SECTION ONE - POWERS Fayetteville State University SGA LEGISLATIVE BRANCH BYLAWS ARTICLE I POWERS AND COMPOSITION All legislative powers shall be vested in the Senate of the Fayetteville State University Student Government Association (SGA). SECTION TWO COMPOSITION I. The Legislative Branch shall be comprised of a total of twenty-nine (29) senators as outlined in the SGA Constitution. II. In the event all seats per respective class are not filled, an election will be held during the Fall Semester. ARTICLE II ORDER OF BUSINESS SECTION ONE MEETINGS I. The Senate shall meet twice monthly during the regular academic year at a time to be determined by the II. III. Vice President; The Vice President shall have the power to adjust the meeting schedule, with a two week notice to the Senate, in order to prevent conflicts with other University activities and/or University breaks. The attire for senate meeting shall be Business Professional unless otherwise specified by the SGA Vice President. SECTION TWO QUORUM I. A quorum for a meeting of the Senate shall consist of fifty percent (50%) plus one (1) of the current Senate membership, excluding vacancies; and II. If the Senate is not in session, the voting members of the Executive Branch shall constitute a temporary quorum. Any items approved by a temporary quorum must also be approved by the Vice Chancellor for Student Affairs or designee. SECTION THREE COMMITTEE OF THE WHOLE I. If a quorum is not present, the Senate may meet as a committee of the whole; II. The Committee of the Whole may consider issues and resolutions other than amendments to the Constitution or the Bylaws; III. A final vote may not be held on any issues or resolution, but the Committee of the Whole can positively or negatively recommend the issue or resolution to the Senate as a whole; and IV. The Executive Secretary shall make a report of the actions of the Committee of the Whole at the next regularly scheduled Senate meeting. SECTION FOUR - TEMPORARY QUORUM 1
If the Senate is not in session, the voting members of the Executive Branch may constitute a temporary quorum and take emergency action(s) on behalf of the SGA; however, such action must be readily and conclusively communicated to the Senate and approved by the Vice Chancellor for Student Affairs or designee. SECTION FIVE VOTING All voting shall be in accordance with Robert s Rules of Order. ARTICLE III QUALIFICATIONS, DUTIES AND RESPONSIBILITIES SECTION ONE SENATORS I. QUALIFICATIONS FOR OFFICE A. Must be a full-time student at Fayetteville State University who is not an early-college high school student, special visiting student, or a student that is solely taking online courses; B. Must possess a cumulative grade point average of a 2.5 at the time of being elected/appointed; and must maintain at least a cumulative grade point average of 2.5 throughout his or her term of office. (If a senator is a freshman, cumulative GPA shall be waived); and C. Must be in good standing with the University, community, and the SGA (as defined in the SGA Constitution). II. DUTIES AND RESPONSIBILITIES A. Serve on at least one (1) standing Senate committee; B. Address concerns reported on concern sheets, at open floor discussion, and at any other setting with University officials per committee assignments; C. Be familiar with parliamentary procedure; D. Attend all scheduled committee meetings; E. Attend regularly scheduled and Senate meetings; F. Appoint members to the Elections Board with majority vote of the Senate upon a Senate hearing; G. Approve or decline the appointment of the Senate Pro Tempore with a majority vote; H. Allocate funds to campus organizations for activities, and allocate expenditures for the operation of the SGA; I. Recommend whether legislation, regulations, or policies affecting students at the University should be approved; J. Hear complaints and suggestions, and make the necessary inquiries leading to an official statement, resolution, or investigation; K. Overrule any Presidential veto by two-thirds (2/3) majority vote; L. Approve or reject Constitutional amendments by two-thirds (2/3) majority of the Senate; M. Approve by majority vote, all Presidential appointments outlined in the Executive Bylaws; N. Establish ad hoc committees to facilitate its functions; O. Approve the Legislative, Elections Board, and Class Councils Bylaws; and P. Impeach SGA officers in accordance with procedures outlined in the Constitution. SECTION TWO SENATE PRO-TEMPORE I. Preside over the Senate in the absence of the SGA Vice President; II. Serve as the SGA Vice President in the case of his/her incapacity; 2
III. Serve as the highest-ranking senator of the legislative branch and oversee Ad-Hoc Committee Chairs; IV. Keep an accurate roster of the Senate, to be shared with the Vice President; V. Keep track of meetings held and report attendance of all Senate Standing and Ad-Hoc Committee members to the Executive Secretary; VI. Serve as an ex-officio member of all Ad-Hoc Committees; and SECTION THREE CHAIR, UNIVERSITY RELATIONS AND LEGISLATIVE AFFAIRS COMMITTEE I. Review and ensure that the Legislative Branch Bylaws are up to date; II. Initiate any proposed changes or, amendments to the Legislative Branch Bylaws; I IV. Compile a list of resolved student concerns for presentation at Senate meetings; V. Oversee all operations of the University Relations and Legislative Affairs Committee; and VI. Report all attendance issues and concerns concerning the committee to the Senate Pro-Tempore. SECTION FOUR CHAIR, ACADEMIC AFFAIRS COMMITTEE I. Serve as a liaison between SGA, the Provost and Vice Chancellor for Academic Affairs, and Deans of Fayetteville State University Colleges and Schools; III. Compile a list of resolved student concerns for presentation at Senate meetings; IV. Shall assign to committee members student concerns that need to be addressed with appropriate Academic Affairs officials; V. Oversee all operations of the Academic Affairs Committee; and VI. Report all attendance, issues and concerns regarding the committee to the Senate Pro-Tempore. SECTION FIVE CHAIR, STUDENT AFFAIRS COMMITTEE I. Serve a liaison between SGA and the Vice Chancellor for Student Affairs or designee; III. Compile a list of resolved student concerns for presentation at Senate meetings; IV. Oversee all operations of the Student Affairs Committee; and SECTION SIX CHAIR, BUSINESS AND FINANCE COMMITTEE I. Serve as a liaison between SGA, Vice Chancellor for Business and Finance, and the Director of Business Services; IV. Oversee all operations of the Business and Finance Committee; and V. Report all attendance, issues and concerns regarding the committee to the Senate Pro-Tempore. SECTION SEVEN CHAIR, INSTITUTIONAL ADVANCEMENT COMMITTEE 3
I. Serve as a liaison between SGA and the Vice Chancellor for Institutional Advancement; II. Shall call and preside over committee meetings; IV. Oversee all operations of the Institutional Advancement Committee; and SECTION EIGHT CHAIR, INFORMATION TECHNOLOGY SERVICES I. Serve as a liaison between SGA and the Vice Chancellor for ITS; II. Shall call and preside over committee meetings; IV. Oversee all operations of the IT Committee; and SECTION NINE CHAIR, ATHLETICS COMMITTEE I. Serve as a liaison between SGA and the Athletic Director; IV. Coordinate activities for the student section during basketball and football seasons; V. Assign to committee members student concerns that need to be addressed with appropriate Athletics officials; VI. Oversee all operations of the Athletics Committee; and VII. Report all attendance issues and concerns regarding the committee to the Senate Pro-Tempore. ARTICLE IV ATTENDANCE SECTION ONE ATTENDANCE I. MANDATORY ATTENDANCE A. All SGA sponsored events and meetings are mandatory, and attendance is required of all members of the Legislative Branch; and B. In the event of an absence, a Senator shall submit an absentee form on the official SGA website seventy-two (72) hours prior to the meeting or event which will be approved or denied by the Executive Secretary. II. ABSENCES I. If a member of the Executive Branch acquires three (3) absences during their term, he or she will receive a written warning from the Executive Secretary. II. If a member of the Executive Branch acquires five (5) absences during their term, he or she will have forfeited their position.. ARTICLE V 4
AMENDMENTS TO THE LEGISLATIVE BYLAWS SECTION ONE AMENDMENTS I. Any amendments of these Bylaws shall be approved by a majority vote of the Senate after being presented via tangible or electronic document; and II. Upon amendment, the Bylaws shall become operative and shall supersede all previous versions of these Bylaws. 5
