Letter on forest products to be signed by Canada Dear I have the honour to confirm the following understanding reached between the delegations of the European Union and Canada during the course of negotiations regarding the Comprehensive Economic and Trade Agreement ( CETA ) signed this day: Canada and the European Union recognize the importance of the forestry sector to their economies and those of the rural communities of both Parties. Through the CETA, Canada and the European Union have established conditions that will improve trade in forest products and support those that depend on this sector. The CETA will establish conditions to improve trade in this sector, by comprehensively eliminating both Parties tariffs on forest products; providing for forums to discuss matters related to market access, including non tariff measures, including among others a Bilateral Dialogue on Forest Products to discuss relevant laws, regulations, policies and sector issues of importance to the production, trade, and consumption of forest products. In the context of liberalized trade for forest products, upon implementation of the CETA, notwithstanding the exception for the export of logs of all species from the application of Article 12 (Import and Export Restrictions) of the National Treatment and Market Access for Goods Chapter, the Government of Canada will issue permits upon request for exports of logs destined for the European Union. I look forward to the strengthening of our historic commercial and economic ties between Canada and the European Union through the successful implementation of the CETA. I have the honour to propose that this letter and your letter in reply confirming that the European Union shares this understanding will constitute an understanding between the European Union and Canada. Letter on forest products to be signed by EU Dear Following your letter dated XX/XX/201X, I have the honour to confirm that the European Union shares the understanding on forest products reached in the context of the Comprehensive Economic and Trade Agreement ( CETA ). We note in particular that, notwithstanding the exception for the export of logs of all species from the application of Article 12 (Import and Export Restrictions) of the National Treatment and Market Access for Goods Chapter, the Government of Canada will issue permits upon request for exports of logs destined for the European Union. I look forward to the strengthening of our historic commercial and economic ties between the European Union and Canada through the successful implementation of the CETA. Sincerely, 3

Letter on RoO for busses to be signed by Canada Mauro, It is understood that the alternative rule of origin for products of 87.02 applies to the following enterprises located in Canada and their successors and assigns: Girardin Minibus Inc. Grande West Transportation MCI New Flyer Nova Bus Prevost This rule of origin will be set out in Appendix X.X (Origin Quotas and Alternatives to Annex X.X Product Specific Rules of Origin) as follows: Alternative Rule of Origin for Products of 87.02 For products of heading 87.02 exported from Canada to the EU, the following rule of origin applies as an alternative to the rule of origin provided in Annex X (Product Specific Rules of Origin): A change from any other heading, except from heading 87.06 through 87.08; or A change from within this heading or heading 87.06 through 87.08, whether or not there is a change from any other heading, provided that the value of the non originating materials of this heading or heading 87.06 through 87.08 does not exceed 50 per cent of the transaction value or ex works price of the product. This rule of origin will apply to the enterprises located in Canada and their successors and assigns producing products of heading 87.02 in Canada, as of date of initialling of this Agreement. Note 2 The Parties agree to apply cumulation with the United States according to the following provisions: Provided that there is an FTA in force between both Parties and the United States consistent with the Parties WTO obligations and the Parties reach agreement on all the applicable conditions, any material of Chapter 84, 85, 87 or 94 of the Harmonized System used in the production of a product of 87.02 of the Harmonized System in Canada or the EU will be considered as originating. 4

Accordingly the above rule of origin will cease to apply one year following the entry into application of such cumulation. The application of cumulation and deletion of Note 2 will be published in the EU Official Journal for information purposes. 5

Letter on Tiroler Speck and České pivo / Pils to be signed by the EU EUROPEAN COMMISSION DIRECTORATE GENERAL FOR AGRICULTURE AND RURAL DEVELOPMENT The Director General Brussels, Dear The purpose of this letter is to address the concerns expressed by Canadian negotiators during CETA talks as regards the terms Tiroler Speck and České pivo / pils following the entry into force of CETA. 1. Tiroler Speck The protection of the geographical indication Tiroler Speck is enshrined in Commission Regulation (EC) No 1065/97 of 12 June 1997 (Official Journal L 156 of 13.06.1997, p. 5). According to the related specification, the protected geographical indication Tiroler Speck may not be translated into any other language. 2.
