MINUTES OF MEETING COMMON PROPERTY AND FOREST COMMITTEE June 7, 2010 The regularly scheduled meeting of the Common Property and Forest Committee was held on June 7, 2010, at 1:30 P.M. in the Conference Room of the POA Building. Those attending were: Dan Webb, Chairman David Cohen Steve Romine Fred Jonas Ruth Kosoglow Beverly Thompson Bruce Caverly Jim Owens, Liaison Jeff Meek, Village Voice Brenda Pate, Secretary Steve White, Director I. INTRODUCTION OF GUESTS: None II. APPROVAL OF MINUTES: Bruce Caverly moved to approve the minutes of the May 3, 2010, meeting. Ruth Kosoglow seconded the motion and the motion passed unanimously. III. CHAIRMAN REPORTS: Dan Webb reported that the sub-committee met and came up with a guideline to educate new property owners regarding common property procedures. Dan Webb will meet with the title companies, Bruce Caverly will meet with the POA and Newcomers meetings, and Ruth Kosoglow will meet with Jeff Meek of the Village Voice. A suggestion was made by David Cohen to print the guidelines on green paper and Steve White volunteered to arrange for the guidelines to be put on the POA s webpage. There was further discussion of forwarding permit requests to Jeff Meek to help with reporting CPFC issues. The committee agreed to send copies of all class 1, 2, and 3 requests to Jeff Meek. Dan Webb advised that Brenda Pate would no longer be the secretary for the CPFC, due to lack of staff in the Planning and Inspections Department. It was noted by Bruce Caverly that he did not want to loose Brenda Pate as the committee secretary. Her years of service and knowledge of the committee s procedures is a valuable asset to the committee. Steve advised that his staff has been cut considerably and it is not possible at this time to leave the office unattended while Brenda attends the meetings. The committee discussed electing a member to serve as the secretary or that each member would rotate keeping the meeting minutes. After some discussion, Ruth Kosoglow moved

that members rotate alphabetically keeping minutes by recording the meetings. The member will then prepare a draft, which will be sent to Brenda Pate for review. Bruce Caverly seconded the motion and the motion passed unanimously. IV. STAFF LIAISON REPORTS: Steve White reminded the committee that the September deer hunt will be coming around soon and its time to get volunteers for the deer check station. After some discussion, the committee agreed that Brenda Pate would prepare a schedule with two hour shifts. The schedule will be submitted at the July meeting. It was also suggested that Jeff Meek print in his article that the POA would accept volunteers from the village to man the check station. Steve also discussed the tree thinning project on Barcelona Road that is being done by Cooper Homes. The thinning has left the area quite unsightly and the POA has received numerous complaints from property owners regarding the debris left behind from the loggers. Steve has been in contact with a representative of Cooper Homes who assures him that areas within 150 feet of the road will be cleaned up. V. COMMITTEE MEMBER REPORTS: None NEW BUSINESS: 1. 10-3 Castellon - # 8 Castellon Drive Jon Sullivan Class 1 -The committee reviewed a request for a class 1 permit, that was issued between meetings, to remove under brush, vines, and seedlings from the common property. Dan Webb visited the site prior to issuing the class 1 permit and visited the site later for a final inspection. After some discussion, Dan Webb moved to approve the class 1 permit as submitted. Bruce Caverly seconded the motion and the motion passed unanimously. Dan Webb moved to approve an annual maintenance certificate for the calendar year 2010. Ruth Kosoglow seconded the motion and the motion passed unanimously. 2. 15-9 Guadalajara - # 38 S. Pego Way Mark Drew Complaint - The committee reviewed a complaint that Mr. Drew has cleared the common property across the street from # 38 S. Pego Way, and has a fishing boat tied to a tree on common property. The complainant, Mr. Byrnes, was interviewed and admitted that he had not actually seen Mr. Drew perform any clearing and he did not know who the boat belonged to. Mr. Drew was not available to discuss the matter. After some discussion, Fred Jonas moved to send a letter to Mr. Drew to cease and desist clearing the common property and to remove the boat from common property. Failure to comply could result in the matter being sent to the POA Board for corrective action. Mr. Drew will be given 30 days to comply. Bruce Caverly seconded the motion and the motion passed unanimously. 3. 14-9 Cielo - # 21 Gloria Drive Carriage Custom Homes - Complaint - The Committee reviewed a complaint that someone has dropped off two pallets of bricks and some concrete blocks onto the common property adjacent to 21 Gloria Drive. Ruth Kosoglow investigated the site and confirmed that the items were placed on common property. The Planning and Inspections Department contacted Jack Bates with Carriage Custom Homes and he agreed to remove the building materials from the common property. The materials will be placed on the vacant lot at 21 Gloria Drive where construction will begin soon. This file will remain open until the committee verifies the items have been removed. Ruth Kosoglow will visit the site prior to the next meeting to confirm whether or not the items have been removed. 4. 27-1 Narvaez - # 9 Narvaez Way Eva Renner Request for annual maintenance certificate The committee reviewed a request for annual maintenance certificate. The class 1 permit was approved and finalized December 2009. Ruth Kosoglow moved to approve the annual maintenance certificate for 6-7-2010 CP&F Committee meeting 3

the calendar year 2010. Beverly Thompson seconded the motion and the motion passed unanimously. 5. 2-1 and 3-1 Palma - # 4 Belmez Lane Marc Richardson Class 2 The committee reviewed a request to cut five pine trees, one small hardwood, and one large healthy hardwood to create a window view. After some discussion, Dan Webb moved to approve cutting the five pine trees and one small hardwood. The large healthy hardwood tree cannot be removed, but may be trimmed to where the tree forks. Bruce Caverly seconded the motion and the motion passed unanimously. The logs may be cut into 4-6 foot sections and left lying crosswise to the slope. The tops must be lopped to within two feet of the ground. Dan Webb will paint the trees that are allowed to be cut. IX. OLD BUSINESS: 1. 3-4 Promesa - # 44 Promesa Drive Eugene Urbanski Annual Maintenance Certificate The committee discussed Mr. Urbanski s annual maintenance certificate not being valid, due to him not having an approved class 1 permit on file. The committee also discussed sending a letter to Mr. Urbanski requiring him to cease and desist all cleaning on common property until a class 1 permit is issued and approved. Bruce Caverly suggested the committee table this matter until he can gather more information regarding this matter. 2. 4-4 Promesa - # 46 Promesa Drive Ray Holmes Annual Maintenance Certificate After a site inspection, Steve White issued the annual maintenance certificate between meetings. Ruth Kosoglow and David Cohen were not in favor of this decision. They wanted the cutting to stop to allow the common property to grow back to its original state. This matter is also tabled until Bruce Caverly can gather more information. 3. 3-1 Murillo - # 67 Murillo Way Ray Barber Complaint The Planning & Inspection Department received a complaint that Mr. Barber built a deck on common property without a permit. Steve White investigated the site and confirmed that there is a deck on the common property. Mr. Barber was sent a certified letter on May 10 giving him 30 days to remove the deck from common property. 4. 2-1 Murillo - # 65 Murillo Way William Hungerford Complaint While inspecting 67 Murillo Way, the Planning & Inspection Department discovered that Mr. Hungerford, at 65 Murillo Way, is continually maintaining the common property adjacent to his home. Mr. Hungerford was sent a letter on May 10 requiring him to cease and desist clearing common property until a class 1 permit is obtained and approved by the CPFC. 5. 17-2 Alegria - # 6 Adaja Lane Terry Theisen Complaint A letter was sent to Mr. Theisen on May 7 giving him 60 days to remove the stone table, benches, and bridge from the cul de sac. Since the letter was sent, property owners on Adaja Lane have contacted the POA and committee members expressing their 6-7-2010 CP&F Committee meeting 4

concern regarding removal of the items in the cul de sac. The neighbors claim that there was a permit issued approximately 12 years ago to Dale Huddleston. After some discussion, Ruth Kosoglow moved to table the matter until there is proof of a permit being issued. Beverly Thompson seconded the motion and the motion passed unanimously. Ruth Kosoglow agreed to contact Mr. Huddleston to inquire further about the permit. 6. 10-3 Castellon - # 8 Castellon Drive Jon Sullivan Request build a seawall on common property At the last meeting, the committee would not approve a stone seawall, but would allow rip rap to be placed on the shoreline to prevent erosion. Since the committee cannot approve stone seawalls, Mr. Sullivan was referred to the Board to get approval to build a stone seawall on common property. Mr. Sullivan has submitted the request to the Board for approval. This file may be closed. 7. 5-1 Alava - # 337 Mazarron Drive Russell Nooyen (renter Chris Nichols) Complaint Dog pen on common property It was confirmed that the dog pen was removed from common property and the file may be closed. 8. 30-3 Soria - # 30 Berlanga Circle William Bartholomew Class 2 This file remains open. X. OTHER BUSINESS: XI. ADJOURNMENT: The regular meeting was adjourned at 3:20 p.m. upon motion made by Bruce Caverly and seconded by Ruth Kosoglow.
