All members were present. Larry Kleindl, County Administrator, appeared and gave an update on the Broadband Bond. Kleindl explained that CTC is requiring a 50% or about 800 residents to sign up for Broadband before they will begin work in the area. Kleindl said that currently we have approximately 40% signups with CTC, and requested a motion to postpone the bond sale for the Border to Border Kandiyohi County broadband project to a future date to be determined by the County Administrator and our financial advisors from Ehlers. A motion by Nissen 2 nd Ahmann to postpone the bond sale for the Border to Border Kandiyohi County broadband project to a future date to be determined by the County Administrator and our financial advisors from Ehlers was on vote unanimously adopted. A motion by Madsen 2 nd Butterfield to approve Resolution 2017-22 was on vote unanimously adopted. KANDIYOHI COUNTY RESOLUTION 2017-22 IT IS RESOLVED that Kandiyohi County enter into MnDOT Agreement No. 1027698 with the State of Minnesota, Department of Transportation for the following purposes: To provide for payment by the State to the County for the use and maintenance of County State Aid Highway No. (C.S.A.H.) 148 and No. 2 and County Road No. 48 as a detour route during the contract construction to be performed upon, along and adjacent to Trunk Highway No. 71 from 0.5 miles North of T.H. 23 to 0.218 miles North of T.H. 9 under State Project No. 3417-18 (T,H. 71=141).

Dated at Willmar, Minnesota this 18th day of April, 2017. A motion by Nissen 2 nd Ahmann to approve Resolution 2017-20 was on vote unanimously adopted. RESOLUTION 2017-20 AUTHORIZATION TO EXECUTE MNDOT AGREEMENT NO. 1027720 SP 045-605-030 ADVANCE CONSTRUCTION IT IS RESOLVED, that pursuant to Minnesota Stat. Sec. 161.36, the Commissioner of Transportation be appointed as Agent of Kandiyohi County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. BE IT FURTHER RESOLVED, that the Kandiyohi County Board and the Kandiyohi County Auditor are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in Minnesota Department of Transportation Agency Agreement No. 1027720, a copy of which said agreement was before the County Board and which is made a part hereof by reference. Dated at Willmar, Minnesota this 18th day of April, 2017. Jeff Bredberg, Director of Environmental Services, appeared concerning four requests for monies from the Water Planning Task Force. Bredberg stated that the Water Plan Task Force had met and considered the four applications for money. The request from the Big Kandi Lake Association for $3,000.00 for a fish stick program which will make for a better fish habitat with the recommendation from the Task Force for 50% cost share not to exceed $3,000.00. A motion by Butterfield 2 nd Madsen to approve the recommendation from the Task Force was on vote unanimously adopted.

The request from the Big Kandi Lake Association for $3,000.00 to install an internet landing installed device sensor (I-LIDS) which is a self-contained solar powered system at the County Park 2 boat launch to prevent Aquatic Invasive Species (AIS) through video capture and remote inspections of launching boats/trailers and audio education of boaters using the lake with the recommendation from the Task Force for $3,000.00. A motion by Nissen 2 nd Ahmann to approve the recommendation from the Task Force was on vote unanimously adopted. A motion by Madsen 2 nd Nissen to approve the recommendation from the Task Force was on vote unanimously adopted. A motion by Madsen 2 nd Nissen to appoint Ron Halvorson to replace of Alan Eblen on the Water Planning Task Force for a four year term was on vote unanimously adopted. A motion by Nissen 2 nd Madsen to re-appoint Robert Thein, Doug Hanson, Steve Wood, Nick Bjornberg and Ron Dilley to the Water Planning Task Force for a four year term was on vote unanimously adopted. A motion by Butterfield 2 nd Madsen to approve the 2017 State of Minnesota Federal Supplemental Boating Safety Patrol Grant Agreement between the State of Minnesota, acting through its Commissioner of Natural Resources and the Kandiyohi County Sheriff was on vote unanimously adopted. Mel Odens, Public Works Director, appeared and gave an update on the Willmar Wye project, stating that the Master Cooperative Agreement is still in negotiations and listed key negotiating items; County s role in acquiring right of Way acquistion and that the public and private partners are committed to see this project completed. Odens also requested that the board pass a motion to proceed with the Master Coop Agreement negotiations as presented and that the County supports the project as described and approved in the Environmental Assessment. A motion by Madsen 2 nd Butterfield to approve proceeding with the Master Coop Agreement negotiations as presented and that the County supports the project as described and approved in the Environmental Assessment was on vote adopted. Voting yes: Madsen, Butterfield, Ahmann, Imdieke. Voting no: Nissen.

A motion by Nissen 2 nd Butterfield to approve Resolution 2017-21 was on vote unanimously adopted. RESOLUTION 2017-21 VACATE A PORTION OF COUNTY ROAD 30 A/K/A NORTH SHORE DRIVE WHEREAS, the Application seeks to vacate that certain specific part of County Road No. 30 a/k/a North Shore Drive within Kandiyohi County Highway Right of Way Plat No. 4, described as follows: That part of the highway right of way as shown on KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4 as of public record, Kandiyohi County, Minnesota, described as follows: Commencing at the Southwest corner of said KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4 and assuming that the West line of said KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4 bears N 00º58 25 E; thence Easterly 258.49 feet along the South line of said KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4, along a non-tangent curve, concave to the North, having a radius of 1175.91 feet, a central angle of 12º35 41 and a chord bearing and distance of S89º04 04 E, 257.97 feet to the point of beginning of the tract herein described; thence on a bearing of S 01º03 44 W along said KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4, a distance of 33.13 feet; thence Northeasterly 47.35 feet along the South line of said KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4, along a non-tangent curve to the North, having a radius of 1208.91 feet, a central angle of 02º14 39 and a chord bearing and distance of N 84º54 33 E, 47.35 to its intersection with a line that is 305.00 feet East of and parallel with the West line of said KANDIYOHI COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 4 as measured perpendicular to last said line; thence on a bearing of N 00º58 25 E, 36.76 feet to a line that is 50 feet South of and parallel with the existing centerline of County Road No. 30; thence on a bearing of S 83º55 34 W along last said line, 47.38 feet to its intersection with a line bearing N 01º03 44 E from the point of beginning; thence on a bearing of S01º03 44 W along last said line, 2.82 feet to the point of beginning.
