach the office of the Election Authority within 15(fifteen) days from the date of notice inviting such nominations. In case a member of the Working Committee is out of India, the member of the Council, who had nominated him, may send the nomination of his representative for election. Nomination sent by Telex / Fax / Telegram will be treated as invalid. (ii) Scrutiny and Publication of List of Valid Nominations The Election Authority, upon receiving nominations, shall enter the names of the nominees in a Register and after due scrutiny prepare a list of valid nominations received and thereafter display the same at the Notice Board placed in the office of the Election Authority. Election Authority shall also send copies thereof to the Council for arranging display in the Website and also its offices across India. (iii) Withdrawal of Nominations Nomination can be withdrawn by the candidate or the member concerned, provided the candidate is out of India, within 7 (seven) days from the date of publishing the List of Valid Nominations. Withdrawal of nomination by Telex / Fax / Telegram will not be accepted by the Election Authority. Nomination once withdrawn shall be final and no request for rescinding / setting aside letter of withdrawal of nomination shall be entertained by the Election Authority. 6. How voting takes place (i) Dispatch of voting paper The Election Authority, within 4 (four) days from the last date of withdrawal of nominations, shall issue voting papers, printed on pre-printed stationery, duly signed and numbered to the eligible members of the Working Committee by Speed Post to the addressees available with the Council. No duplicate voting paper shall be issued by the Election Authority under any circumstances whatsoever. In case the aforesaid Voting papers are returned back to the office of the Election Authority by the postal authorities, the Election Authority shall arrange to intimate the eligible members in question whose documents could not be delivered by the postal authorities. The Members in question, may in such circumstances depute their representative, possessing a valid Photo ID proof and an authorization letter for this purpose signed either by the Chairman or by Managing Director or by Director / Executive Director or by Proprietor / Partner / Designated Partner to collect the documents returned by the postal authorities directly from the office of the Election Authority.
3 (ii) Submission of Voting Paper Members of the Working Committee shall return the original voting papers, issued by Election Authority, duly completed to the Election Authority within the time and date specified in the voting paper. This period shall be 14 (fourteen) days weeks from the date of issue of voting paper. Voting papers shall be sent in sealed envelopes marked Voting Paper. (iii) Action on voting paper and counting of votes The Election Authority shall maintain one Ballot Box at its office in Kolkata. All voting papers received in the office of the Election Authority, either by post or by hand shall be handled by the Election Authority and immediately on receipt of the voting papers, the same will be placed in the Ballot Box. No receipt will be granted for voting paper delivered by hand. Immediately after expiry of the timeline mentioned in the voting paper, the Election Authority shall seal the Ballot Box, so that no further voting papers could be dropped / put inside the Ballot Box after the expiry of the prescribed time. 7. Declaration of result Within 2 (two) days from the last date of the receipt of the voting papers, the Election Authority shall scrutinize the voting papers and declare the result in the following manner:- a. Total number of voting papers received; b. Number of voting paper rejected; c. Number of votes secured by the contesting candidates; d. Names of persons declared elected for each post. The Election Authority will have the absolute right to decide genuineness of votes and will accept only original voting papers and reject such voting papers which they consider as duplicate or otherwise not in order. Election Authority s decision in this regard shall be final and binding. The result will be put up on the Notice Board maintained at the office of the Election Authority and shall also be communicated to the Secretary of the Council for hosting it in the Council s Website and also to put up in the Notice Boards of all offices of the Council across the country. The result of the election of the Committee of Administration shall also be circulated to the members of the Council. The person receiving the largest number of votes for each post will be declared elected. In the case of a tie, the result will be determined by the drawing of lots by the Election Authority.
4 In the event of no nomination being received by the Election Authority for any particular post, the Working Committee may request the Election Authority to hold fresh election for the post for which no nomination has been received. 8. Exclusive Jurisdiction Only the Courts at Calcutta shall have the jurisdiction to the exclusion of all other courts and forums, with regard to any matter arising out of the election of the Committee of Administration of the Council.
