C.M. RECOMMENDATIONS: A. Adopt the attached ordinance to approve the site plan amendment to convert the uses permitted on the ground floor of the building, approximately 51,552 square feet of gross floor area (41,544 sq. ft. of office and 10,008 sq. ft. of existing vacant retail space) to an arcade, bowling alley, restaurant, retail, and accessory uses, subject to all previously approved conditions and the addition of new conditions #1 and 2. B. Approve the subject use permit to permit Bowlero to operate an arcade, bowling alley, restaurant and accessory uses, subject to the conditions of the staff report, with a County Board review in one (1) year (January 2020). ISSUES: This is a request to convert approximately 51,552 square feet of gross floor area (GFA) consisting of office and retail space in the Buchanan apartment building, to include retail, arcade, bowling alley, restaurant and accessory uses and to allow operation of such a use for Bowlero in this space. No issues have been identified as of the date of this report. SUMMARY: This is a two-part request: 1) a site plan amendment to convert approximately 51,552 square feet of gross floor area (GFA) in the Buchanan apartment building (320 23 rd Street S.) from office and retail uses to include indoor recreational and entertainment uses such as an arcade, bowling alley, restaurant and accessory uses; and 2) a new use permit to allow for the uses on the ground floor of the existing building to include an arcade, bowling alley, restaurant and accessory uses for Bowlero, a bowling alley chain that includes video game arcade uses and accessory restaurant space. BACKGROUND: On February 14, 1968, the County Board approved a site plan (known as National Center ) for the area between the Airport Overpass and 23 rd Street South in Crystal City, consisting of four (4) 12-story office buildings, one (1) eight-story office building, and one (1) 12-story apartment building. Several site plan amendments have been approved since then. On August 17, 1999, the County Board approved a site plan amendment to convert 41,544 square feet of retail space to office space and renovation. The following provides additional information about the site and location: Site: Zoning: Land Use: House is located on the block bound by 23 rd Street S. to the north, Crystal Drive to the east, 26 th Street S. to the south, and S. Clark Street to the west. The site plan includes the buildings west of S. Clark Street and east of Jefferson Davis Highway (US Route 1). The site is zoned C-O, Mixed Use District. The site is designated on the General Land Use Plan (GLUP) as High Office-Apartment-Hotel. SP #65 and SP65-U-16-1 Site Plan Amendment and Use Permit - 2 -

Neighborhood: The site is located in the Crystal City Civic Association; adjacent to Aurora Highlands Civic Association and within the Crystal City Business Improvement District. Figure 2: Street View (Note: Proposed Conversion Behind Bar Louie) Source: Bing Maps 2018 DISCUSSION: The applicant proposes a site plan amendment to convert office and retail gross floor area to include retail, arcade, bowling alley and accessory uses, including restaurant uses and a use permit to allow for an arcade, bowling alley, restaurant and accessory uses (Bowlero). Site Plan Amendment: House, the property owner of the Buchanan apartment building, requests a site plan amendment to convert 51,552 square feet of gross floor area on the ground floor of the building. The site plan amendment is necessary to convert office and retail gross floor area on the ground floor of the building to permit retail, arcade, bowling alley and restaurant uses, as arcades and bowling alleys are not considered retail uses, according to the Arlington County Zoning Ordinance. This area was previously part of the Buchanan Mall and was once entirely retail and then converted to office. SP #65 and SP65-U-16-1 Site Plan Amendment and Use Permit -4-

Clark Street Source: CPHD The proposed site plan amendment will convert space in the interior of the Buchanan apartment building that is currently used for office space to retail and restaurant uses, and further expand the permitted uses of the space to include a bowling alley (which is classified by the Zoning Ordinance as an Indoor Recreation use) and a video game arcade (which is classified by the Zoning Ordinance as an Entertainment use). Conversion of the space to permit retail and restaurant uses, as well as the additional proposed uses as a bowling alley and arcade will help fulfill the goals of the Arlington County Retail Plan. Although arcades and bowling alleys are not considered retail uses by the Zoning Ordinance, the subject location is located on a gold street per the Retail Plan where retail, restaurant and entertainment uses are permitted and considered suitable uses for the area (see Figure 3). In addition, the proposed location along 23rd Street is located in the center of what the Crystal City Sector Plan designates as the Entertainment District of Crystal City. The Entertainment District of Crystal City envisions a robust and active restaurant and retail experience (p.38). The proposed expansion of uses to include a bowling alley and arcade, along with restaurant and retail uses, will help to fulfill the goal of the Sector Plan to provide various cultural and civic facilities and uses for all age groups, and strategically locate them near transit centers, public spaces, and restaurants to promote those venues and help define neighborhood centers Furthermore, the developer agrees to meet the Crystal City Sector Plan requirements for retail window transparency along 23 rd Street to achieve a minimum transparency of 80 percent for the area between three (3) and eight (8) feet above sidewalk grade. Overall, the applicant is proposing to maintain a total transparency of approximately 80 percent measured over the entire SP #65 and SP65-U-16-1 Site Plan Amendment and Use Permit - 5 -

retail storefront, allowing for the existing masonry in the building façade, as the developer does not propose to renovate the exterior facade of the building. Use Permit: Bowlero, a global chain of arcade and bowling alleys, proposes a new location in apartment building, which will offer an arcade, bowling alley, restaurant and accessory uses, which include storage and restroom facilities. According to the Arlington County Zoning Ordinance, a use permit is required for a bowling alley and arcade use in the C-O zoning district. The following details the proposed use and provides staff assessments of the use: PROPOSED USE: Type of Use: Hours of Operation: ASSESSMENT: Arcade, bowling alley, restaurant and accessory uses 11 a.m. to 2:30 a.m.; Monday to Friday and 10 a.m. to 2:30 a.m.; Saturday and Sunday Department of Environmental Services (DES): DES is in support of the proposal. The site is within walking distance of the Crystal City Metro Station, with adequate street parking, as well as an existing 1,000-space parking garage located below, which is available to retail tenants and patrons who may drive. The vestibule is a new entrance/exit for the combined retail and office space. CPHD, Planning: County agencies have not identified any issues with the proposed conversion and staff supports the expansion of use. The proposed use is in compliance with the applicable policies of the General Land Use Plan, other County plans and policies, and the Arlington County Zoning Ordinance. Although what Bowlero is proposing is a new type of use in Arlington, the use is most akin to a live entertainment use and the proposed conditions will follow the typical live entertainment use permit conditions. The applicant has agreed to comply with the proposed hours of operation (as listed above), designate a community liaison for residents of the Buchanan apartment building and adjacent areas, and offer TIPS (Training for Intervention Procedures) to all staff serving alcohol to customers. With the conditions in place, staff believes the proposed use permit will: a) not adversely affect the health or safety of persons residing or working in the neighborhood; b) be detrimental to the public welfare or injurious to property or improvements in the neighborhood; and c) is not in conflict with the purposes of the master plans of the County. PUBLIC ENGAGEMENT: Level of Engagement: Communicate This level of engagement is appropriate because the implementation and operation of the proposed use is not anticipated to adversely impact the neighborhood. Outreach Methods: Public notice was given in accordance with the Code of Virginia 15.2-2204. Notices of the County Board hearing on the site plan amendment and use permit were placed in the January 1, 2019 and January 8, 2019 issues of the Washington Times for the January 26, 2019 County Board Meeting. In addition to the above legal requirements: Individual letters outlining the project description and public hearing details were mailed to surrounding property owners of the subject property. Placards were placed in various locations surrounding the subject property within seven (7) days of the public hearing. Civic associations were informed of the application via email communication. The subject property is located within the Crystal City Civic Association, adjacent to the Aurora Highlands Civic Association and within the Crystal City Business Improvement District. Community Feedback: Crystal City Civic Association (CCCA): Staff contacted CCCA and they are in support of the proposal. Aurora Highlands Civic Association (AHCA): Staff reached out to the AHCA for comment on the subject applications, but no response has been received as of the date of this report. Crystal City Business Improvement District: Staff reached out to the Crystal City BID for comment on the subject applications, but no response has been received as of the date of this report. CONCLUSION: The site plan amendment for the proposed conversion to a bowling alley and arcade would fulfill the goals of the Crystal City Sector Plan and Arlington County Retail Plan. Overall, the proposed conversion of space will increase the livelihood of the area, provide diverse cultural and civic facilities to a vast array of demographics and will be an overall quality addition to Crystal City. Staff also supports the proposed use permit, as it complies with the regulations of the C-O zoning district and is conveniently located in a retail-equipped environment in Crystal City within close vicinity to transit and parking options. With the conditions as proposed, the use is not anticipated to adversely affect the health or safety of persons residing or working in the neighborhood and will not be in conflict with the purposes of the master plans of the County. Therefore, staff recommends approval of the attached ordinance to approve the site plan amendment to convert the uses permitted on the ground floor of the building, subject to the previously approved conditions and proposed Conditions #9 and #10; and approval of the subject use permit to allow the uses on the ground floor of the existing building to include an arcade and bowling alley, along with restaurant and accessory uses, subject to the conditions of the staff report, with a County Board review in one (1) year (January 2020). Proposed Use Permit Conditions: 1. The applicant agrees to comply, by way of illustration and not limitation, with all applicable requirements of County Ordinances and State statutes, including the laws and SP #65 and SP65-U-16-1 Site Plan Amendment and Use Permit - 8 -

regulations enforced by Virginia State Code, and the Fire Marshal, the Police Department and the Virginia Alcohol Beverage Control Board (ABC). 2. The applicant agrees that the permitted hours of operation open to customers shall be from 11 a.m. to 2:30 a.m., Monday through Friday and from 10 a.m. to 2:30 a.m., Saturday through Sunday. 3. The applicant agrees to comply the Arlington County Code Chapter 15, Noise Control, as may be amended, and further agrees to keep the restaurant s windows and doors closed, except for the purposes of entry, egress, and other intermittent uses. 4. The applicant further agrees that under no circumstances shall there be any broadcasting to the activities held inside and outside of the building. The applicant agrees that doors shall not be propped open during the hours of operation. 5. The applicant agrees to provide, to all staff serving alcohol to customers, TIPS (Training for Intervention Procedures) or similar certification. All staff serving alcohol to customers shall receive certification. 6. The applicant agrees to clean the sidewalk in front of its establishment each morning, including sweeping and picking up cigarette butts and litter, which may have accumulated overnight. 7. Bowlero agrees to designate and make available a neighborhood liaison to communicate with nearby residents and neighbors to address concerns which may be any concerns by the use and an on-site liaison that shall be available during the hours of the business operation to receive and respond to community concerns. The name, telephone number, and e-mail address (if applicable) shall be submitted to the Zoning Administrator and a copy sent to apartments and the Crystal City Civic Association. SITE PLAN AMENDMENT ORDINANCE WHEREAS, an application for a Site Plan Amendment dated October 9, 2018, for Site Plan #65, was filed with the Office of the Zoning Administrator; and WHEREAS, as indicated in Staff Report prepared for the January 26, 2019, County Board meeting and through comments made at the public hearing before the County Board, the County Manager recommends that the County Board approve the Site Plan Amendment subject to numerous conditions as set forth in the Staff Report; and WHEREAS, the County Board held a duly-advertised public hearing on that Site Plan Amendment on January 26, 2019, and finds, based on thorough consideration of the public testimony and all materials presented to it and/or on file in the Office of the Zoning Administrator, that the improvements and/or development proposed by the Site Plan; Substantially complies with the character of master plans, officially approved neighborhood or area development plans, and with the uses permitted and use regulations of the district as set forth in the Zoning Ordinance; and Functionally relates to other structures permitted in the district and will not be injurious or detrimental to the property or improvements in the neighborhood; and Is so designed and located that the public health, safety and welfare will be promoted and protected. NOW THEREFORE, BE IT ORDAINED that, as originally requested by an application dated February 17, 1968 for Site Plan #65, and as such application has been modified, revised, or amended as set forth in the Zoning Administration records include the drawings, documents, conditions and other elements designated in Condition 1 and 2 below ( which drawing, etc are hereafter collectively referred to as Revised Site Plan Application ), for a Site Plan Amendment to convert approximately 51,552 square feet of office and retail gross floor area to retail, arcade, bowling alley and accessory uses, including restaurant uses, for the parcel of real property known as RPC #34-020-030 and 320 23 rd St S. approval is granted and the parcel so described shall be used according the Site Plan Amendment as originally approved on February 17, 1968 and amended from time to time as shown in the records of the Office of Zoning administration, and as amended by the Revised Site Plan Application, subject to all previously approved conditions for SP #65 and the following new conditions that, notwithstanding the numbering, do not replace all existing site plan conditions as of January 26, 2019: 1. The applicant agrees that the 51,552 square feet of space shown on the plans dated October 9, 2018, prepared by Bowlero Arlington, and entitled Bowlero Crystal City Test Fit may be used for the purposes of this conversion to an arcade and bowling alley, as well as retail, restaurant and accessory uses. 2. The applicant agrees that all windows fronting on 23 rd Street South associated with Bowlero shall provide a minimum of 80 percent transparency for the area between 3 and 8 feet above sidewalk grade, exclusive of the existing masonry on the facade. If the SP #65 and SP65-U-16-1 Site Plan Amendment and Use Permit - 10 -
