Terms and Conditions for Maybank World MasterCard Campaign - Rugby World Cup 2015 ( Maybank World MasterCard Top Spender Campaign ) 1. Definitions In these Terms and Conditions: "Account" means a Maybank World MasterCard account maintained with Maybank in Singapore. "Maybank World MasterCard" means any personal World MasterCard Credit Card issued by Maybank. "Cardmembers" means persons who are principal Cardmembers to whom Maybank World MasterCards have been issued and whose Accounts are in good standing (as determined by Maybank in its sole discretion). Match means the Rugby World Cup semi-finals match "Maybank" means Malayan Banking Berhad, Singapore branch. "Prize" means: 4-days and 3-nights program for 2 people A pair of return economy air tickets to London Airport meet-and-greet service Transfer to and from airport and hotel Luxury accommodation at the Corinthia Hotel or equivalent Breakfast for 3 days Welcome gift Welcome reception at Massimo restaurant or equivalent Transfer to and from stadium and hotel In-venue hospitality Category A tickets to semi-final 1 on Saturday 24 October and semi-final 2 on Sunday 25 October (the Matches ) Dinner at Michelin Star Restaurant Captain s Run Experience or equivalent Meet & Greet with a MasterCard Rugby Ambassador The Prize does not include the following (such list is not exhaustive): Travel Visa and other travel related expenses Travel insurance Long distance phone calls, room service, laundry, mini bar items, room service, loss of hotel property, damage to hotel property, or any other expenses incurred in the hotel Personal expenses unrelated to the program (shopping, transportation to local sites during free time not part of the tour, food expenses aside from scheduled meals) Transportation during guest s free time, e.g. if they decide to visit the mall outside of scheduled activities Accidental insurance coverage
Any personal tax that may be levied on guests with respect to their receipt of the Prize or any part thereof Promoter refers to Malayan Banking Berhad (Maybank), a company incorporated in Malaysia with its principal place of business at 2 Battery Road, Maybank Tower, Singapore. "Qualifying Account" means, an Account, at the time of the Maybank World MasterCard Top Spender Campaign, which, in the sole opinion of Maybank is in good standing and has not been terminated. "Qualifying Period" means 1 July 2015 to 31 August 2015 (Singapore time). Qualifying Amount means a minimum of SGD $10,000 charged to a Maybank World MasterCard (excluding FlexiCash, Cash advance, Balance Transfer, interest charges, late payment charges, finance charges, annual fees, reversals and other miscellaneous charges) during the Qualifying Period. The aforesaid transactions must be posted to the Cardmember s Qualifying Account by 31 August 2015. "Winner" means the winner of the Maybank World MasterCard Top Spender Campaign. Definitions importing the singular shall include the plural and vice versa. 2. Maybank World MasterCard Top Spender Campaign 2.1 The Maybank World MasterCard Top Spender Campaign is open to Cardmembers who: 1. Send an SMS to Maybank in the required format to register their participation; and 2. Charge the Qualifying Amount during the Qualifying Period. 2.2 If Maybank receives an eligible SMS in the correct format then the Cardmember will receive an auto-reply SMS from Maybank. Proof of sending an SMS does not constitute proof of Maybank s receipt of the SMS. 2.3 Supplementary Cardmembers are not eligible to participate in this Promotion. 2.4 Card retail transactions (including online and foreign transactions) charged by the Cardmembers and their Supplementary Cardmembers (if any) may be combined and used to accumulate the Qualifying Amount. 2.5 The top highest spender will be chosen based on highest total accumulated Qualifying Amount within the Qualifying Period. 3. Eligibility 3.1 Only Cardmembers with a Qualifying Account(s) are eligible to participate in the Maybank World MasterCard Top Spender Campaign. 3.2 If the Maybank World MasterCard held by a Cardmember is suspended or cancelled or terminated by Maybank or the Cardmember for any reason whatsoever before the winners are announced, the Cardmember will be disqualified from the Maybank World MasterCard Top
Spender Campaign (notwithstanding that his/her other Cards may not have been suspended or cancelled or terminated). 3.3 The estates of deceased Cardmembers shall not be entitled to participate in the Maybank World MasterCard Top Spender Campaign. 3.4 Transactions must be made to the Cardmember s Qualifying Account within the Qualifying Period. In the event an eligible transaction is cancelled or reversed by any party for any reason the said transaction will not be considered for the purpose of this Maybank World MasterCard Top Spender Campaign. If an eligible transaction is cancelled or reversed after theprize has been awarded Maybank has the right to charge the value of the Prize to the Cardmember s Account or deduct it from any Maybank account the Cardmember holds with Maybank. 4. Prize 4.1 The Prize is not transferable or exchangeable for cash, credit or kind and shall be subject to such terms and conditions which Maybank may in its sole and absolute discretion impose. Maybank may in its sole and absolute discretion exchange or substitute the Prize to another of equivalent or similar value without notice and liability to any person. 4.2 The Winner and his/her guest must be 16 years or above. 4.3 Tickets to the Matches must be accepted as awarded and are subject to all of the applicable terms and conditions prescribed to such tickets from time to time by Rugby World Cup Limited ( RWCL ). By accepting tickets as a prize, the holder is deemed to have accepted all of the applicable terms and conditions. 4.4 The Winner acknowledges that the Prize is developed and managed by Octagon Inc., and will not hold Maybank, Mastercard or Octagon Inc liable for any loss or damage caused to the Winner by Octagon Inc. or if applicable, any replacement vendor that MasterCard may engage and notifies in writing to the Winner. 4.5 While Maybank has endeavoured to ensure the Prize details are final, Maybank reserves the right to amend the details by written notice to the Winner. 4.6 Maybank has no control over the change of itineraries and accepts no liability relating to any such change. Accommodation and airline shall be chosen by Maybank in its sole discretion. 4.7 By accepting the Prize the Winner agrees to participate in Maybank's and its partners' postcampaign marketing communications. 4.8 The collection and use of the Prize shall be subject to these terms and conditions and such other conditions that may be imposed by Maybank or the relevant merchants supplying the goods or services. The Prize shall be collected at the risk and cost of the Winner. The Winner shall accept his/her Prize on an "as-is, where-is" basis. Maybank shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the Prize. Notwithstanding anything herein, Maybank shall not at any time be responsible or held liable for any defect or malfunction in the Prize by any person, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of the Prize (or of any goods or services redeemed with the Prize).
5. To win 5.1 Maybank will choose the Winner based on the highest Qualifying Amount charged to a Maybank World MasterCard by an eligible Cardmember during the Qualifying Period. 5.2 The Cardmember who charges the highest Qualifying Amount to his/her Maybank World MasterCard during the Qualifying Period will win the grand Prize. 5.3 Transactions must be made at a valid merchant. Maybank reserves the right to refuse transactions and/or disqualify participants if Maybank considers in its discretion that a merchant is not acceptable in view of ethical, commercial or legal/regulatory standards, or for any such other reason as Maybank may determine. 6. The Results 6.1 The Winner shall be contacted by Maybank by phone by 15 September 2015. 6.2 The Prize cannot be used for commercial or promotional purposes or resold for more than their original sale price. The Winner of the Prize will be required to sign confirmation of his/her acceptance of the ticket conditions and such conditions relating to accommodation and travel. Travel is from Singapore. It is the responsibility of the Winner to obtain the necessary travel documents. No compensation will be given should the Winner fail to obtain such documents, regardless of any circumstances. 6.3 Winner is required to attend the prize presentation ceremony and/ or other publicity programmes (if any) at their own costs and expenses at the time and venue stipulated by Maybank for the purposes of collecting their Prize. 6.4 Maybank reserves the right to select one (1) or more reserve winner(s) to replace the Winner subsequently found to be disqualified. 6.5 Where the Prize remains unclaimed for 10 business days after Winner is contacted by Maybank, Maybank reserves the right to transfer the Prize to a reserve winner. 6.6 Maybank reserves the right to transfer the Prize to a randomly selected reserve winner in the event that the Winner is unable to fulfill the obligations required of him/her. 7. General 7.1 Notwithstanding anything herein, Maybank shall not at any time be responsible or held liable for any loss, injury, damage or harm suffered or incurred by or in connection with the use of the Prize (or of any goods or services redeemed with the Prize) by any person. 7.2 The Winner agrees to co-operate with and participate in any advertising or publicity activities of Maybank relating to the Maybank World MasterCard Top Spender Campaign and agrees that Maybank may publicise the name, IC/passport number and/or photograph of the Winner for the purpose of this Maybank World MasterCard Top Spender Campaign only and in accordance with applicable law.
7.3 Without prejudice to these terms and conditions, all participants in the Maybank World MasterCard Top Spender Campaign expressly and irrevocably permit and authorise Maybank to collect, use and disclose information regarding their particulars to the parties involved in organising, promoting and conducting the Maybank World MasterCard Top Spender Campaign for the purposes of the Maybank World MasterCard Top Spender Campaign. 7.4 The decision of Maybank on all matters relating to this Maybank World MasterCard Top Spender Campaign will be at its absolute discretion and will be final and binding on all participants. No correspondence shall be entertained. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Maybank World MasterCard Top Spender Campaign, these terms and conditions will prevail. 7.5 Maybank shall not be responsible for any loss to or expenses incurred by any Cardmember or any other person in connection with the Maybank World MasterCard Top Spender Campaign, howsoever arising, including but not limited to any error in awarding the Prize, any notice which is misdirected or lost in the post or any change or cancellation of the rugby matches for any reason. 7.6 Maybank accepts no responsibility for any tax implications that may arise from the Prize or the use thereof. Any tax filing obligation or any tax payment due to any tax authority as a result of receipt of the Prize remain the sole responsibility of th Winner. It is the responsibility of the Winner to seek independent advice on the possible implications this may have on their own financial situation. 7.7 Maybank reserves the right at its absolute discretion to terminate this Maybank World MasterCard Top Spender Campaign or vary, delete or add to any of these terms and conditions from time to time and to exclude any person from participating in the Maybank World MasterCard Top Spender Campaign without notice including without limitation, the eligibility of any Cardmember, the methods of identification of the Winner and the dates of the Qualifying Period. 7.8 By participating in the Maybank World MasterCard Top Spender Campaign each participant agrees to abide by the terms and conditions stated herein. In the event that the participant does not agree to these terms and conditions he/she should not participate in the Maybank World MasterCard Top Spender Campaign and should opt out by informing Maybank of the same. 7.9 MasterCard and Maybank do not assume any responsibility for the products and services offered under this Maybank World MasterCard Top Spender Campaign. The products are sold and services are provided solely by the relevant vendors, under such terms and conditions as determined by such vendors, and MasterCard and Maybank accept no liability whatsoever in connection with such products and services. The products and services have not been certified by MasterCard and Maybank and under no circumstances shall the inclusion of any product or service in this Maybank World MasterCard Top Spender Campaign be construed as an endorsement or recommendation of such product or service by MasterCard and Maybank. 7.10 These Terms and Conditions shall be governed by the laws of Singapore and the participants in the Maybank World MasterCard Top Spender Campaign irrevocably submit to the nonexclusive jurisdiction of the courts of Singapore.
7.11 A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions. Excerpt of Terms and Conditions of Rugby World Cup Limited (RWCL) 1. Each winner and his/her guest(s) as applicable agree to comply with the terms and conditions applicable to the issue and use of tickets from time to time (as available and set out at https://tickets.rugbyworldcup.com/staticpages/termsandconditions.aspx or such other webpage as determined by Rugby World Cup Limited ( RWCL ) from time to time) and all applicable RWCL, the tournament organiser (England Rugby 2015, ER2015 ) and venue owner or operator rules and regulations relating to access to Rugby World Cup venues and any other areas associated with Rugby World Cup (including any terms of accreditation determined by RWCL). Further each winner and his/her guest(s) acknowledge that he/she may be required to enter into a direct acknowledgement and/or agreement with RWCL and/or ER2015 concerning use of the tickets and compliance with ticket terms and conditions prior to receiving the prize. 2. Winners and/or guests shall not, while using any Rugby World Cup tickets, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Rugby World Cup, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others rights (including intellectual property rights) or reflects negatively upon any of RWCL or the Rugby World Cup. Each entrant agrees and acknowledges that any breach of this clause 2 will cause significant damage and loss to RWCL. 3. The Promoter may pass personal information relating to prize winners to RWCL and/or ER1015 (and any of their service providers or agents) for the purposes of monitoring the distribution and use of Rugby World Cup tickets and related experiences and, in the event of a suspected breach of any terms and conditions, rules or regulations of RWCL and/or ER2015 relating to the use of such tickets and/or experiences, investigating and taking action against such winners. 4. This promotion is run by the Promoter with the permission RWCL. Accordingly any dispute in respect of the operation of and all matters and concerns relating to the promotion should be resolved with the Promoter, not RWCL or any other persons involved in the staging of Rugby World Cup 2015 (including ER2015) and World Rugby (formerly the International Rugby Board), all of whom shall not be responsible for or liable to entrants in any way whatsoever in connection with this promotion.
