Because one of the parties' proposals is to consolidate certain UE 0 9 issues for hearing into UE 00, PacifiCorp is also filing this motion in Docket UE 00. 1 Currently the schedule in UE 9 provides for Staff/lntervenor Surrebuttal Testimony to be filed today, August 8, 008, along with cross-examination statements, and a hearing (with live Sursurrebuttal) on August 1,008. The schedule then sets forth briefing dates, with a target date for a Commission decision of October,008. The parties hope to be able to narrow the issues sufficiently so that the Commission may set a reasonable briefing schedule and still issue its final order in this case in time for calculation of the Transition Adjustment associated with the November 1, 008 direct access shopping window. However, the Company agrees not to use the direct access effective date as an argument against allowing an appropriate amount of time for briefing and a Commission decision in this case. n relation to the new schedule, the Company agrees that, if necessary, it will request a waiver of OAR 80-08-0 (setting the direct access window on or about November 1 of each year) to change the date of the direct access window to allow sufficient time for completion of this docket. 1 1 1 1 1 1 0 1 The parties propose to consolidate the UE 9 issues related to UE 00 into the UE 00 docket and under the UE 00 hearing schedule. This includes Staff's issues related to the capacity factors of the Rolling Hills and Glenrock wind facilities, and the potential inclusion of two new wind resources in the July TAM update and the Renewable Adjustment Clause. This does not include issues related to wind integration charges, which will remain under the UE 9 schedule. Under the current UE 9 schedule, Staff and intervenor testimony on these issues is due August 8, 008. Staff and intervenors now agree to file this testimony no later than August 1, 008. The Company will respond with sur-surrebuttal testimony on these issues, and the issues raised in Staffls previously filed surrebuttal on the Glenrock project, concurrently with the Company's UE 00 rebuttal, now due on August,008. The parties agree to a settlement conference on the previous hearing date ofaugust 1,008. Staff and intervenors agree to use best efforts, taking into consideration the volume and complexity of the data requests received, to respond to discovery on their surrebuttal testimony within business days, further taking into consideration that the intervening UE 00 hearing may mean that business days are required for some of the responses.
