POSEI: presentation and vote of a draft Commission Implementing Regulation laying down rules for the application of Regulation (EU) No 8/03 of the European Parliament and of the Council laying down specific measures for agriculture in the outermost regions of the Union - DSCG/04/0. The Commission presented the draft implementing Regulation going through the main modifications inserted into the text since its presentation at the Management Committee meeting of 5 September 03. The vote was requested with reservation of the updating of legal references and a slight technical clarification in Article 40 to respond to observations made by Member States. The Committee delivered a favourable opinion.. Aegean Islands: presentation and vote of a draft Commission Implementing Regulation laying down rules for the application of Regulation (EU) No 9/03 of the European Parliament and of the Council laying down specific measures for agriculture in favour of the smaller Aegean islands - DSCG/04/0 The Commission presented the draft implementing Regulation by indicating which modifications introduced into the Implementing Regulation for POSEI was taken over in the Aegean Islands regulation. The vote was requested with reservation of the updating of legal references and a slight technical clarification in Article 3 to respond to observations by Member States. The Committee delivered a favourable opinion. 3. CAP reform post 03: Implementing act for Direct Payments a. Continuation of the exchange of views on the draft Articles related to the crop specific payment for cotton - DSCG/03/5 - Rev. The Commission presented the redrafting resulting from the request in the Management Committee for Direct Payments of 9//03 to change the deadlines, referred to in Article and Article of the draft (3 January instead of 3 December and March instead of 3 January) for internal procedural reasons. b. Presentation and exchange of views on the draft Articles related to the greening - DSCG/03/0 - Rev. The Commission presented the revised articles related to greening that were initially discussed at the occasion of the Management Committee meeting for direct payments of 9//03 and a discussion with the delegations followed.

c. Presentation and exchange of views on the draft Articles related to the basic payment scheme - DSCG/04/03 The Commission presented for the first time the draft proposal as regards implementing provisions for the basic payment scheme, in particular as regards information to be provided in the application for the first allocation of payment entitlements and for the payment in case of a private contract clause, as regards calculation of the value of entitlements in case of inheritance, as regards notification of transfers and reversion of payment entitlements to the national/regional reserve. The Commission also presented provision on the allocation of payment entitlements in case of scissions in Member States applying certain limitations on the number of payment entitlements to be allocated and informed the Committee that most likely these provisions will be provided in the delegated act, instead of the implementing act. The Commission noted Member States comments for reflection and possible revision of the presented draft proposal. 4. CAP reform post 03: Implementing act for the Integrated Administration and Control System a. Legal draft of the Article related to the allocation or increase of the value of payment entitlements - DSCG/04/04 The Commission presented the new draft Article, provided some explanations in reply to the questions raised by the Member States, in particular concerning the final date to be fixed by the Member States. b. Legal draft of the Articles related to the control rate of on-the-spot checks and the sample selection - DSCG/04/05 The Commission presented the new draft Articles, provided some explanations and replied to the questions, in particular on the percentage of farmer exempted from greening to be controlled, the in-year increase of on-the-spot checks and the increase of on-the-spot checks in general. c. Legal draft of the Articles related to the recovery of undue payments and of undue entitlements - DSCG/04/06 The Commission presented the new draft Article on the recovery of undue payments, provided some explanations and replied to the questions, in particular concerning the elaboration of this Article in practise. Further reflection concerning the scope of this Article and a clarification of the second part of paragraph 3 (factual elements) are needed. d. Legal draft of the Article related to the advances for direct payments - DSCG/04/07 The Commission presented the new draft Article, provided some explanations and replied to various questions, in particular concerning financial discipline, the balance payment and the requirement of the finalisation of administrative and on-the-spot checks in respect of the claim year concerned. Member States also raised the question how to proceed with advances for direct payments in respect of claim year 04.

e. Legal draft of the Article related to the transfer of holdings - DSCG/04/08 The Commission presented the new draft Article, provided some explanations and replied to the questions, in particular on the deletion of former paragraph (5) of Article 8 of R/009. 5.
