H-1 ORDINANCE NO. 2018- WATER AND SEWER UTILITY CAPITAL ORDINANCE APPROPRIATING $175,000 FROM CAPITAL SURPLUS FOR THE REHABILITATION OF THE FAIRVIEW WELL BY THE, IN THE COUNTY OF ESSEX, NEW JERSEY BE IT ORDAINED BY THE TOWNSHIP COUNCIL OF THE, IN THE COUNTY OF ESSEX, NEW JERSEY AS FOLLOWS: SECTION 1. The Township of Verona, in the County of Essex, New Jersey (the Township ) hereby appropriates $175,000 fully funded by Capital Surplus from the Water and Sewer Utility Fund, for the Rehabilitation of the Fairview Avenue Well. SECTION 2. The Township hereby certifies that it has adopted a capital budget or a temporary capital budget, as applicable. The capital or temporary capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with the adopted capital or temporary capital budget, a revised capital or temporary capital budget has been filed with the Division of Local Government Services. SECTION 3. This ordinance shall take effect after final adoption and publication and otherwise as provided by law. J-1 RESOLUTION No. 2018- A motion was made by ; seconded by that the following resolution be adopted: CERTIFICATION OF ANNUAL AUDIT WHEREAS, N.J.S.A.40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions; and WHEREAS, the Annual Report of Audit for the year 2017 has been filed by a Registered Municipal Accountant with the Township of Verona pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and WHEREAS, R.S. 52:27BB-34 authorized the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, at a minimum, the sections of the annual audit entitled, Comments and Recommendations; and WHEREAS, such resolution of certification shall be adopted by the governing body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and WHEREAS, all members of governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit: R.S. 52:27BB-52: A local officer of member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Division of Local Government Services), under the provisions of this Article, shall by guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000) or imprisoned for not more than one year, or both, in addition shall forfeit his office. NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Verona, in the County of Essex, New Jersey, hereby affirms compliance N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to the Local Finance Board to show evidence of said compliance. J-2 RESOLUTION No. 2018- A motion was made by ; seconded by that the following resolution be adopted: APPROVING THE CORRECTIVE ACTION PLAN FOR THE 2017 MUNICIPAL AUDIT WHEREAS, the Township of Verona has received a report of audit for the year ending December 31, 2017; and WHEREAS, Local Finance Notice No.92-15 dated July 8, 1992 requires that the Chief Financial Officer submits a Corrective Action Plan for all findings in the audit within 60 days of receipt of the Report of Audit; and WHEREAS, the Chief Financial Officer has prepared a Corrective Action Plan relating to the findings of the 2017 Audit. NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Verona, in the County of Essex, New Jersey, does hereby approve the Corrective Action Plan for the year 2017 as submitted by the Chief Financial Officer. BE IT FURTHER RESOLVED that the Township Clerk is hereby directed to forward a copy of this resolution and the Corrective Action Plan to the Director of the Division of Local Government Services. The appropriation amounts associated with the Capital Projects under each of the following Bond Ordinances are funded as of the date hereof and are hereby cancelled as of the date of this Resolution: SECTION 2. J-4 RESOLUTION No. 2018- A motion was made by ; seconded by that the following resolution be adopted: AUTHORIZING THE CREATION OF A CHANGE FUND FOR THE SWIMMING POOL UTILITY WHEREAS, from time to time the Swimming Pool Utility is required to make change for cash payments received; and WHEREAS, there exists a need to maintain such a fund for use of operation of the Swimming Pool Utility WHEREAS, New Jersey State regulations allow change funds to be established by an initial resolution and to continue from year to year without additional governing body action until such time as they take action to have funds returned; and WHEREAS, such fund will allow for easy separation of accounts. NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Verona, in the County of Essex, New Jersey that a change fund be authorized and created for the Swimming Pool Utility to an amount not the exceed one hundred dollars ($100) for the purpose of making change to insure the proper exact payment due is paid. BE IT FURTHER RESOLVED that said change fund be safely secured in keeping with established prudent business practices. BE IT FURTHER RESOLVED that said change fund be used to make change only and shall not be used to purchase good and/or services of any kind. BE IT FINALLY RESOLVED that the Chief Financial Officer is hereby authorized to issue the change funds in the amount of one hundred dollar ($100.00) for use set forth in the resolution. J-5 RESOLUTION No. 2018- A motion was made by ; seconded by that the following resolution be adopted: RESOLUTION AUTHORIZING THE VERONA TOWNSHIP TAX COLLECTOR TO PREPARE AND MAIL ESTIMATED TAX BILLS IN ACCORDANCE WITH P.L 1994, C.72 WHEREAS, the State of New Jersey has not certified Municipal and County Budgets as of this date, and WHEREAS, as a result thereof, the Essex County Board of Taxation is unable to verify Verona s tax rate and the Verona Township Collector will be unable to mail the Township s 2018 tax bills on a timely basis; WHEREAS, the Tax Collector has computed an estimated tax levy in accordance with N.J.S.A 54:4-66.3, and has signed a certification showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies. NOW THEREFORE BE IT RESOLVED, that the Township Council of the Township of Verona, in the County of Essex, State of New Jersey as follows: ROLL CALL: AYES: NAYS: ABSENT: ABSTAIN: 1. The Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for the Township for the third installment of 2018 taxes. The Tax Collector shall proceed and take such actions as are permitted and required by P.L. 1994, c. 72 (N.J.S.A 54:4-66.2 and 54:4-66.3). 2. The entire estimated tax levy for 2018 is hereby set at $63,853,923.83. 3. The Estimated tax rate (based on estimated levy) is hereby set at $3.159. 4. In accordance with law, the third installment of 2018 taxes shall not be subject to interest until the later of August 10 or the twenty-fifth calendar day after the date the estimated tax bills were mailed. The estimated tax bills shall contain a notice specifying the date on which interest may begin to accrue. THIS IS TO CERTIFY THAT THE FOREGOING IS A TRUE AND EXACT COPY OF A RESOLUTION ADOPTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF VERONA AT THE REGULAR MEETING HELD ON JUNE 11, 2018.

J-6 RESOLUTION No. 2018- A motion was made by ; seconded by that the following resolution be adopted: PERMITTING ITEMS TO BE DISCUSSED IN EXECUTIVE SESSION WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975, permits the exclusion of the Public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exists. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Verona, County of Essex, State of New Jersey, as follows: 1. The public shall be excluded from discussion of an action upon the hereinafter specified subject matter. 2. The general nature of the subject matter to be discussed is as follows: a. Pending Litigation pursuant to N.J.S.A. 10:4-12(7) b. Contract Negotiations pursuant to N.J.S.A. 10:4-12(8) c. Personnel Matters pursuant to N.J.S.A. 10:4-12(8) 3. It is anticipated at this time that the above stated subject matter will be made public when said subject has been fully discussed by the Council, and the attorney rules this matter may be brought before the public without jeopardizing any pending litigation. 4. This resolution shall take effect immediately.
