COMMITTEES NEW BUSINESS MERCHANTVILLE BOARD OF EDUCATION PUBLIC AGENDA MINUTES Approve Minutes - It is recommended that the board of education approve the board minutes from the August 24, 2010 meeting. BUSINESS OFFICE 1. Approve Financials It is recommended that the board of education approve the the July 2010 Financial Reports. Pursuant to N.J.A.C. 6A: 23A-16.10(c) 3, I certify that as of July 2010, no budgetary line item account has obligations and payments (contractual orders) which in total exceed the amount appropriated by the Merchantville Board of Education pursuant to N.J.S.A. 18A: 22-8.1 and N.J.S.A. 18A: 22-8.2 and no budgetary line item account has been over-expended in violation of N.J.A.C. 6:23A-16.10(a) 1. In accordance with N.J.A.C. 6A: 23A-16.10 (c) 2, it is certified that anticipated revenue has not changed for the months ending July 2010. 3. Contracted Services It is recommended that the board of education approve the following contracted services contracts for school year 2010-2011. VENDOR S NAME Bradley- Sciocchetti Inc., N. J. Approve Camden County Elementary League Membership Resolution - It is recommended that the board of education approve the chief school administrator s recommendation to enroll Merchantville School as a member of the Camden County elementary League to participate in the approved interschool athletic programs sponsored by the league. 2. Approve Sodexho Management Food Contract Resolution - It is recommended that the board of education approve the chief school administrator s recommendation and approve the Resolution awarding the Food Service Contract to Sodexo Management, Inc. for the 2010-2011 school year, as outlined below.

Resolution Awarding Food Service Contract To Sodexo Management, Inc. Approve and award a contract for School Food Service Management for the 2010-2011 school year, to Sodexo Management, Inc. 9801 Washingtonian Blvd., Gaithersburg, Maryland 20878 it is the recommendation of the Business Administrator that the Merchantville Board of Education award the contract to Sodexo Management, Inc. subject to the following contractual provisions: The Food Service Management Company shall receive, in addition to the costs of operation, a fee of $.565 per reimbursable meal and meal equivalent to compensate the Food Service Management Company for administrative and management costs. This fee shall be billed monthly as a cost of operation. The Local Education Agency guarantees the payment of such costs and fee to the Food Service Management Company. Total meals are calculated by adding reimbursable meal pattern meals (breakfast, lunch and after school snack meals) served and meal equivalents. The number of School Breakfast Program, After School Snack Program, and National School Lunch program meals served to the children shall be determined by actual count. Cash receipts, other than from Sales of National Lunch Program and School Breakfast Program meals and After School Snack Program meals served to the children, shall be divided by $2.00 to arrive at an equivalent meal count. The per meal management fee of $.565 will be multiplied by total meals. GUARANTEE. District and Sodexo shall work together to ensure a financially sound operation and shall guarantee financial results for the 2009-2010 school year as follows. Deficit Guarantee If Food Service operations result in an annual Deficit greater than Six Thousand Seven Hundred Dollars ($6,700) for the 2010-2011 school year, the following shall apply: Sodexo shall reimburse District for the annual Deficit greater Six Thousand Seven Hundred Dollars ($6,700) in an amount not to exceed fifty percent (50%) of Sodexo's annual Management Fee ("Sodexo's Share"). Sodexo reserves the right to recover any such reimbursement made during the current contract year from that year s Surplus on a monthly basis; and Any annual Deficit greater than Sodexo's Share shall be borne by District. ASSUMPTIONS. Financial terms of the Contract are based upon the following assumptions. If there is a change in conditions, including, without limitation, changes to the following assumptions, the parties agree to enter into negotiations

concerning the impact of such changes, and the financial terms of the Contract, including any guarantee, shall be adjusted accordingly. Changes in District's policies, practices, and service requirements, including but not limited to, changes in bell schedules, meal service periods or proposed staffing, will result in an appropriate adjustment. The projected number of full feeding days shall remain at o Breakfast 180 o Lunch 166 There shall be no reduction in number of full feeding days (breakfast, if applicable, and lunch) and average daily attendance as a result of inclement weather, delayed opening or early dismissals resulting in lost full days. Average daily attendance ( ada ) and the number of free and reduced price participants shall remain at the same levels as the 2009-2010 contract year. Changes in legislation, regulations, reimbursement rates, meal components and quantities required by the National School Lunch Act, the National School Lunch Program or changes in the State s School Nutrition policies will affect the guarantee. This is exclusive of the announced reductions, as of May 7, 2010, in state reimbursement rates for the 2010-2011 school year Cash and/or food assistance levels from State and Federal sponsors do not decline below the previous year s levels. Usable commodities, of adequate quality and variety required for FSMC's proposed menu cycle for the current contract year, valued at no less than the per Pattern Meal value for the previous contract year. The state or federal minimum wage rate and taxes in effect as of July 1, 2010, shall remain consistent throughout the year. Costs for repairs, maintenance, replacements and small wares do not exceed Three Hundred Dollars ($300.00) per school year. Prices to be charged for meals during the 2009-2010 school year shall be as follows: Breakfast: Paid: $1.25 Reduced: $0.30 Lunch: Paid: $2.50 Reduced: $0.40 District costs charged to the Food Service program shall not exceed the following: o District contract monitoring costs: $3,840.00

RECOMMENDED That the Board of Education approve the appointment / reappointment of the following coaches and / or advisors for the 2010-2011 school year. RECESS INTO CLOSED SESSION It is recommended that the Board of Education adjourn, by Resolution, into Closed Session, from which the general public is excluded, to discuss, personnel, negotiations, or any other matter appropriate for this session. The results of this session will be made public immediately after, or as soon thereafter, as a decision is reached, if permitted by law. RESUMPTION OF PUBLIC PORTION OF THE MEETING ADJOURNMENT
