Staff Presentation: Mr. Howlett stated that based on the findings listed in the staff report, Planning staff recommended that R(C)-14-29 be DENIED as listed in the official agenda. Proponent: Grady Palmer, Poole Mahoney, PC, 1403 Greenbrier Parkway, Chesapeake, Virginia, appeared before the Commission on behalf of R(C)-14-29 representing the applicant. COMMISSION DISCUSSION: Commissioner Perry wanted to make a motion to approve this application because he believed the traffic would improve, utility franchise improvement area expansion support, this would be a viable economic use of the property, and it was appropriate with the Comprehensive Plan.

4 Chesapeake Planning Commission DRAFT June 10, 2015 Public Hearing Minutes Commissioner Williams stated there was no doubt that the developer would build a quality project and that it would be a benefit to the City. However, he felt the only fix for the traffic problem would be to widen Battlefield Boulevard and he did not see that happening in the near future. He said he would not be able to support the motion to approve. Commissioner Van Laethem agreed and said he also would not be able to support this project. Chairman Kish said he would not be able to support the motion to approve due to the present school numbers. He also stated that a lot of applications had already been approved for that area and he did not know what the total impact it had on the citizens in that area. He said the study of the roads currently met the Level of Service (LOS) but other applications were coming before the Commission and if those applications were approved then the roads would not meet the LOS. The Level of Service was based on the applications before them at the time not the applications that had not yet been reviewed. COMMISSION VOTE: Commissioner Perry moved that R(C)-14-29 be APPROVED with the proffers and the requested expansion to the Public Utilities Franchise Area as listed in the staff report. Commissioner Johnson seconded the motion. The motion failed by a vote of 3-5. Commissioners Williams, Van Laethem, Small, Kish, and Hutchinson voted against the motion. Commissioner Morris was excused. Commissioner Van Laethem moved that R(C)-14-29 be DENIED with the requested expansion to the Public Utilities Franchise Area based on the findings in the staff report. Commissioner Small seconded the motion. The motion was carried by a vote of 5-3. Commissioners Perry, Johnson, and Ellis voted against the motion. Commissioner Morris was excused.
