ELGIN COMMUNITY COLLEGE FACULTY ASSOCIATION CONSTITUTION AND BYLAWS AS AMENDED AUGUST 20, 2009, AUGUST 17, 2017, AUGUST 16, 2018, and JANUARY 10, 2019. Article I NAME AND AFFILIATION Sectin 1. The name f this rganizatin is Elgin Cmmunity Cllege Faculty Assciatin and hereinafter in this cnstitutin is designated as ECCFA r the Assciatin. Sectin 2. ECCFA is affiliated with and participates actively in the American Federatin f Teachers, Illinis Federatin f Teachers, the Illinis State Federatin f Labr, Chicag Federatin f Labr-Industrial Unins Cuncil, Elgin Federatin f Labr, and the AFL-CIO. Article II PURPOSE ECCFA is a prfessinal assciatin f cllege educatrs emplyed by Elgin Cmmunity Cllege, District N. 509 f the State f Illinis and is authrized by its cnstitutin t engage in any and all activities that prmte educatinal prcesses and the welfare f its members. As the representative f the faculty f Elgin Cmmunity Cllege, it seeks t effectively serve the educatinal needs f the residents f Cmmunity Cllege District N. 509 by identifying and slving educatinal prblems, by encuraging educatinal innvatin, and by prmting and striving fr a harmnius wrking relatinship with the administratin and Bard f Trustees f Elgin Cmmunity Cllege. Article III OBJECTIVES Sectin 1. T prmte within faculty the highest type f prfessinalism. Sectin 2. T encurage active participatin f all faculty in the slutin f cllege prblems and cmmunity needs. Sectin 3. T defend the rights and respnsibilities f academic freedm. Sectin 4. T prmte faculty participatin in educatinal management. Sectin 5. T secure and maintain adequate salaries and wrking cnditins. 2 f 14

Sectin 6. T supprt tenure, sabbatical leave, retirement plicies, and ther plicies that encurage the highest level f faculty perfrmance. Sectin 7. T represent faculty in a cntinuing review and revisin f cllege plicy. Sectin 8. T suggest new plicy r request statements f plicy frm apprpriate grups. Sectin 9. T cmmunicate the psitin f faculty t the public, students, administratin, and Bard f Trustees f Cmmunity Cllege District N. 509. Article IV MEMBERSHIP Sectin 1. ECCFA membership is pen t all full-time and eligible adjunct faculty wh pay dues. Sectin 2. Full-time faculty and eligible adjunct faculty chsing nt t jin the Assciatin are designated nn-members (under Article II Sectin 2.10 f the ECCFA Agreement) shall nt have vting privileges, hld ffice, r be eligible fr ECCFA Senate membership: hwever such individuals are members f the bargaining unit and maintain all f the right and respnsibilities named in the Cntract. Sectin 3. Full time and adjunct faculty retirees wh were members f ECCFA at the time f retirement can jin a retiree chapter f ECCFA r frm ne if ne des nt exist. Such chapter - frm nw n, "the retiree chapter" - defines its wn cnstitutin and bylaws. Hwever, n actin, bylaw r prvisin f the retiree chapter shall be in cnflict with plicies and decisins f the membership r the Senate f ECCFA. The plicies and decisins f the membership r the Senate f ECCFA shall take precedence when a pssible cnflict arises with the actins, bylaws, r prvisins f the retiree chapter. As such, the initial cnstitutin and bylaws f the retiree chapter must be presented t the Senate f ECCFA fr apprval prir t the retiree chapter taking effect. A member f the retiree chapter shall be knwn as "retiree member." The sle vting rights within ECCFA f retiree members are prvided in Article VII, Sectin 1(b), f this Cnstitutin. ECCFA is cmmitted t facilitate cmmunicatins between the AFT, the IFT, and the retiree chapter. 3 f 14

The dues wed by the retiree chapter t ECCFA are apprved by the senate f ECCFA after cnsultatin with the treasurer f ECCFA and the retiree chapter, as per Article I, sectin 6(h)(i) f the bylaws f ECCFA. Article V OFFICERS AND STAFF Sectin 1. There are six fficers (President, First Vice-president, Secnd Vicepresident, Third Vice-president, Secretary, and Treasurer), a Cmmunicatins Liaisn, a Sentinel editr, a Membership Crdinatr, a Webmaster, Vlunteer Crdinatr, and a Parliamentarian, all f whm must be full members f ECCFA. Sectin 2. The President is elected t a tw-year term by a plurality f vtes cast by the ECCFA membership. The newly elected President assumes ffice at the first Senate meeting after the electin. A President may succeed herself/himself. Sectin 3. The First Vice-president is a Senatr frm the full-time faculty. The Secnd Vice-president is a Senatr frm the Unit Adjunct Faculty II. The Third Vice-president is a Senatr frm either the Unit Adjunct Faculty I r the Unit adjunct Faculty II if n UAF1 is available. The Secretary is a full member f the ECCFA. The Treasurer is a full member f the ECCFA. The First Vice-president, Secnd Vice-president, Third Vice-president, Secretary, and Treasurer are elected t ne-year terms by a plurality f the Senatrs present and vting. They are seated immediately after their electin. Sectin 4. The Cmmunicatin Liaisn, Sentinel editr, the Membership Crdinatr, Webmaster, Vlunteer Crdinatr, and Parliamentarian are appinted by the President, with Senate apprval, t a ne-year term and seated immediately after the appintment. Sectin 5. In additin, the Senate may elect representatives t any state and/r natinal rganizatin with which ECCFA is affiliated. NOTE: Fr dates and prcedures, see Bylaws Article IV: Electins. Article VI POWERS AND AUTHORITY OF THE SENATE Sectin 1. Members f ECCFA empwer the Senate t act as their representative and t cmmunicate directly with the cllege administratin and Bard f Trustees in all matters. Sectin 2. The Senate establishes plicy fr ECCFA as directed by the membership, supervises activities f all faculty cmmittees invlved in 4 f 14

gvernance, negtiatins, welfare, prfessinal develpment, electins, and the day-t-day peratin f ECCFA. Sectin 3. The Senate has the authrity t establish stipends fr its fficers and members. Article VII MEMBERSHIP AND DUTIES OF THE SENATE Sectin 1. Membership: a. Senatrs are elected, during annual Senate electins in April, by ECCFA members. Full-time faculty members elect Senatrs in their respective divisins. Each divisin is entitled t ne Senatr per ten (10) faculty (runded t the nearest ten)*. Unit adjunct faculty II members are entitled t ne Senatr per twenty (20) actively teaching unit adjunct members (runded t the nearest twenty)*. Unit adjunct faculty I members are entitled t ne Senatr per frty (40) actively teaching unit adjunct I members (runded t the nearest frty)*. The cunt f actively teaching unit adjunct II and unit adjunct I members is determined by the secnd mnth f each academic semester. *(5 shall be runded up) b. Members f the retiree chapter are entitled t ne Senatr. Such Senatr is entitled t all rights and privileges f a Senatr except that such senatr shall nt be entitled t hld ffice utside f psitins within the retiree chapter. c. The term f ffice fr a Senatr is tw years, beginning at the first Senate meeting fllwing the April electin. Sectin 2. The duties f the Senate are: a. T serve as an agency thrugh which any member f the faculty, administratin, r any cmmittee may intrduce matters invlving faculty gvernance and educatinal prgrams fr cnsideratin; b. T serve as a bdy t appint, apprve and/r prvide fr the electin f faculty n standing r ad hc cmmittees; c. T receive and evaluate reprts frm its standing and ad hc cmmittees and t submit reprts passed by a majrity Senate vte r a membership vte t the Bard f Trustees r apprpriate administrative rganizatin(s) and t prpse actin relative t thse reprts; d. T rganize and supervise the rle f faculty in negtiatin f cntractual matters and plicies affecting wrking cnditins and educatinal prgrams f the cllege; 5 f 14

e. T make recmmendatins t the administratin and/r Bard f Trustees in the frmulatin f plicies and prcedures; Sectin 3. The duties f the Senatrs are: a. T advise faculty f actins taken by the Senate; b. T infrm faculty f actins taken by the Bard f Trustees, cllege President, r administratin n recmmendatins made by the Senate in s far as the Senate can be aware f thse actins. Article VIII Cmmittees: There are three types f cmmittees; Standing, Ad Hc and Negtiatins. Sectin 1. Standing cmmittees are: Grievance, Academic Affairs, and Sick Bank. a. Standing cmmittee members are elected annually by ECCFA members frm each divisin. Each divisin is represented by ne faculty member. Fr the purpses f cmmittee representatin, Cunseling, Learning Resurces and Pre-Cllegiate are cnsidered ne divisin, Unit Adjunct Faculty II shall be cnsidered ne divisin and Unit Adjunct Faculty I shall be cnsidered ne divisin. b. Standing cmmittees are elected in April and hld their first meeting n later than Octber 15. The term fr a standing cmmittee member is tw years, fllwing the April electin. The standing cmmittee chairpersn is elected by cmmittee membership. Sectin 2. Ad hc cmmittees are appinted by the Senate President upn apprval f a majrity f the Senatrs. Ad hc cmmittees will cnsist f, but nt be limited t the fllwing: a. Electins Electins Chair plus ne full-time, ne Unit Adjunct II and ne Unit Adjunct I faculty. b. Amendments Amendments Chair plus ne full-time, ne Unit Adjunct II and ne Unit Adjunct I faculty. Sectin 3. Negtiatin Cmmittee: At the request f the First Vice-President, a negtiatin cmmittee will be elected. The negtiating cmmittee will serve until a new cmmittee is elected. Membership f the Negtiatin Cmmittee will cnsist f, but nt be limited t the fllwing: First VP as chair, Secnd VP, Third VP, the Cmmunicatins Liaisn, ne member elected frm each divisin, and any ther persn the Senate deems necessary. 6 f 14

Article IX AMENDMENTS TO CONSTITUTION Sectin 1. All amendments must be submitted t the Senate Amendments Cmmittee chair prir t the last regularly scheduled Senate meeting preceding a general membership meeting. Sectin 2. Amendments may be submitted by individual ECCFA members r cmmittees. Sectin 3. Amendments t the cnstitutin are adpted by a tw-thirds affirmative vte f ECCFA members attending a general membership meeting. Sectin 4. The President, upn recmmendatin f the Senate r Senate Amendments Cmmittee, may call a special general membership meeting fr the cnsideratin and vte n amendments t the cnstitutin. Article X PARLIAMENTARY PROCEDURE Rberts' Rules f Order (Revised) shall gvern all meetings. BYLAWS Article I DUTIES OF THE OFFICERS OF THE SENATE Sectin 1. The President in cperatin with ther fficers: a. calls and chairs meetings f ECCFA; b. plans meeting agenda with the advice f the Senate; c. represents ECCFA t the Bard f Trustees and administratin and ther nn-faculty grups r appints ther persns t represent ECCFA; d. makes appintments with apprval f the Senate; e. submits all petitins f faculty cncern t all members f ECCFA fr cnsideratin and fllws membership directin as reflected in vtes, in wrking tward the reslutin and/r implementatin f thse cncerns; f. tgether with ther fficers, the President keeps the membership f ECCFA infrmed f matters f faculty cncern; g. appints his/her substitute t attend meetings r particular functins n thse ccasins that the President r a Vice-President cannt be present; 7 f 14

h. serves as an ex-ffici member f the grievance and negtiatins cmmittees; i. shall be a delegate t the IFT and AFT cnventins. Sectin 2. The First Vice-President in cperatin with ther fficers: a. perfrms duties f the President when the President cannt attend an Assciatin, Senate, r ther meeting; b. initiates faculty activity fr cntract negtiatins in ample time fr negtiatins t take place; c. facilitates the distributin f infrmatin and materials t Fulltime Faculty members; d. prepares cnstituent lists fr all Fulltime Faculty senatrs. Sectin 3. The Secnd Vice-President in cperatin with ther fficers: a. perfrms duties f the President when the President and First Vicepresident cannt attend an Assciatin, Senate, r ther meeting; b. reprts t the Senate the issues and cncerns f Unit Adjunct Faculty II; c. wrks with the Membership Crdinatr and Human Resurces t identify adjunct faculty wh qualify fr membership as UAFII; d. facilitates the distributin f infrmatin and materials t Unit Adjunct Faculty II members; e. assists the Unit Adjunct Faculty II Senatrs in cmmunicatin with the membership and acts as a cntact persn fr Unit Adjunct Faculty II with questins r cncerns; f. prepares cnstituent lists fr all Unit Adjunct Faculty II senatrs. Sectin 4. The Third Vice-President in cperatin with ther fficers: a. perfrms duties f the President when the President, First Vicepresident, and the Secnd Vice-president cannt attend an Assciatin, Senate, r ther meeting; b. reprts t the Senate the issues and cncerns f Unit Adjunct Faculty I; 8 f 14

c. wrks with the Membership Crdinatr and Human Resurces t identify adjunct faculty wh qualify fr membership as UAFI; d. facilitates the distributin f infrmatin and materials t Unit Adjunct Faculty I members; e. assists the Unit Adjunct Faculty I Senatrs in cmmunicatin with the membership and acts as a cntact persn fr Unit Adjunct Faculty I with questins r cncerns; f. prepares cnstituent lists fr all Unit Adjunct Faculty I senatrs. Sectin 5. The Secretary in cperatin with ther fficers: a. recrds the minutes f all ECCFA and Senate meetings and distributes thse minutes t the senatrs a minimum f 5 days prir t the next senate meeting; b. assists with distributin f infrmatin cncerning ECCFA and/r the Senate as directed by the President r Senate; c. maintains recrds and files f all ECCFA matters ther than finances; d. receives all petitins frm ECCFA members, ther than thse fr an elective ffice, r an amendment t the Cnstitutin, fr submissin t the Senate; e. prepares and maintains a calendar f imprtant dates, such as frthcming electins, and keeps faculty infrmed f the calendar. 9 f 14

Sectin 6. The Treasurer in cperatin with ther fficers: a. submits mnthly financial reprts t the Senate; b. prepares a budget and maintains cmplete financial recrds f ECCFA; c. maintains the rganizatin s bank accunts; d. initiates an annual audit f the rganizatin s financial recrd; e. pays bills as authrized by the senate; f. presents bi-annual financial reprts t the general membership; g. develp, review, and recmmend changes t Financial Management Prcedures as necessary t supprt the rganizatin s financial practices and peratinal cntrls; h. cmputes and estimates csts that ECCFA will sustain fr, r because f, the retiree chapter; i. recmmends t the Senate f ECCFA, in cperatin with the retiree chapter, the dues fr the retiree chapter. Article II DUTIES OF Cmmunicatins Liaisn, Sentinel editr, Membership Crdinatr, Webmaster, Vlunteer Crdinatr, and Parliamentarian f the Senate. Sectin 1. The Cmmunicatin Liaisn: a. attends Senate meetings regularly issues press releases as directed by the Senate President r Chief Negtiatr; b. acts as fficial Senate spkespersn t the press; c. assists in prmting the public image f ECCFA. Sectin 2. Sentinel Editr attends Senate meetings regularly and versees editing, printing and distributin f The Sentinel. Sectin 3. Membership Crdinatr: a. attends Senate meetings regularly and reprts the status f all unit members and nn-members; b. wrks with Human Resurces t cllect infrmatin t maintain and update the ECCFA membership database; c. wrks with Human Resurces t identify faculty wh qualify fr membership; d. distributes membership packets t qualifying faculty; 10 f 14

e. crdinates the recruitment f new members f ECCFA. Sectin 4. The Webmaster: a. attends Senate meetings regularly b. maintains the fficial ECCFA website; c. archives Senate/ECCFA meeting minutes, Sentinel issues and majr ECCFA related dcuments t the website; d. cllects infrmatin fr the website frm the membership; e. reprts ECCFA related business and infrmatin n the website; f. respnds t e-mail that is cmmunicated thrugh the website. Sectin 5. Article III Duties f the Senatrs Sectin 1. Attendance at Senate meetings a. A Senatr may arrange t have a substitute frm his/her divisin attend a Senate meeting that he/she is unable t attend. b. If a Senatr misses tw cnsecutive duly called meetings, the Senate President may, with the apprval f the senate, replace that Senatr Sectin 2. Cmmunicatin with cnstituents a. maintains cnsistent cntact with cnstituents face-t-face, in writing, and electrnically b. disseminate infrmatin frm the Senate c. gather respnses frm cnstituents t issues, etc. d. request agenda space at a frthcming fr items brught t him/her by any cnstituent 11 f 14

Article IV DUTIES OF ECCFA COMMITTEES Sectin 1. Standing Cmmittees a. The Grievance Cmmittee initiates actin, in accrdance with the grievance prcedure, f any claim by the entire ECCFA r an individual member, that there has been a vilatin, misrepresentatin, r misapplicatin f the terms f the current cntract. b. The Academic Affairs Cmmittee reviews then reprts t the Senate issues and decisins related t academic plicies and prcedures. c. The Sick Bank Cmmittee wrks with Human Resurces t review Sick Bank requests and grants sick days t qualified applicants in accrdance with established Sick Bank guidelines. Sectin 2. Ad Hc Cmmittees a. The Schlarship Cmmittee is appinted by the Senate President with Senate apprval each year in February. It supervises the disbursement f faculty spnsred schlarships. b. The Electins Cmmittee is appinted by the Senate each year t cnduct ECCFA s electins. The Cmmittee is respnsible fr receiving electin nminatins, preparing ballts, recruiting judges, cllecting and tallying ballts and reprting the results t the Senate fr cnfirmatin. c. The Amendments Cmmittee ensures all prpsed changes t the Cnstitutin and Bylaws are prperly submitted t the members f ECCFA and vted n as specified by Article IX f the Cnstitutin. Sectin 3. The Negtiating Cmmittee prepares fr, negtiates and prvides versight f the bargaining agreement fr the membership and appints a faculty team t serve as spkespersns fr cntract deliberatins. Article V PROCEDURES FOR THE SENATE Sectin 1. The schedule fr Senate meetings is determined by the Senate at the beginning f each semester. The Faculty is infrmed f the meeting schedule. Sectin 2. The Senate schedules a full faculty meeting at the beginning f each semester. Sectin 3. Additinal general faculty meetings may be called as needed. 12 f 14

Sectin 4. A qurum fr Senate meetings is a majrity f the authrized membership at that time (fr ten members, six wuld be a qurum). Sectin 5. A plurality f affirmative vtes is required t pass mtins and/r apprve actin. All Senatrs have an equal vte. Sectin 6. When the Senate presents issues fr a vte by the full ECCFA membership, the utcme is determined by a plurality f affirmative vtes cast. Unit Adjunct II and Unit adjunct I member's have full vting privileges. Sectin 8. The Senate will respnd t any petitin signed by twenty percent f ECCFA membership and submitted t the Senate Secretary. Sectin 9. Senate meetings are pen t all current and retired ECCFA members. Sectin 10. The Senate may invke the right f clsed sessin when the privacy f a faculty member wuld be vilated by the anticipated discussin. Sectin 14. Prcedures fr cnducting Summer business will be established by the Senate each year during the last meeting in May. Sectin 15. Official ECCFA/Senate business may be cnducted by e-mail including: Article VI ELECTIONS a. the cmmunicatin f fficial ECCFA/Senate business. b. the casting f vtes regarding fficial Senate business. The vting guidelines established in Article V, Sectin 5 and 6 f the ECCFA Bylaws will apply t e-mail vtes. c. the nminatin f ECCFA members t psitins f service. Sectin 1. Electins fr Senatrs must be cmpleted prir t April 30, f each year. Sectin 2. If the President resigns prir t March 1, and the psitin f First Vicepresident is thereby vacated by successin, a special electin is held fr anther Senatr in the apprpriate divisin. A new First Vice-president is then elected by the Senate. The same prcedure is used t fill vacancies in the ffices f the Secnd Vice-president, Third Vice-president, Secretary r Treasurer if the ffice is vacated fr any reasn. 13 f 14

Sectin 3. If a senate r elected cmmittee seat is vacant, the President may, with the apprval f the Senate, appint a member frm the apprpriate divisin t fill the vacancy until the next general electin. Sectin 4. All electins are cnducted by the Electins Cmmittee. Sectin 5. Absentee Ballting a. Absentee Ballts shall be published by the electins cmmittee fllwing the clsing f nminatins. b. Absentee ballts, which may be electrnic, shall be available fr distributin t the ECCFA membership ne week prir t the scheduled electin dates in April. c. Absentee ballts must be returned t the chair f the Electins Cmmittee r his/her designee nt later than the clse f the scheduled electin dates in April; Absentee ballts received after that time will be cnsidered spiled and will nt be used in the ttal cunt f vtes cast. Article VII FINANCES ECCFA Dues and budget are apprved by ECCFA members at the first general membership meeting f the academic year. Article VIII AMENDMENTS TO BYLAWS Sectin 1. All amendments must be submitted t the Senate Amendments Cmmittee prir t the last regularly scheduled Senate meeting preceding a general membership meeting. Sectin 2. Amendments can be submitted by an individual ECCFA member r cmmittees. Sectin 3. Amendments t the Bylaws are adpted by a tw-thirds affirmative vte f ECCFA members present and vting at a general membership meeting. Sectin 4.The President, upn recmmendatin f the Senate OR Senate Amendments Cmmittee, may call a special general membership meeting fr the cnsideratin and vte n amendments t the bylaws. 14 f 14
